I ordered a 7 and 1 game table for my kids and the seller stated she's too sick to **bleep** my item but it's stating it's out of stock

It is out of stock because it was sold to you.
Did seller say when they would be able to ship it?
If it will be too long of a wait you could ask the seller to cancel order and refund you.

If the estimated delivery date has passed and you still don't have a tracking number, you can file an item not received case.
Not much you can do until then unless the seller cancels.

Well, depending on what they are sick from, many sicknesses have a time frame of expected recovery. Also a seller could ask someone else to ship item for them and no delay.

Did the seller cancel the order, citing 'Out of Stock'? If so, the seller's account took a hit... and you should receive a refund.
