state sales tax

For the first time, I bought an item this morning that included a state sales tax for New Mexico.  This raises a couple of question. 

1.  How does Ebay determine that this is a legitimate charge?  In order for this charge to be legitimate, the outfit must have a physical presence in NM.  Without this, the charge is bogus.

2. How are we certain these collections are going to the state?  Does Ebay collect the tax amount and submit it?
