seller scammed me

hi, a few months ago a seller sold me an unlocked galaxy s5, and there was a defect, the seller takes forever to respond to issues, but i had 3 replacements, all had a defects, the description showed the phone was new except for the unlock. but every phone seems like it had been used before, first one had gyroscope defective, the second had a popping out screen, and the third is missing the IR sensor cap. and now apparently im too late to issue a refund from this scam from ebay and apparently from the so called warranty which is sketchy because the time is always off for their duration. is there a way for ebay people to resolve this? because i just want them to send me a refund so i can go on my way and find another seller that can be trusted.
