The order was created by mistake by my Daughter i send him a request cancelation and the seller doesn't want to cancel the order his pushing me that i have to pay

If you request the seller to cancel the order the seller can hit cancel at buyers request. Just keep asking him to cancel it he should eventually give up and cancel the order for you. He might raise an unpaid item case on you after several days to which you can choose to ignore that and eventually he will get his listing fee back and relist the item. On a side note you may want to secure your ebay account so only you can use it. That way accidental ordering won't happen next time.

Looking back at the threads you posted earlier this year, I see that in April, you posted about buying possibly fake sneakers, which then turned into a claim that the buyer had sent you "a empty box full of paper."

 

Then in August, you posted the same situation--receiving "a box Full of paper" instead of sneakers. It's unclear whether this was the same transaction from four months earlier, or whether this happened to you twice.

 

Now your daughter has somehow gained access to your account, placed an order, and you don't want to pay for it.

 

Judging from your feedback received and feedback left for others, you've had a number of unsatisfactory transactions. A couple of sellers left negative comments in their positive feedback, and you've left a number of negative ratings, a neutral rating, and a negative comment in a positive rating.

 

All in all, in looks like you haven't really had a great run as an eBay buyer.

 

Back to the issue of canceling the transaction, though, please be aware the seller can either accept or decline the cancellation request. Sellers are under no obligation to cancel a transaction, and, best business practice aside, the seller is well within his/her rights in requiring you to pay for an item that was purchased on your account, whether it was by you or your daughter or your cat.

You should be pushing your daughter to pay.

Franklingpina: Why on earth would you leave a negative for this seller?  You and your daughter are the ones at fault, not the seller.  The seller didn't do anything wrong.   You really need to remedy this and see about getting that negative removed.

seller is under no obligation to grant your request

YOU are responsible for all activity on your account.

The seller is under NO obligation to let you off the hook.

The seller needs to file the Unpaid Item Dispute in order to receive a credit on their selling account and to help protect sellers from non-paying buyers like you because Ebay will issue the Unpaid Item Strike on your account. 2 or more strikes will limit your bidding/buying activity.

 

In a nutshell, you BUY, you PAY. Have your daughter reimburse you.

 

P.S. Was your daughter purchasing the Men's Nike's as a gift for someone?

As you are probably aware, under the terms of the UA you're responsible for securing your account access and password.  You are also responsible for paying for purchases made on your account.  Thus my question is how was your daughter able to make the purchase on your account in the first place?

 

With regard to cancelation requests, they are just that, a request, and the seller is not required to agree to any such request.  Thus, if the seller doesn't agree, you are bound to pay for the purchase under the terms of the UA and may be subject to the consequences of not doing so if the seller chooses to file a UID.

 

Not being privy to your daughter's age it is hard to advise regarding how to recouped one's loss resulting from her purchase.  However, I strongly recommend that you take steps to secure access to your account to avoid such issues in the future.

I noticed that you have seen fit to leave negative feedback for the seller because of this issue.  Frankly, I believe that such feedback is totally unjustified and that it shows you to be vindictive because the seller failed to do something that they are not required to do.  Hopefully the seller can get it removed as they should if they filed a UID and won.  However, I believe that your feedback comment may have hurt your purchasing ability from several sellers here on eBay.

If it were me I would have just paid for it and learned an expensive lesson not to let my child access my account.

 

You can’t always cancel.

This happens on other sites too. I was ordering some toiletries and household items from Walgreens the other night and realized about 15 minutes after I hit “submit order” that I’d ordered the wrong thing on one of the items.

I went back and it wouldn’t let me cancel.

So, it is what it is. It wasn’t their fault I goofed up. Policy is policy.

Taking responsibility is always the best route to go.

 

I certainly wouldn’t leave negative feedback for something that was my fault.

@tigercatt-16 , Yep, I was ordering something from another site earlier today, and next to the “submit order” button, it said “once placed, orders cannot be modified or cancelled “.
