False information from Seller on a deal
Hello Dear Community,
First of all let me express to you all a Very Happy, Healthy and Prosperous New Year 2026. I came to your contact you because I am at an impasse regarding a purchase I made and paid for three similar items on December 29, 2025 - item nº 376807233926. At that time, the seller only had one item in stock, and after I messaged enquiring when he would have two more, he replied immediatly that he would have all them the next day and would ship them immediately after payment. Trusting him completely, I bought the three items I needed, paid, and immediately sent a message with my address requesting the tracking number of parcel when shipped. The following day, I received a message from eBay stating that the package had been shipped, but without the tracking number. I inquired him again to have the tracking nº and received a message stating that the items were not in stock and that a supplier would send them to me. So I was deeply fooled by a person with unscrupulous. Realizing I was dealing with a completely dishonest seller, I immediately requested a cancellation of the sale and a full refund of total amount paid. He keeps sending me messages saying the package has been shipped, but it's completely false: it hasn't even been sent. Seven days have gone, and it's just like at the beginning of this unfortunate purchase. All I report you can be fully checked through all messages and my requests to him at My Ebay.
I went to "My eBay" at Ebay France to report that I hadn't received the package, and I got a message saying I couldn't proceed because the seller had already shipped it. which is not true. Most regrettable is that the seller inserts that he shipped the parcel and the buyer is completely in his hands, once Ebay had in the past available the order cancellation and the support of Ebay, today no more available.
The only option I have is to contact the seller, which I've done three times without success. I don't have the option to open a dispute on eBay.
How can you help me get out of this cursed purchase?
Thank you in advance for your invaluable help.
Sincerely,

·9 months agoHi, 100% agreed with others. Wait until a few days after the estimated delivery date & file an "item not received" case. Keep in mind however, that the estimated delivery date has been estimated by ebay (not your seller) & can often be a bit unrealistic. So try to be patient. Though most of the eBay procedures are now automated - they are fairly eazy to use. Good Luck! I Know That Everyone Here Hopes That This Works Out A-Ok For You!

OP9 months agoDear jbbowers12012,
Thank you for your kind help. My problem is not to be patient at all. It was to be cheated by a swindler that informed me false situation (item's on stock), got my payment, inserted a shipping that not happened after all these days and is smiling in my face once he knows that I'm tied. I feel completely unprotected, waiting so much time for a good I shoud receive in 4/5 days.
All the best to you
Kind regards

·9 months agoA day after the estimated delivery date Ebay gave you, open an Item Not Received case.
Go to your purchase history and click I didn't get it in the menu next to the item.
The seller will have 3 days to provide a tracking number showing it was delivered or refund.
If they don't, return to the case on day 4 and ask Ebay to step in.

OP9 months agoDear kensgiftshop, good evening to you and many thank's for your advise. However in my humble opinion is clear that this seller is violating the rule of dispatch the parcel within 4 days after payment, as it's stated on payment conditions. I tried to send you 4 photos of item insertion, order information, shipping condition / timings and purchase history, but could not find the right way. The problem is that Ebay trusts something that has not happened : putting on My Ebay the false information that he shipped the parcel, I cannot do nothing than expecting. Not fair at all. The Ebay original insertion of the item states that dispatch is made through colissimo suivi that means TRACKED, which not happens.
One doubt : A day after the estimated delivery date Ebay gave me, is it possible in the menu to open an Item Not Received case ? On item purchase history that option is not available.
Really a nightmare. Thiese rules are a protection to the swindlers. Sorry for my heart cry !!!
Keep always fine

·9 months agoEbay does not know whether the seller shipped or not.
It uses automated procedures to evaluate sellers and handle problem transactions. Those procedures have not been triggered. You may be correct in your evaluation of what is happening but it is not yet time for Ebay to act. When the estimated delivery date been exceeded by 3 days you may open an item not received case,

·9 months agoActually, when one day has passed since the EDD, I believe the buyer CAN open that INR case; however, we often suggest that the buyer give it a few more days, especially if there's tracking proving movement.

OP9 months agoHello again soh.maryl,
Many thank's again for your information. But that is the crucial situation : enquired two times by me, the seller informed that he doesn't shipped the parcel once he had not in stock the three item's, when previously (and in order to attract my purchase) he said that the item's were in stock and ready to be shipped on day after. All is in messages exchanged between us.
When shipped tracked express (which is my case) it appears on the purchase history panel the tracking nº, that it's not there. So I'm in a situation "don't hold your breath".
Kind regards

OP9 months agoDear tobaccocardyahoo,
Thank you so much for your kind help. In fact on day after shop (02/01/2025) the seller inserted on "My Ebay" that he shipped the parcel untracked, in order I cannot in any condition to ask for cancel order. Normally it was time to have arrived by the 06 or 07/01/2025 once is express post from France to Portugal. I will follow the indication suggested by Dear members and wait the days indicated by Ebay.
Kind regards

·9 months agoYes, as Ken told you, if you do not receive the item by its latest estimated delivery date, an item not received case can be opened the next day. We often suggest, however, that you give it a few more days, given the USPS situation, especially if there's tracking showing that it's moving through the system.
Just curious: You do not appear to be a seller, at least on this ID, and have been a member for 20 years, buying only. Is this the very first problem you have had with a seller? Also, have you read the Money Back Guarantee?

OP9 months agoDear soh.maryl
Thank you so much for your information. I can give all days suggested by Ebay, but it was already time that the parcel should arrive once it was clearly indicated in Ebay insertion, paid a express tracked parcel (normally arrives in 4 days after shipment). That is not the critical situation bu the tfraud of informing I could buy once in stock, and until today it is not. So the seller cheated me knowing that once indicated that the parcel was shipped, I would be "tied".
I'm not a seller but only buyer since the beginning more that twenty years ago. I had just one similar problem some years ago and was much easier once option of cancelling the order face to a fraud like this was immediate. Selling what was not in stock and still after 8 days is still same situation, putting wrong information (shipping) to avoid Ebay action, was severely condemned. At that time all options were available on "My Ebay", which does not happens now in a short acceptable time. But ok........it is what it is.
Kind regards
