Item shows as "Delivered" and returned to sender. Seller wants me to dispute as they can't refund
So I bought an item from Italy and it was shipped to the US via Italian Post. But after about a week of sitting in Italy it never got on a plane to the USA and was re-routed back to the sender/seller. I asked them what was the issue and why it was returned to them. They simply said they will speak to their post office. The tracking shows Returned to Sender and eBay app shows "Delivered" as if I received it, but if you actually look at the tracking details, it's "delivered" back to sender in Italy.
Now I said, sure I will wait but to let me know if they'll be sending the item back to me as I still wanted the item back then. I thought maybe the seller was just speaking to their post office to confirm what the issue was so there is no repeat of the shipping problem. Now after waiting more, they're saying their post office isn't replying to them. I said, I'd now rather get a refund since I've been waiting for some time. They refuse to refund me and also saying once it shipped eBay doesn't let them refund after a few days... And want me to open a dispute to protect themselves. I'm confused because it already shows it was delivered to them, I'm the one who is out still... Also I am a seller myself and have issued refunds in the past and didn't encounter this inability to send refund after it ships.
Now I can go to try to dispute but I read on here that if I file an item not received, I would lose the automatically because eBay app will take a look at the tracking and it will show "delivered". The app they said won't look to actually see the details of what country it was delivered to and immediately rule in favor of the seller. Is this true? Anyone has this experience?
So I'd like some advice on how to proceed with this. I'm not sure how to handle it via the eBay app and I don't know what other avenues I can raise this up to. I also still don't understand why this seller won't refund me and be done with it, they have lots of positive feedback and as far as I know have the item back.

OP2 years agoThank you both. I opened an INR case. I completely forgot the appeals process. I was mostly concerned about the automatic decision in favor of the seller due to it being in delivered status by the app... but it was back to the seller.

·2 years agoSorry you got such bad advice @the_shinsengumi_store and got tricked by the seller.
Please update after
-- your INR case closes
-- you're not issued a refund
-- you cannot leave feedback for the seller
-- and your appeal to look at tracking is also denied.
Instead, both PayPal (file your INR dispute here) or your card issuer will look at tracking and issue your refund.

OP2 years agoHi. So you think ebay will side with the seller? I actually called ebay and they were the one who opened the INR case after I explained to then the "delivered" status was Italian post delivering back to sender. Seller right now sent ebay a reply that they need to keep on waiting because he's still waiting on the Italian post manager to reply. Ebay rep says to call them again after a few days or just go to the app to have them step in after a few days. I don't understand why this seller won't refund me. He's also not being very clear whether he received the item eventhough I told him it shows delivered back to sender. He's not been saying he didn't receive it nor has he ever said he has it which is weird. He has over 100 in feedback but just seems so hung up. He saw it never left italy. Oh well I guess if this gets worst I can try a PayPal or card dispute but I'm not sure what will happen to my ebay account whether ebay will hold my account not in good standing if they decide in favor of the seller and I do a card charge back or PayPal dispute. I just hope ebay does this right because I didn't get the item and it never left Italy to go to the USA even if the ebay app shows delivered (to sender). Why that happened I don't know. Why this seller is not being very clear and seems to keep stalling I don't understand either.

·2 years ago"ebay will hold my account not in good standing"...you are the buyer and if you make a dispute with your banking source whether a credit card or debit card...eBay steps aside and the bank decides what to do.
Will eBay not give you a "happy face"...of course..but it does not affect your account..."if" it is your first dispute. Keep that in mind. Everyone counts from 1 to 10 nowadays. Best to do it online with your banking source...less questions...just clink..."dispute"...and go from there. Keep in mind too many disputes with your banking source is not a good thing....Doordash...Uber...etc just to get the picture. Good luck.

·2 years agoYes whenever you ask customer support for help -- after tracking already shows delivered, but not to you -- eBay will always open an INR for you, and assure you that they will review tracking to decide the outcome.
It's a lie. The INR case wil close without a refund, feedback is blocked/removed if already left, and your appeal will automatically close also without a refund.

·2 years agoFile an INR and see what happens.
if the seller is honest, he'll be able to refund.
If it does get closed, appeal and have them check the tracking.

·2 years agoFile an item not received claim and go from there. If you don't, you will not get your money back.
