Will I receive a "ding" if I refund orders without opening a case/dispute? | Selling

Hello,I am at situation where some of my orders are stuck somewhere(probably customs warehouse), because of the new import customs rules in the USA.I am aware if buyers open an INR requests for these shipments, my account will be flagged, my BBE will get very high, and therefore I can be suspended.I already have 4 INR's for this reason.I may have 2 options:1.Write to the buyers, ship another items at my cost with DDP, and wait for delivery .2.Refund the whole amount of the orders.Will I receive a "ding", or any other defect, if I just refund them, without opened a case/request by them?If they put me a negative feedback for this, am I eligible for removal as the reason is the new customs import rules?I will be happy to see your thoughts.
