Why are ANY Dvd's being allowed to be sold when it's wrong to do so.
With all these copyright laws and things, why is Ebay allowing ANY dvd to be sold on here when each dvd says on the back "For Private Use Only"... So when you sell any dvd, aren't you violating and infringing on the copyright of the movie and distribution rights of the Studio who released it? Isn't that called "piracy"?? Here's a thought...get rid of the entire category of movies, dvd's, vhs, records, laser disc and all others and not allow any of these to be sold Ebay?huh? Explain to me about this "Fair Use" thing I've heard talked about when you don't have the right to sell ANY movie and make money for yourself? Inquiring minds wanna know Ebay.

·1 year agoeverything that you stated above is not true, the private use means that you can play the DVD in a public setting like say a bar.

·1 year agoWell you might as well ban charity shops ,boot sales there is only so much that can be policed ,I'm sick of how many modern films claiming to be public domain when they have not reached the 70 yrs barrier

·2 years agoThe physical disk is what you purchase and own when you buy a DVD. The media on the disk is what does NOT belong to you, and you have no rights to that portion other than to play and watch it yourself. But it can be transferred in a one- time sale as the original disk.
you CAN sell that disk as you would anything else you have purchased and owned, that is your only right. You just can’t profit by showing the media, copying it, or otherwise infringing on the copyright of the media owner.

·2 years agoYou are misunderstanding COPYright law.
Home use DVDs are marked that way because it is a copyright violation to broadcast or show the content in a commercial or public setting (Like a Bar for instance)
You are perfectly entitled to sell unwanted DVDs second hand, just like it is perfectly legal for DVD shops to sell DVDs market that way new in the first place. Technically speaking, anything you buy Retail in a shop 'new' has been 'Owned' by at least 3 other companies before you got hold of it.
What is illegal is to make a copy of a DVD and sell either the copy or the original while retaining the copy.

·2 years agoYou could also say it's wrong to try and sell a very common old stamp for $25K as super "rare" because it has the usual side-alingnment lines, just because you saw someone else doing it.

·2 years agoPrivate use means you can't show them in public. Like setting up a screen at a park or such. Or setting up a movie lounge at your local store. You can resell the DVD just not make copies of it.

·2 years agoI'm in Canada, so please excuse me if this question comes off as being a bit whack, but how does a message of "for private use only" mean "cannot be sold or resold" if the buyer is using it for their own private use?

·2 years agoCanada is a socialist country leaning towards comunist.
US is a democratic country leaning toward socialist.
We are at different points on the scale, and laws reflect that.
I've seen books with that 'cant be resold' stamped on it, and sold them anyway because (so far) this is a free enough country that I can sell most things that I own.
Hey Marno ... can you sell your used Ford truck? Or do you have to scrap it when you don't need it any more ...

·2 years ago'Can't be resold' is not meant for an individual who purchases/receives that item. It is aimed at the distributors of the item-- for example, when I worked at GameStop, we would receive preorder bonus items that were meant to be given out to people who preordered copies of a particular game. They were all marked "Not for resale" because WE, GameStop, were not allowed to sell them as they were items specifically intended to be given out for free with a purchase. If the people who received those items with their copy of the game wanted to then turn around and sell them, that was perfectly fine.

·2 years agoWe don’t have Fords in Canada. Fords are products of scummy capitalist countries. We drive old Ladas and Yugos made before the USSR collapsed. But we don’t own them; King Charles does. As head of state, his mother Queen Elizabeth distributed them to families in an ambitious program started in the early 80s. But plans to replace them every five years collapsed when the Soviet Union imploded, so now we have to keep these vehicles going much like Cubans do with theirs.
Charles is okay with Canadians trading cars, at least.

·2 years agoThere are, or at least used to be. The DVDs sent to Blockbuster didn’t have that mention and would cost BB much more than regular home consumer copies.

·2 years agoNo, you aren't. "For private use" means you can't show it and sell tickets, and you can't make copies to sell. But you can re-sell the item itself.

·2 years agoSame is true often for fabric. You can sell a piece of Disney licensed fabric but you cannot make something out of the fabric and sell it

·2 years agoYes, you can. The first sale doctrine means that once the copyrighted item is yours, you can not only resell it; you can do with it as you please before doing so. This means you can take pages out of a book and use them for a decoupage item that you sell; or sell individual ad pages out of magazines; or you can make something out of an authorized copyrighted fabric and sell it. But you can't use your embroidery machine to make a copyrighted or trademarked design and sell that item.
The trademark comment (usually something like "for home use only") that appears on the selvage of some fabrics is bee ess. Here's a case where Disney backed down from challenging the re-sale of their fabric in the form of handmade items. Scroll to the bottom of the page for a wealth of links to trademark issues and education.

·2 years agoNot sure about the US, but a DVD previously owned and being sold or given to someone does not infringe any laws over here, no more than selling a book you no longer want coz you have read it.
Now renting the said DVD to someone and profiting that way, is another story.

OP2 years agoThe US has some odd rules on what can and can't be done. The US is very a*al on things like this, where as other countries dont seem to be bothered by this at all.
