Who is allowed to Presale an item?
If I purchase an item somewhere on a presale, can I turn around and sell it on eBay before I actually get it out of I don't know the exact release date?

·1 year agoI would suggest you think about that question a bit more.
You want to buy something on another site that is being Presold, you DON'T know the release date and you want to sell it here???
Do you want to do that BEFORE or AFTER you actually get the item??
If it is BEFORE, think about this logically, does it sound like a good plan? When are you going to tell the buyer you are going to ship the item? I hope to ship within the next week, month, two months etc. Some of which would not be within Ebay rules.
I would certainly not recommend selling it here until AFTER you receive the item. There are rules on the site and you might even risk getting sanctioned.

OP1 year agoI'm not planning on going this. But other sellers do it. I'm wondering what about the rules. I read the terms but I'm still not sure. I think my brain is calcifying. If so, it's a calcified brain thinking that, so I could be wrong... Either way, I appreciate your understanding.

You have to be able to have it shipped to the buyer within 40 days.

·1 year agoYeah, there's tons of ways it can go wrong. Many of these sellers probably intentionally set up the listings in ways they know will let them avoid the MBG, but obviously sometimes it's just ignorance of the rules. Either way it can really burn buyers.

·1 year agoThat is a recipe for disaster. It is not that some get away with that but others can have their accounts canceled if you end up canceling too many sales due to delays in the announced release date.

·1 year agoRemember that you are essentially just the buyer's "backup plan" because if the buyer finds it cheaper after it is released, they will return it to you for a refund and you may not longer be able to sell it at a premium.

·1 year agoNo. eBay requires you ship within the listing's stated handling time which is a maximum of 40 business days. This means you have to ensure the product will be physically in your hand before that to fill orders. You should allow a cushion for delivery delays getting the product, too. While 40 biz days is approx 2 mos, you shouldn't list the item more than 6 weeks before you expect to have it in hand to allow for that cushion.

@wastingtime101 If one does see a listing that promises delivery withing 90 days (more than 40 business days) should that listing be reported?
Are there any situations that one should not report that listing to eBay?
If a buyer does purchase a presale item outside of the 40 biz days, would they still be able to use the eBay MBG if it arrives not as described?

·1 year agoI would say (and I know I'm not @wastingtime101 ) that yes, it should be reported, but that you shouldn't be confident it will be correctly removed. It does explicitly violate the presale policy. If anyone wants to see that policy for themselves, it's here: https://www.ebay.com/help/policies/listing-policies/presale-listings-policy?id=4252
The wording that covers that: "Presale listings must guarantee that the item will be shipped within 40 business days of purchase". There's not really any nuance in that. If the date the item is advertised to be shipped is more than 40 days after purchase, it violates the policy.
As for the MBG guarantee, that gets tricky depending on how the seller set up the listing. The MBG guarantee is supposed to cover customers for 30 days from the delivery date, but I have seen many situations where customers were strung out because of a presale that was not shipped for 90 days or more, and they could not get and INR or INAD claim even filed with eBay. If the presale shipped, say, 50 days after the purchase and was delivered relatively quickly, they might still be able to, but at some point that window for the MBG closes depending on a few factors, and if the item doesn't arrive or is not as described, the only option is a chargeback with their bank (assuming they don't receive it too long after the purchase for that as well).
