UK CE requirements, Toys, etc

There is an announcement on the UK concerning the CE marking requirements that has interrupted the sale of toys and other items to the UK on Ebay.

and in this information is a section about used items:

Second-hand products

In most cases, second-hand goods are treated in the same way as new goods when placed on the market in Great Britain. If second hand products are further made available, they must meet the requirements that were in place when they were first placed on the market, unless there is specific provision to the contrary. If second-hand goods have been substantially modified, there may be a need for re-assessment and remarking.

There's been alot of discussion/angst about not being able to sell some items, particularly used toys, to the UK because of the necessity of the CE requirements which went into effect 2021 or so.........which blocks products not carrying the designations.........because they were manufactured prior to that date. This seems to say it is legal to offer/sell the items IF one has a date of manufacture prior to those dates......

First time I've seen the subject of "used products" addressed.

Can you check with the appropriate "teams" to find out when/if more information will be forthcoming as to this section of the law will be available?

Hi @dhbookds. We have heard back from this team who stated the following:

"All toys much be CE certified if they are being sold to the EU or UK. There are some exceptions on toys, but we would recommend reviewing https://www.ccpc.ie/business/product-safety/toy-safety/ here."

@elizabeth@ebay Thanks for the followup.........I assume "all toys much be CE..." means MUST be......... Of course that is impossible with toys made prior to the passage of the law..........which I think is 2020 or so..........

The law clearly states........they must meet the requirements that were in place when they were first placed on the market.

So ebay is choosing to ignore that...........their choice, I guess..........

They have some strange rules too. I purchased a Monster Rancher Tiger plush from over there. The horns did not stick out to a point. They were curved back. I had never seen Tiger of the Wind depicted in that way. They are just soft cloth not plastic by the way. I sent an email to the company and asked about it. I was informed their laws required it to be made that way.
