I understand the brand Tommy Hilfiger is on the VERO list. I have some shirts I got at an estate sale, they're preowned. May I sell preowned T H on eBAY?

·2 years agoI'm gobsmacked that anyone would bother faking Tommy Hilfiger - it seems to me that it's the logo, not the design, because most of these designers are rather uninspiring.

·2 years agoJust curious where you got this information given how many TH items are listed on eBay. Sounds to me like an issue involving fake TH, TH photos or something else inappropriate in the listing

·2 years agoAs far as vero goes, I would have no hesitation selling a used anything here on ebay.

·2 years agoVeRO was established to protect the rights of trademark and copyright holders, by removing listings which are counterfeit or otherwise infringe upon those rights. If an item is legitimately licensed then it is OK to sell it here. At the moment there are over 240,000 listings with "hilfiger" in the title or item specifics. Some VeRO members abuse their option to object to listings, and they get legitimate items pulled, but that's just a few companies and the rest are OK to list.

The only way to be absolutely safe is to not list it.
That said the one place where I have found we run into trouble is here:
Tommy Hilfiger and its licensees design, manufacture and market classic American
sportswear for men, women, children and toddlers, as well as eyewear, footwear,
outerwear, leather products, jewellery, watches and fragrances, all bearing the
renowned TOMMY HILFIGER name, trade marks and logos.
“Tommy Hilfigerâ€, “Tommy Jeans†and our iconic “flag†device
are registered worldwide along with many other trade marks. The use of any of these
Trade Marks without Tommy Hilfiger’s permission is trade mark infringement.
It is this use of trademarks, that is usually what triggers the bots into action, I also wouldn't waste time getting "permission" as that won't stop a bot from finding and flagging a listing. Your best bet would be to take your own photos and avoid using trademarks on unrelated products (velcro, onesie, lego, kevlar, etc.), also I would stay away from stating that your product is "OEM" or "genuine" or anything of that sort. Stick to the facts of the product, list it by name of product, what it is, you may include the brand name or leave that out too.
Come to think of it, just list it as a shirt and give the color and size and then take plenty of pictures, leave the brand name out of any verbiage might actually work too. Or list it and see what happens but if they do flag your listing do NOT relist! Once flagged you'll need to stay away from listing that company's products.

If I am selling a non name brand item and show the Tommy Hilfiger trademark on one of the pictures or using the word Tommy Hilfige at all in the listing, that is trademark infringement. If I buy a counterfeit tshirt from China that has a TH logo and I try to sell it, that would be a trademark infringement. If I went to my local clothing or thrift store, bought a tshirt with the Tommy Hilfiger logo made by TH or one of their licensed manufacturers and I listed it on ebay, that would NOT be a trademark infringement as that logo is legally being used on the tshirt.
As @nobody*s_perfect stated, some Vero members abuse their option to remove listings will have it removed even though it is perfectly legal to list it. Those companies are in the minority and unless you know that a particular company is abusing their Vero rights, there is no reason to avoid listing that name brand. Saying not to list it just in case is like saying that you shouldn't list anything here just in case the one particular buyer who is going to buy that item is dishonest.

·2 years agoWhen they are on the VERO list, it doesn't matter if they are new or used, they cannot be listed or sold here.

·2 years agoThis information is inaccurate. Of course, if the item is valid and authentic, you can sell the items (new or used)
Use your own photos and descriptions and be sure that your items are authentic and you can sell them.

·2 years agoSo if you were to extrapolate this theory far enough it would mean that no item could be resold if the manufacturer did not want you to and most of them do not want you to.
