The future of eBay arbitration fraud…….
Im sure future eBay arbitrations will be a lot like “financial regulator†FINRA’s arbitration fraud, brought to you by Wells Fargo, among the many.
Except for the horrifying facts that FINRA is supposed to be a financial regulator and eBay is about as unregulated as a corporate turd can be. FINRA is actually a “private regulator†working under the SEC’s authority in the capacity of a cross eyed secretary “just sucking†under the SEC chairman’s desk.
On the upside however, there “might†be awards NAMED AFTER the “worth every penny†chief executive presiding over widespread arbitration fraud. Big prestigious awards, so nobody forgets their contributions to “fairnessâ€.

·1 year agoeBay did recently change their arbitration clause in the new User Agreement that is effective on May 16th.
The big differences I noticed is you must give them a 60 day notice (instead of 30), in addition to physical delivery you now have the option to eMail the notice and the arbitration administrator has changed.

Well, there's also this very important detail, which eBay has determined is so important that it has its own separate sub-paragraph:
[Beginning of Quote]
"2. Waiver of Jury Trial
YOU AND EBAY HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT
AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. You and eBay are instead electing that all Disputes shall be resolved by arbitration under this Agreement to Arbitrate, except as specified in Section 19.B ("Agreement to Arbitrate")."

Waiver of a Constitutional Right is a pretty big deal.
People have the right to Opt-Out of the new provisions for arbitration of legal disputes,
as long as they have not used eBay services, meaning buying, listing, or selling, among other actions,
no later than this coming Friday, May 16, 2025.
The applicable new sections of the User Agreement do explain how to Opt-Out, with a link to the one-page Opt-Out Notice in the new sections. You would have to print it out and fill in the requested info, which is your name, address, telephone, your eBay User ID(s) and the e-mail address(es) connected with your eBay User ID(s).
Sign it and date it on the appropriate lines. Then mail it to eBay's Legal offices in Utah. The address is printed at the bottom of the form. It has to be post-marked no later than May 16, 2025.
You will have to provide your own postage stamp.
If you choose to send it via FedEx or UPS, you would have to pay those charges yourself.
eBay itself, however, has pointed out that if eBay users just cannot bring themselves to accept these new terms, they may close their eBay accounts and essentially walk away for good.
