I'm in a mess here! I just received a letter from KS Dept of Revenue Notice of Non-Filed Returns, saying I have returns that have not been filed with the department. I'm sure it has to do with eBay taxes. I got into my hub & found all the taxes but not the amounts, from April of 2022 to December of the same year.
Since eBay collects the taxes on items sold, I thought they would send those to KS Dept of Revenue???
I can't ever get a hold of anyone at eBay on the phone so am asking the community for help.
I do have a Retailers' Sales Tax Registration Certificate.
I would REALLY appreciate any & all help youcan provide!

·3 years agoEven though eBay does collect and remit, as I do have a Sales and Use Tax Permit, ND still requires me to file a quarterly sales tax return for all sales. They just get classified as non-taxable sales as the tax has been collected elsewhere. Could this be your situation with KS?

·3 years agoWhat I'm about to explain below, run it by with a call to the Kansas Dept of Revenue. DO NOT TALK TO ANYONE ON THE PHONE AT EBAY -- THEY ARE TOTALLY UNRELIABLE !
Ebay already paid the sales taxes to Kansas for any sales you made to other Kansas resident addresses. They also paid the sales taxes your buyers paid in other states. Ebay did that for you, so you don't have to. But that doesn't keep you from having to file sales tax returns to your state, if required.
From the limited information you have given in your post, it appears that it is your RETURNS to the KS Dept of Revenue that you have not filed for the last 3 quarters of 2022, not the actual payment of Kansas sales taxes. Because you have a Kansas Sales Tax Registration Certificate, your reports to that authority are not eBay's responsibility - it's yours, and that is what they are very possibly contacting you about.
I live in Idaho, and the sales tax laws may be slightly different, but they could also be very similar. I have what's called an Idaho State Tax Commission Seller's Permit - probably the counterpart to what you have. When I lived in California and sold online to my California online buyers, I had a California Franchise Tax Board Reseller's Permit. I filled out a return every quarter in order to report and pay the State I live in for the sales taxes I collected from buyers ONLY in my state of residence at the time.
In Idaho, I now fill out Idaho's return (only once a year). When eBay started remitting the sales taxes to Idaho for me last year, Idaho Sales Tax Authority personnel told me to NOT include any sales or sales tax information from my eBay and Amazon sales, as those marketplace facilitators already do it for me... But I still had to file a return if I wanted to keep the permit for things like craft shows, gun shows, organized street fairs, or any other entity where I sold items and needed to collect and remit sales taxes in my state. Consequently, my return for 2022 had all zeroes in it.
Again, contact a tax professional, or better yet the authority in your statement and get clarification. But my guess is that you are still required to file a return, even though eBay now remits Kansas sales taxes for you. That's what makes sense to me...

·3 years agoI don't see how anyone here can possibly help you. I don't see how anyone from eBay can, either. You need to contact whoever sent the letter from the Kansas Department of Revenue to determine just what it is that the department needs.
Since you are in Kansas, only the eBay sales you made to others in Kansas are relevant. Kansas has no interest in sales you made to buyers in other states the sales taxes, if any, those buyers were charged.
Or, perhaps there is question not about the collection and remittance of sales tax at all, but about your use of your resale certificate.
I know that all sounds unuseful but, really, the chances are slim to none that anyone here is sufficiently familiar with KS sales tax issues to advise you, even if it were clear what the issue is.

·3 years agoPrior to eBay starting to collect Sales Tax were you registered in KS to collect and remit sales tax?
If the answer is yes then in most States (maybe all) anyone registered still needs to file returns even if they did not collect the Sales Tax. Every State has a different system but you would still be reporting your sales, some States it's a NIL filing (if you only sell on eBay), in other States you report the amount collected by eBay and then deduct the same amount (tax collected by eBay) on a different line.
There is no point contacting eBay about this, you need to contact the KS Dept of Revenue (or look it up online) to see how they want you to report.

Is the letter referencing sales taxes or income taxes? Both are totally different animals.
