STOP SHIPPING WITH EBAY !
i just got screwed out of $80. and my item. Ebay scam .buyer claimed the speaker i send was damaged. The speaker was in perfect working condition when i carefully boxed it up. Buyer claimed other wise. The speaker was damaged by fedex or the buyer. The buyer put in a claim for $80. So I had a negitive balance in my account. The buyer refused to put in a claim with fedex. Also tried to scam for parts to fix claimed damage.Due to this scam i refused to send the buyer a shipping lable for return. If the post ofice, fedex or ups damages or loses you item you the seller are responsible. stop shipping with ebay.

·2 years agoThe only 'scam' is you refusing to send your buyer a return label. That allowed you to lose your item and the money.

·2 years agoYou could also sell items on online auctions, most have a as is where is policy with absolutely no recourse for buyers which seems to be what you are looking for but in any case you definitely are not cut out to sell on ebay and everyone would be better off if you did not.

·2 years agosome thoughts and questions:
Did you review this buyers' profile and all feedback?
Shipping with FedEx is the worst. They are known for damaging packages.
Did you overpack for safe delivery? Did you mark the package with anything like 'fragile', handle with care', or even 'glass'?
Did the buyer ever entertain sending photos of the damage area or to show that the FedEx box was damaged?
Overall, I think you just scammed. Buyer was probably replacing their own broken speaker.

·2 years agoIt isn't the buyers responsibility to put in a claim with the shipper, that is your responsibility. Insurance is for the seller, not the buyer. Your problem literally has nothing to do with eBay or eBay shipping. eBay's MBG is there to protect buyers, not the seller.
mam98031
·2 years agoHow did this problem become Ebay's problem? I don't understand why you are advocating not to use Ebay shipping? What does that have to do with your issue?
If you have the item insured, you can start the claims process with the carrier.
By refusing to send the buyer a return shipping label, you are only hurting yourself and your account. In a couple of days, the option to ask Ebay to step in on the Request for Return will appear and if the buyer checks that box and force the refund. When they do that, sometimes they will have the buyer return the item and sometimes they don't require it. You will not get your FVFs refunded either even though Ebay will force you to refund the buyer.
I get it why you are upset. But the way you are going about it, you will only cost yourself more money and hurt your account.

·2 years agoI am experiencing a similar issue. Buyer claimed the product was different as advertised and requested a return 32 days after receiving. I promptly responded and shared evidence of what I sent was in fact, "as advertised." Ebay just randomly determined in favor for the buyer, despite my many attempts to call and clarify that the buyer's claims were not accurate. Now they charged my bank, which should be illegal, and having to stress through this issue.
Curious, if you ever found any resolution?
kensgiftshop
·2 years agoWhy should it be illegal, you gave them permission when you decided to sell here.
Did they refund the buyer or just holding the funds?
There's nothing the OP can do.

Most savvy sellers leave enough funds in their accounts to cover any unforeseen issues like an unexpected return. It is strictly up to you to maintain some working capital for the smooth operations of your day-to-day business.
“The buyer refused to put in a claim with fedex. Also tried to scam for parts to fix claimed damageâ€
When there is shipping damage, it is the seller who makes a claim with the carrier, not the buyer. The seller refunds the buyer and then collects from the carrier, in that order. The buyer is not expected to wait for the carrier to compensate the seller, either.
You blew it if the buyer was willing to fix the damage and you would not cooperate. You essentially forced your buyer into seeking satisfaction thru eBay’s Money Back Guarantee, by failing to acknowledge the possible legitimacy of the buyer’s report of damage.
@vr6scirocco88 It seems you are sadly unaware of your responsibilities as an eBay seller, as you are doing the opposite of what is expected of you.
Your inflexibility to accept any responsibility for the outcome of this failed transaction, or to learn from your mistakes, and then to insult those who are giving you valuable spot-on advice, will only create more needless chaos and worse problems for you.

All that not accepting the return is going to get you is a refunded buyer that keeps the item.

·2 years agoYou seem to have a major problem in being educated by most of the people here taking the time to reply to your posts. Everyone replying is telling you like it is, but you refuse to understand. And as you have stated over and over, have you read their replies? We don't make the rules, eBay does and most of the people replying have learned from experience and taken the time to understand these same rules that ALL sellers must abide by. Your feelings have nothing to do with running a business. By signing up to sell on eBay YOU and only YOU agreed to the eBay fine print on how you sell. If you don't like their rules, then you should try a different platform to sell on. I wish you luck.

·2 years agoIt's not a scam if you refused to send the buyer a return shipping label.
vr6scirocco88
OP2 years agoi have sent the buyer a return shipping label once in the past. the buyer never sent the item back. ebay did nothing to resolve the issue. ebay will always favor the buyer over the seller. this is a scam. the buyer has his $80. back and the speaker. the speaker sold for $50. shipping was $30. so you and ebay want me to send the buyer $30 more for shipping back to me? lame. this is a scam!
kensgiftshop
·2 years agoIf the buyer didn't return the item, you don't have to refund.
You wouldn't be sending the buyer $30, you send them a shipping label to return the item.
If they don't use the shipping label, it cost you nothing.
mam98031
·2 years agoThere has to be more to this. Because when there is an INAD filed, the seller has issued a return label, and the buyer never sends the item back, in a few weeks, that claim would close in the favor of the seller and the money would not be refunded to the buyer.
So since you objected to pay for the return shipping, did you issue the return label or didn't you. You say "Ebay want me to send" but earlier in your paragraph you said "I have sent". Which was it?
If you did not send the return label, then you were fighting the INAD. After about 3 days or so and option appears on the claim where either party can ask Ebay to step in. If that happens, you are right, Ebay will likely rule for the buyer and force you to fully refund the buyer.
BUT had you of actually issued the label and the buyer just didn't ship it back, you would have won that claim and no refund would have been sent the buyer. Also you would have never been charged for the shipping label because it wasn't used.
kensgiftshop
·2 years agoYou scammed yourself by not accepting the return.
vr6scirocco88
OP2 years agowrong.tell me why ebay always favors the buyer over the seller? this is a scam. the buyer got the item for free.
kensgiftshop
·2 years agoBecause they need buyers a lot more then they need sellers.
If you had accepted the return and provided a shipping label, you would have got the item back before refunding.
oldwestgold
·2 years agoYou have left dozens and dozens of the same feedback to buyers blaming eBay for apparently a delay in your shipping. And to quote pages and pages of what the feedback left shows: "slow eBay payment delayed shipping. sorry." Why? Why blame eBay for your delays in shipping on every sale? 99% of the feedback you left for buyers is the same line.
Everybody here should just stop trying to help this seller. They do not want our educated and experienced help. Save yourself a few minutes in replying to this OP and just move on. I'm out.
oldwestgold
·2 years agoThen you should not be doing business if you do not understand these simple principles in shipping what you sell. Sorry. Your assumptions that it is a scam just could be wrong. Maybe the buyer did receive it busted up or not working. How it got that way is not the buyer's problem. That's between you and the shipper YOU chose.
lonebuck-books
·2 years agoNo, the scam would have been if the buyer purchased an $80 item, got it damaged and eBay/seller told the buyer "too bad, so sad". Nobody was scammed (if it was really damaged), you simply didn't follow the correct way of handling the problem. Oh, and I didn't even look but let me guess, you had the 'no returns' option turned on for your listing. If so, you caused all of this yourself. On eBay, there is no such thing as no refunds. All the no returns option does is force buyers into filing a claim and using the MBG nuclear option when there is a problem. You would be much better off changing your listings to the standard 30 returns buyer pays return shipping option. It protects you from this sort of thing and gives the buyers more confidence in purchasing from you.
broto_64
·2 years agoHad you issued the label to your buyer you would've likely...
And I say likely because I think you argued with the buyer, so had you issued the return label it is likely you would've got your speaker back in working condition. Then you could have re-sold it, recovered a portion of that $80.
Of course it's annoying to ship our wares cross country and back all for someone's show and tell, but I have more bad news: When you refused to cooperate with this buyer's return and ebay had to step in that means you were also issued a super defect and you probably don't care but sellers are only allowed a very few of these before ebay Mc999's that seller. Also it likely won't show up until the next quarterly review but believe me it's there, having one of these won't hamper your selling efforts here much but 2 or 3 more of them and...

·2 years agoA used speaker?
Did you know that a speaker has small solder joints with 2 wires and if you drop a speaker off the 2nd floor balcony, that it could 'break' one of those joints?
Did you know that ALL items Shipped by ANYONE ANYWHERE are treated the same way?
Did you know that the buyer CANNOT do a claim with ANYONE- that YOU, the Seller- has to do it?
Did you know you are 100% liable for all items YOU ship and that YOU would have to 'refund' the buyer?

Either the sender or the receiver of a USPS package can file an insurance claim with USPS I am not sure about Fed-Ex. It is actually much easier for the receiver to do so since often USPS will want the claimant to take the item and the original packing to the post office for examination.
I have filed claims as both the sender and the receiver.
kensgiftshop
·2 years agoIt doesn't matter how or where you ship, you're responsible for any damage.
Before you let Ebay refund the buyer, you could have refunded the buyer, then filed a claim with the carrier.
Just because it working before you shipped, doesn't mean it worked when the buyer received it.

·2 years agoThe speaker was damaged by fedex or the buyer
There are actually two other possibilities - the speaker may have been damaged due to insufficient packaging, or it may have not been damaged at all.
Due to this scam i refused to send the buyer a shipping lable for return
So you will never know what the actual condition of the speaker was.
If the post ofice, fedex or ups damages or loses you item you the seller are responsible
Correct. The buyer already has a money-back guarantee from eBay.

OP2 years agodid you read my post? THIS IS A SCAM!
broto_64
·2 years agoYes, I have more bad news...
It says in that item's description that you will not ship to the West Coast...
How exactly are you stopping buyers from the West Coast from ordering from you?
You don't actually have to answer that question, I'm pretty sure it's cancelling orders for reason of "problem with buyer's address" but you should know buyers can report you for doing that (and they should).
It is a violation of ebay policy to cancel an existing order simply because you refuse to ship to that location, if you don't want to ship somewhere then you need to set that up in your preferences; unfortunately I don't believe that you can exclude parts of the continental USA but if a buyer can order it then you are obligated to ship.
As well your responses to buyer negative and neutral feedbacks are not helping you.
On that note neither is the feedback you leave for your buyers.
About the only reason I can see that you're still selling on ebay is because you only sell 100-200 items a year... If I were just a regular buyer you are definitely not the kind of seller I would want to deal with, as a seasoned ebayer however I sometimes look forward to encountering sellers like you.
Yes, the problem with "No Returns Accepted" policies that you use in your listings is that the MBG does not require the return of the product before the refund is issued, especially if the buyer escalates. Only inexperienced buyers will return the product to you in these situations, and the number of buyers who will cooperate with you is affected by your attitude during the returns process which, if it's anything like what we're seeing here... As pointed out elsewhere, better off setting up a 30-day returns policy.
I have my payouts set to once a month, fewer deposits helps tremendously in the accounting department, also as many have pointed out, everything you've brought up is all part of the seller agreement we signed (or checked off on) when we became sellers, you need to read up on this agreement, it may help clear up much confusion.
heckofagame
·2 years agoIt does not matter where you buy your shipping label, you will be responsible for the safe arrival of anything you sell on eBay.
If you refuse to accept the return, then eBay will accept it for you, and you will be out both the money and the item as well as a ding on your seller metrics.
