The problem is while a buyer that receives the wrong item can file a case. There is no such case a seller can file. There is no I sent the wrong item and want it back case. You don't have to send them the correct item until they return the other. However, it looks like they won't. If it has a higher value, that can be a problem.
I don't suppose you have another to send out to the other buyer?
All you can do is explain to the other buyer what happened.
@oxford_collection go to their house and knock on their door, but seriously, there is no 'legal' obligation to return the item to you, but there is a 'moral' one, so it will come back to them twice as hard

Actually, there is. It’s called legally, unjust enrichment. Courts recognize that mistakes happen. Let’s say you go by an Econo car and when they deliver it to you the next day they deliver a brand new Corvette. You sign for it and they leave. You don’t get to keep it. Just like when the bank makes a mistake and deposit $100,000 in your account by mistake, you won’t get to keep that either.
The only problem is in order to get justice you will have to go to court. And a most eBay cases it’s just not worth it.
and don't leave a negative like I got, I even refunded, let them have the lure and offer to send the correct lure but the never responded to any of my emails.

If they decide to keep it, nothing you can do.

·8 months agoThey unfortunately have no legal or ebay requirement to return the item to you.
Lets hope it wasn't something very similar but much more valuable, because chances are good that you won't ever get it back.
