If you accepted a return, or responded properly to any inquiry regarding a return to your buyer, and reconciled the situation with a refund in the time allowed, there should be no forfeiture of fees paid for that transaction. (they would be returned/credited to your account)
If you did not do it "by the book" and ebay stepped in, then yes, they keep the fees.
