    Sellers don’t have Guarantees- Beware

    I have sold product for a little under a year now on eBay. Outside of some of their outlandish fees  that clearly are based off politics my experience up till now has been good. I sold over 151 units across 92 shipments of this particular item. 100% feedback with great praise comments. I had a shipment that hadn’t had any movement for a week. My buyer (a repeat customer) reached out and was starting to get frustrated. I haven’t had a lost package thus far so I wasn’t sure what to do. They gave me a link to give to my buyer which I provided to  him to fill out a case not received claim. The package went to 5 distribution centers across 4 states. I spoke with multiple agents who assured me that eBay had my back as the seller and I wouldn’t loose out on compensation as well because I had done everything text book style. I have the transcripts from all agents  which I’m thinking maybe I need to talk to a few attorneys to get some clarity, but none the less. They lied to me… it doesn’t matter if the carrier lost the package it all falls back on the seller. They did absolutely nothing for me. I knew my buyer needed refunded but the agents told me NOT to. The money is not the issue here, I just wonder.. how many sellers are eBay screwing and profiting off of like some kind of dictator?? How am I responsible for what the post office does? The bold lies truly had taken me back. They told me I needed to file a claim with the post office… ahh hello, what is the purpose of me using this 3rd party app if I have to do the work?? I was so shocked, but how many more sellers have this same  story?

    Is it at all possible that your shipment got intercepted as counterfeit? I notice for example on the back of the box for your 'Skullcandy True Freedom Indy ANC FUEL , NC Earbuds' that 'Activate Assistant' is misspelled as 'Assitant' instead.

    Without knowing the exact time frame and value it is hard to comment.  You should probably urge the buyer patience - so long as you are sure the item was addressed correctly - especially with it showing the bouncing around.  There is a problem with the Q-codes sometimes - and that is the shippers 'fault' even though its really a technology problem.  Once you send the refund you might as well resign yourself to taking it on your taxes as a loss.

    A lost or misdirected package isn't any different than if the item arrives broken.  As the seller you are responsible.  What would you do if you were the buyer in that situation?  Just say, "oh well"?  Ebay has your back in the sense your buyer wouldn't be allowed to give negative feedback for something you couldn't control.

    Funny, I don't get a package, and I get the seller saying "what do you want me to do about it" and ebay refusing to give me my money back. Now I am filing a chargeback with my CC.

    Did you file an Item Not Received dispute? What was the outcome?

    I filed the dispute and the CC company gave me the money back. I asked if they were taking it from EBAY, or just giving me a courtesy credit, the CC rep told me it was just a courtesy return from them and that EBAY wasn't getting dinged. I think the Post Office insurance should get dinged for constantly marking packages delivered when they aren't. They mark items delivered after hours when my office is closed. Sometimes the items show up the next day, a couple times, they never showed. But marked as delivered to a closed, locked up office with no mail slot.

    Almost as odd as suggesting that because the carrier lost the item that's tough beans for the buyer, who's supposed to just suck it up.

    I'll tell you the same here that I told you on another thread about this:

     

    It is not that you are responsible for the carrier losing the package, it is that you are responsible to see that buyer receives either the item ordered or a refund. It is not your fault that the package was lost, but it is your responsibility.  So you make the buyer whole, and then you go after the carrier to reimburse you.

     

    That is not just eBay policy. It is the law of the land: Perfect Tender Rule, United States Uniform Commercial Code (UCC) § 2-601.  The law, codified in the USUCC, requires "perfect tender" by the seller -- delivery of the goods to the buyer, and those goods must precisely meet the terms of the contract.

     

    Think of it his way:  What if there were a glitch in processing the payment and your buyer said: "Hey! Not my problem.  I did everything I was supposed to do, and it's not my fault you didn't get the payment.  So send me my item, and send it pronto!"  Would you ship?  Of course not.  It is the buyer's responsibility to be sure you receive payment, just as it is your responsibility to see that the buyer receives the goods.
