Scamming thief Buyer
Hello everyone,
I would like to share with you my experience with Buyer
Buyer by whom I was robbed to the amount of $2500 ! In short it looked like this:
1) He wrote to me that he was interested in buying RECARO seats that I was selling
2) He inquired about how long shipping would take (at the time I didn't know it was very important to him yet)
3) He purchased and paid for the item
3) Immediately after the expiration of the timely delivery day (11-23 business days), he created a case and demanded a refund even though he knew that the seats were already on their way to him because he received the tracking number and I informed him of my conversation with the post office (because the delivery took longer than usual).
4) The same day Ebay granted him a full refund and buyer picked up my packages with two RECARO seats for himself in a few days and thus received the seats with home delivery for free....
5) After he picked up the packages I wrote to him whether he was going to pay for them or send them back. He wrote back to me that he wanted to send them back but that I had to pay in advance for return shipping 🙂 The cheeky coward still wanted to cheat me on shipping costs....
I am writing this to everyone as a warning because ebay does not help sellers and did nothing about my case. I, of course, will not leave it at that. I have already spoken to a consumer rights attorney and next week I have an appointment with a lawyer. If any people reading this post have also been scammed.... from California then please contact me (we will do a class action lawsuit)

Your description of the scenario, painting the buyer as a scam artist, has some holes in it. In addition, you glossed over your handling of the transaction.
It seems your buyer was within his rights to request a refund for an Item Not Received case. You sold the seats on June 26 and advised the customer of a maximum 26-day transit period, per your opening post. That was 73 days ago.
What date were the items finally delivered? You admit there was a shipping delay, one that mattered to your buyer. As the seller, you are held accountable by eBay for late shipping. It also does not look like the buyer immediately rushed to open a case. It appears he waited additional time before raising the complaint with eBay.
Based on your account, it sounds like the buyer contact you first with his concerns over the shipping delay. Did they ask to be refunded? eBay ultimately only gets involved if the seller refuses to cooperate. It looks like you failed to take responsibility for meeting your contractual obligations to the buyer. Sellers are on the hook to refund if a package does not arrive as promised.

It is the seller’s responsibility to provide return shipping when a buyer opens a Money Back Guarantee case. It certainly is if closed in the buyer’s favor. If you want the goods back, it is your role to pay return shipping.
I think you have unfairly maligned this customer. He asked the right questions before purchasing, making a particular point about shipping duration. He states he is willing to return your items, but you are still failing to cooperate or take responsibility for your role as the seller.
Right now, there is no evidence the buyer is trying to defraud you.

If the information you provided is accurate, you were very likely not treated with proper regard as dictated in the company's terms of service - You assert a case was closed in favor of the buyer on the SAME DAY the case was filed. In ebays terms of service they CLEARLY state a seller has 3 DAYS to rectify an item not received case...
I would think a case of this nature would qualify for a number of legal avenues - Somewhat constrained by, yet at the same time, not entirely bound by what the site may say in their terms of service regarding seeking satisfaction, especially if they have violated the terms of their contract with you...

Keep in mind that at this point, the buyer was right and the purchase had not been delivered.
5.) The request for return shipping may be cheeky, but they have the seat(s?) and you want them.
Pay for the return shipping.
Not every transaction will go perfectly.
Losses in transit, refund costs, and procurement costs are all business expenses and tax deductible.
If they are willing to ship the purchase back and you want the purchase back, why should they be out the money for a purchase that was delivered late?

·1 year agoSorry this happened to you. Selling and shipping something that expensive and large is risky business, especially internationally. Cant imagine what shipping cost you on that.

You acknowledged an eBay user agreement that explains what seller protections you have, and the terms regarding "Item Not Received" cases and how to respond to them:

The Seller Protection policy says that if an item is delivered late, you are protected from defects and negative feedback. It says nothing about getting your money or your item back.
Unless eBay violated those terms, a class action lawsuit is unlikely to succeed.

According to eBay rules, he won the case so he is under no obligation to return the item. So return shipping costs are entirely on you ... if you trust the buyer to actually follow through.

·1 year agoYou are in Poland and did not state where your buyer is/was located but if they are in Poland for the amount of money involved I would just drive and pickup the seats. I cannot imagine what the shipping cost was on these or why you offered free shipping for both a domestic as well as an international sale.
The buyer is correct in this situation if they are refusing to pay you for the item now that they have received it and while you can issue them a return shipping label there is no guarantee that they will use it or that they will actually return the seats and not some other item. Personally this is not an item I would have listed on eBay and certainly not with free shipping. i would have attempted to sell them locally first and If I was to list something like this local pickup only would have been a viable option.

I will say you ARE responsible for return shipping.
Why would a buyer come out of pocket for the return.
You are also in the wrong. If you said you sent him a prepaid shipping label and he refused then I'd say worse about them.
