Sales taxes on silver in Florida
Summary: The discussion revolves around the issue of sales tax being incorrectly charged on silver purchases in various states by an online platform. 1969daytona and others are trying to understand why sales tax is applied despite laws exempting it, especially in states like Florida and Virginia. lacemaker3 highlights that interpretations by the platform may be inconsistent and go-bad-chicken suggests pursuing a chargeback as a solution, though this is debated due to ethical concerns. In conclusion, participants express frustration over ongoing issues with refunds and incorrect tax charges.
I have purchased the same item from the same seller 11 different times. The item is $100 face value of 90% silver US coins . The sale prices we're about $5,000 for each sale. On the 11th time I was wrongfully charged sales tax. I live in the state of Florida and that's where the items were shipped. Florida law is clear that any purchase of silver for over $500 is exempt from sales tax.
I reported the issue to eBay on March 23rd 2026. I called back on April 1st and they said they had no record of my March 23rd call. They said they would file a new report and promised to refund the sales tax within 60 days. I called back on April 10th and again on May 15th and both times was told they were working on the issue and to patiently wait. Each time I asked if they could provide me with something in writing that I was due a refund and they were always unwilling or unable to do so. As of May 25th I have heard nothing so I called again. First the agent said he did have a record of my March 23rd call but had no idea what I called about and that my April 1st call was to report an inability to log into my account. I never had a problem logging into my account. Minutes later he checked again and said that he did have a record of me asking for a sales tax refund on both my March 23rd and April 1st phone calls. He said he saw a record of my calls on April 10th and May 15th but no notes were taken. He said that no report has yet been filed to obtain a sales tax refund and he will file a report today but that I must wait 60 days to get my refund. He later clarified to mean 60 business days. Has anybody else had this much trouble with this issue? I feel like eBay is either incompetent or dishonest.
1969daytona
OP2 months agoI almost can't believe it but eBay just sent me a refund for most of the sales tax I paid on this transaction. For some reason they shorted me $15 though so I now will probably have to wait another 4 months to collect that. Furthermore I still have a pending claim for sales tax they charge me for silver that was shipped to me in Wisconsin.

·2 months agoVA state does not have sales tax on silver bullions, coins, rounds, and bars. Why does eBay still collect them? is that even legal? Or their program is outdated. I have purchased silvers from several companies, Apmex, Scottsdale, MJBullion, Moneymetals, none of purchases have sales tax.

·3 months ago@1969daytona ,
It looks like if this issue is important to you and you can't get satisfaction. It might be time for you to lawyer up?
1969daytona
OP3 months agoActually I don't think a lawyer would be needed. The terms and conditions of eBay's contract says that disputes must go through arbitration unless they fall within the small claims limit. In that case I'm allowed to file a lawsuit in small claims court. If I file in small claims court I don't anticipate needing an attorney. I have read other posts of people having issues with eBay and filing in small claims court and then eBay fails to show up. These people then got a default judgment against eBay.

·3 months agoYou are buying silver coins at $5K per lot? Silver is $62 per ounce. No way you will get $5K worth out of a coin. It would take thousands of coins. Then you say each coin is sold at face value meaning a $1 silver piece is sold for $1. You also say you made 11 purchases at $5K each. That would be a lot of coins paying face value. Maybe you can clarify.
go-bad-chicken
·3 months agoThe OP is or was buying circulated coins at or near the daily spot price on silver. They are buying them with the hopes or based on calculated experience, that the price of silver will again rise sometime in the future.
This is a very common practice with precious metal investors.
jdbelt1960
·3 months agoThanks but the math still does not add. The OP spent $5K x 11 times which comes to $55K. Why buy 90% silver coins (which must be melted and extracted) instead of 99.9% silver bullion bars. Make it make sense.
1969daytona
OP3 months agoLet me help you out. Right now 90% junk silver, also known as constitutional silver, is selling for less than it's melt value. The reason it's selling for less than melt value is because the refiners are backlogged and are not accepting 90% silver. In some cases they'll accept the silver but can't refine it for several months and then will only pay out based on what the silver price is several months after they receive it and at the time they actually refine it. Because of this fact dealers are paying way way under melt price for 90% silver. Because they're paying so little they are willing to sell it for under spot or melt price and they can still make a profit. Every one of the 11 lots of silver I purchased were at least 5% under spot price. The same dealers that are selling 90% silver for 5% under spot are selling .999 silver eagles for as much as 20% OVER spot. In fact today I just purchased over $500 of face value of silver in a separate transaction that had nothing to do with eBay and I only paid 86% of melt value. When the refiners catch up or some enterprising people build new refineries I believe 90% silver will sell much closer to its true melt value. Hopefully that answers your question.
1969daytona
OP3 months agoThe silver coins I purchased were at an average of about $5,000 for each lot. Each lot was $100 face value. I purchased 10 different lots back when silver was higher than it is now. During those 10 early transactions I was not charged sales tax. Then on March 23rd 2026 I purchased an 11th $100 face value lot for $4,650.47. That particular transaction was assessed sales tax for $279.03. These coins were all sent to my address in Florida. I don't believe I ever said the coins I purchased were at face value. You must have misread something. Yes you are right it takes quite a few coins to add up to $100 face value. 1000 dimes, 400 quarters, or 200 half dollars to be exact.

·3 months agoI understand what you are doing but @jdbelt1960 wants someone to explain the specifics of speculation to them.
On a different note at this point if it were me id just do a charge back with my financial institution. Its throwing the seller under the bus but it does not seem like you are going to get anywhere with ebay with them refunding the sales tax.
marnotom!
·3 months agoOn what grounds? There’s no evidence of fraud here, and that’s what chargebacks are supposed to combat.
go-bad-chicken
·3 months agoEasy. The sellers marketplace (ebay) wrongly assessed sales tax and the buyer (op) can not get satisfaction. Unfortunately for that seller there marketplace has failed their buyer.
marnotom!
·3 months agoBut there’s no evidence of fraud, which is what chargebacks are supposed to combat.
Seems grossly unfair to pursue a return of erroneously charged sales tax from a seller who never charged, collected, or remitted it in the first place. You’re right, if doable, this is throwing the seller under the bus, particularly as the OP has already established a good business relationship with this seller.
1969daytona
OP3 months agoNo it wouldn't be unfair because the money wouldn't be coming from the seller. EBay is the one that collected the sales tax. EBay does not forward that sales tax to the seller. They collect it from the buyer and then in theory forward it directly to the state. Others have questioned whether all of that collected tax money finds its way to each state that it's collected on behalf of. I think that's what the state of Florida is interested in looking into and that is why they've asked me to fill out a tax violation report. This could get interesting.
1969daytona
OP3 months agoChargebacks can also be for mistakes with the amount of the charge. Like I just pointed out in a previous post though I did try the charge back option and Capital One refuses to help me. As far as fraud goes, I've explained the situation to the State of Florida and they want me to fill out a tax violations report. Apparently they're interested in doing an investigation. I'm not going to let this rest. If need be I will resort to small claims court. I will take this as far as it needs to go.
1969daytona
OP3 months agoYeah I tried the charge back route already. Capital One refuses to help me even though I pointed out that the tax I paid was illegal according to Florida state law and then I'm legally unable to obtain a refund directly from the state of Florida. The business has to be the one to apply for the refund. There is an exception. That exception is if I can get eBay to fill out a form that assigns their rights to the sales tax refund I can then apply directly. Good luck with getting eBay to do that.

If you have been told to fill out that form, I suggest you do so and see what happens.
1969daytona
OP4 months agoI understand that I was sending the same reply to multiple people and that others may see multiple replies. The reason I did that was that I wanted each and every person that took the time to post on this thread to receive notice that there was a reply to their post. I'm sorry if it is to repetitive. I also don't think you understood my post. If you read the document at the very top it says that the purchaser who paid tax that was not due must secure a refund from the business (ebay) not from the state. That's the reason I posted this and was responding to each person that told me I should be seeking a refund from the state. According to this document it is the business that must seek the refund and then forward it to me. If they refuse to do that I could attempt to get them to sign dr-26a which is titled assignment of rights to refund of tax. If eBay is unwilling or unable to fill that out it appears there's no way for me to get sales tax back if eBay isn't willing to give it to me.

·4 months agoI think someone mentioned in a previous thread that maybe the "90%" silver content had something to do with the tax being applied. There was a new law adopted august 2025 expanding what is non taxable but I did find this:
What Remains Taxable
Items that fall outside Florida statutory definitions remain taxable even when they contain precious metals. Coins or currency that are not United States legal tender and are sold based on metal content remain subject to tax under Florida administrative rules.
Jewelry and finished goods created from coins or bullion remain taxable because they are classified as adornment or manufactured items rather than bullion. Mixed metal objects, novelty designs, and non qualifying forms are also taxable.
If i'm reading into that correctly, even though that listing was in bullion category, it was being sold based on silver content rather than currency.
lacemaker3
·4 months ago@r_lresale
This listing doesn't come under any of those classifications that would make it taxable in Florida.
The big question here, is that the listing does NOT have Florida sales tax added now, so it's very confusing why Florida sales tax was charged once, but not now, and not for the previous ten purchases either.
@1969daytona, what percentage rate of sales tax were you charged? What was the date of the purchase?
And is the rate you were charged correct for your Florida address, your Wisconsin address, or neither? (assuming the purchase to be taxable).
r_lresale
·4 months ago1969daytona
OP4 months agoThe purchase was made on March 23rd 2026. I ended up being charged 6.3% sales tax which is a little strange because Florida has a 6% sales tax rate and Pinellas County Florida which is the county I live in has a 1% sales tax rate so it doesn't really add up. That sales tax rate would be too high for Wisconsin because Wisconsin is 5% sales tax with a 0.5% County tax rate for the county I reside in there. Wisconsin shouldn't have anything to do with that transaction though since every prior shipment had been sent to Florida as well as the one in question.
I don't think the date of purchase should have anything to do with this issue because nothing changed in the law between the time of the prior purchases which were not charged sales tax and this latest purchase which was charged sales tax.

Furthermore you have a very limited time to pay for the item or it gets repriced because it's connected to the live silver market price and varies every few seconds. ·4 months agoeBay closed their incoming phone number in 2020 during Covid, if you called a number in March when this happened you did not call eBay but rather scammers who plaster their number all over Google.

1969daytona

The category is Bullion> Silver> Coins. The item number is 366162777225. It appears that no matter how many are purchased the item number stays the same and it just becomes available again. If you search this item number that should be the exact item that I purchased with the same item number and same categories and seller.

·4 months agoLooking at the listing page, @1969daytona, I'm wondering if eBay is now employing more "sophisticated" computer code when examining listings, which might explain why you've been able to purchase from the same listing in the past without issues.
Perhaps there's some keyword scanning going on in addition to checking the item's category, and the term "90%" is getting misinterpreted or the code doesn't have enough information to ascertain that that's usually a legitimate percentage for silver bullion in coin form.
Have you asked the seller if they know if other buyers have been having this issue?
1969daytona
OP4 months agoThe seller has said that they've had other buyers have the same issues I did. The seller told me that eBay says to just pay the tax and then apply through eBay for a refund. It seems so scammy though because eBay does not seem at all interested in issuing that refund. They're giving me the runaround and I believe they are lying to me. Interestingly if I try to check out with a new purchase and have the item shipped to Florida it will not charge me sales tax. The problem with that is that I am in Wisconsin for the summer and even though Wisconsin is also sales tax free on bullion it now wants to charge me tax for any shipments to Wisconsin.
lacemaker3
·4 months ago@1969daytona
Wait, what? You didn't say anything about using a different shipping address for this purchase! In your first post, you said the purchase was shipped to Florida!
https://www.ebay.com/itm/366162777225
Sales tax is charged based on the shipping address, and the state laws in that state. This listing is not charged tax if it is being shipped to Florida, but it is charged tax when it is shipped to Wisconsin.
FYI, this is NOT because of the category, because the same item is taxed when delivered to one state and not taxed when delivered to another state. It is because of how eBay is interpreting the sales tax law in Wisconsin.
This situation with respect to sales of bullion/coins to Wisconsin has been reported several times since the law was changed in Wisconsin in 2024 (and modified requirements for claiming/requesting the exemption in 2025). At first, buyers needed to apply for an exemption from the seller and eBay didn't have any way to implement that. However in 2025, the requirement for buyers to apply for the exemption was apparently dropped.
eBay has not updated their program and still collects the sales tax. In the past, this has happened when eBay had requested a ruling or confirmation from the state as to how the law should be interpreted. Until eBay gets an official ruling or confirmation from the state, they will err on the side of caution and collect the sales tax. They can't collect it after the purchase, and if the ruling says the transaction was taxable, then eBay would have to pay the tax out of pocket.
@1969daytona , at this point you have two options:
1969daytona
OP4 months agoNo you've misunderstood. I'll explain it fully. I own two homes. One is in Florida one is in Wisconsin. I live in Florida from October through May and I live in Wisconsin from me until october. The first 10 purchases which did not have sales tax charged were sent to florida. The 11th purchase which did have sales check tax charged was also sent to Florida. I have not had any silver sent to Wisconsin. Where you misunderstood was me saying that at this very moment if I try to purchase more silver and haven't sent the Florida they will not charge me sales tax but if I attempt to have it sent to Wisconsin they will charge me tax. I have no explanation as to why they would not charge me tax on 10 purchases in a row and then all the sudden on the 11th purchase which is still being sent to Florida to go ahead and charge me tax. I simply was pointing out that if I was still in Florida it appears I could purchase more silver without tax being added once again. The problem is as I stated though that I am not in Florida at the moment and if I want to try to purchase silver currently you have to be sent to wisconsin. Wisconsin is also sales tax exempt for this product but they insist on adding sales tax

I agree with jdbelt: sales taxes are a state issue. Sales taxes are not an eBay issue.
eBay is just, kind of, the "manual labor." eBay, as a marketplace facilitator, has to collect sales taxes based on the sales taxation laws of the 45 states* that do collect sales taxes. Some of those sales tax laws state that certain items are not subject to sales taxes, but sometimes a few of those items do get taxed on eBay. Very often, that is due to an error in the item category, as chosen by the seller.
The best answer for a sales tax refund seems to be to request it directly from the state it was sent to.
*Five (5) states currently do not charge sales taxes on anything: alphabetically, they are Alaska, Delaware, Montana, New Hampshire, and Oregon.

·4 months agoBy law sales tax is an eBay issue. They are required to collect and submit sales tax to states based on the law of the buyer's state, and all states with sales tax require eBay to do this. As the OP said, their silver purchase is sales tax exempt, and eBay should not be collecting and submitting sales tax to FL on it.
I have the same problem with clothing. Clothing under $100 is exempt from sales tax where I live, but when I buy clothing on eBay they collect and submit full state sales tax on it anyway. I really wish they would address this issue.

·4 months agoFrom what I’ve seen on these discussion boards, when sales taxes are charged supposedly erroneously on eBay, it’s because either the seller listed the item in a taxable category, or else there’s a loophole in the state’s taxation laws that either makes online purchases ineligible for the tax exemption, or else the tax doesn’t apply in certain circumstances which eBay’s checkout calculator can’t differentiate.
1969daytona
OP4 months agoIt really shouldn't matter what category silver bullion is listed in because it's untaxable in all circumstances if it's over $500 in florida. Having said that it was in the only category that everybody agrees is the proper non-taxable category, and that category is bullion. There is no loophole in Florida law that says online purchases are taxable. Florida law simply States all silver purchases over $500 are sales tax free.

·4 months agoYou go to your state to apply for the refund, they are the ones who have your money now. Usually a merchant will not refund sales tax if they have already submitted it. OP4 months agoThank you for that suggestion and I'll go ahead and try that . I'm wondering though how it is that Florida will know that eBay has actually forwarded the sales tax money that they collected from me and sent it on to the state of Florida.

·4 months agoYou need to bring your paid invoice to show the item purchased and the tax paid. If ebay collected it, im pretty sure they forwarded it.
Now, be aware, your invoice has to be very clear on what you bought, cant display any dialogue that it might be bought as a collectible or something other than bullion. But it is up to you to prove you paid tax on something you werent required to

Likewise, I am "pretty sure" that the laws of the 45 states with sales taxes require eBay to forward the sales tax money to each applicable state. Not only eBay, BTW, but other organizations that meet the qualifications of being Marketplace Facilitators. They all have to remit their collected sales taxes to the appropriate states.

OP4 months agoI talked to the State of Florida today and they told me I needed to fill out form DR-26-A. That form says that if a purchaser paid tax with no tax was due that the business must secure a refund from the state.
