Posted MBG policy is not in effect anymore!
I sold an $3300 item with local pick up and buyer elected to use 3rd party trucking company to pick it up and transport the item to another state. MBG policy in the black and white states that such transactions will not be covered by MBG
In this case ebay first agreed with it and closed the case in my favor, later buyer appeal it and ebay overturn that decision and now asking me to pick up the item from the buyer, which by itself would cost $1000 or so
I spoke with ebay and they told me that they have "exceptions" and if buyer claim not as advertised they will enforce it and make me responsible
Have anyone experienced this?
Question for the ebay rep - what is the policy? Posted is not enforced

I think you are over complicating this now. Of course Ebay refunded the buyer for the sales tax. That is how it works for buyers that pay sales tax and Ebay refunds them.
IDK what you want now. You have been made whole by Ebay. True your buyer got their money too because Ebay made a mistake. But YOU are fine and you have your money.
Ebay made a mistake and the stepped up, realized that and made you whole. IDK what more you want.

Yet, an infinitesimal dollar amount (compared to that) someone else eats because they selected the wrong reason for a legit return?
And they are told "Sorry, you lose. You should have known the policy & made the correct choice. Because you selected the "literal" correct reason for return as opposed to the "policy effective" correct reason you are S.O.L. and the scammer seller wins."

Sounds fair to me.
100% glad the OP was made whole. They should never have had the stress to begin with. Is there compensation for "pain, suffering and the undue anxiety this trauma has caused?"
Still 100% feel they should clarify a policy (and its exceptions) and be fair & uniform about it.
It absolutely matters going forward regardless of the joyful news that the OP got back what they never should have had to worry about losing in the first place.
It will have a chilling effect on the willingness of a seller to sell a really big-ticket item.

I think eBay needs to seriously look at how we handle 3rd party freight pick ups as "local pick ups". Once the 3rd party freight touches the item, eBay and the seller no longer are responsible for any claim against the item, even for items NAD. Let the buyer purchase insurance from the freight line to protect their purchase & ensure the proper delivery. Or at the very least, any return from a 3rd party freight company must be returned to the point of pick up & paid by the buyer, or whoever contracted the freight.
The fact that ebay has reps that handle high value claims, tells us the rule is, these are judged on a case by case basis

110% agree and how seller can be responsible for INAD or missing pieces if he/she has NO control of what is delivered to the buyer and in what condition if any

This is a main point. It is like gymnastic competition vs heavy lift competition. The first is a completely murky and rely on OPINIONS and second is clear and transparent

Your photo shows a desk and chair and other items inside the enclosure and your description says "No accessories provided unless pictured"
Since it's pictured, I'd expect to receive what was shown in your photo.

Well, we advertised the very specific item and people knows what they are. Not a lab or a equipment test booth set up
Following your logic any ads with lets say a car with a girl inside would include a girl with the sale.. or beer commercial with models imply that if you buy a case of beer they will come along too..

and you only accept cash, paper money, as payment.
Then you don't have these problems. Part of doing ebay is avoiding the many potholes that

Weill this will severly limit ours and anyone else sales to local market, which i can do without ebay
Pint is to have a secure transaction for the seller providing that both buyer and seller understand the rules and these rules are clearly published and written

Correct, today i checked and they decided to close the case
In my particularly case eBay decided to close it with refunding money to buyer themselves . not from my account
I certainty appreciate it, but kind of disappointed a bit since they basically gave a guy money and a product. he wasn't even asking for it. I just feel bad that eBay decided to give him 3.3K out its pocket. Although I am happy with outcome, but i am wondering what is the next. are we protected or not from the situation than a buyer elected to engage 3r5d party shipper to pick up the item?

·1 year agoYep, that's exactly what you just witnessed in action. -eBay paying a "courtesy refund" to the buyer is a form of seller protection. Sometimes it's a bit irksome, in cases where you know the buyer was lying and just trying to pull a scam, then essentially succeeded, after all the time you spent stressed and trying to prevent catastrophe. -You don't get compensated for that lost time, but at least you are spared the catastrophe.
This is much like chargeback cases where the buyer's bank/card finds in their favor, but thanks to all the Seller Protection requirements you followed as a seller, eBay pays the bank instead of taking it from you, and doesn't charge you the $20 fine.
In other words, Seller Protection often looks like losing, but without actually losing anything. It's the smoothing-over that the company sometimes does to prevent losing buyers or sellers.

I am not trying to take advantage or defraud anyone, neither i want to be defrauded myself.
All we (at least I) want is a fair play. Meaning is that there are the rules of dealing with selling process
I think ebay MBG is written in that in mind. Issue is that it is somehow is not enforce as it is written

·1 year agoThe rules on this were clear. However humans make mistakes. And whomever reviewed your claim was wrong in how they handled it. It really isn't more complicated than that. This should not have been as big of a hassle as it was for you, but the great thing is we got it in front of the right people and things are now fixed for you.
I think it is a very good thing that Ebay stepped up and righted the wrong.

So where/how did you get the idea that the buyer was refunded by eBay's own revenues? It doesn't say that at all. In fact what it does say matches the MBG policy to the letter! The policy worked exactly like it's supposed to.

·1 year agoHad eBay previous taken or held the funds from your account? Because to me it looks like they are considering it a refund to you. -If you look under 'What you earned' (all the text in black) that money is called a refund, like you earned a refund because the case did not fit the policy of the MBG, and it shows the fees taken from it, resulting in your net earnings.

Again, i never was against ebay or said anything bad about the company. I just want to know the rules of the game and that is it. I believe in ebay success and by paying 300K plus per year in fee proving the point of my "pledge of allegiance" so to speak
My core issue - tell us the rules of the game and that is it. if we play soccer we should play 45 min, 11 people team and one ball. But if we have a situations when it is suddenly 40min or 50 min , or having one team with 13 people, or perhaps 2-3 balls, than we have an issue
We all want ebay to succeed and want to serve our customers, BUT if customer picks up an item , moves it by 3rd party carrier god knows there, god knows how, i want to make sure i am not responsible of it. taking an example of the same fridge. Guy can indeed have a genuine issue transporting it through multiple states with no proper shock insulation or been dropped. that may not result in VISIABLE damage, but easily can create micro crack in metal tubing and it will have no Freon inside.

·1 year agoAs said earlier in this thread, there was another post very similar to this situation of a 3rd party carrier picking up items and forcing the seller to provide a return. This is a very alarming situation for sellers.
I have a few thoughts...first off, this isn't about policy or right or wrong, its about money and who's money. eBay is no different than every other insurance company in a matter like this. If they make you pay for this, contact an attorney and force their hand....eBay ultimately knows that outcome, but they are waiting for you to take action. eBay is doing what every car insurer and home insurer does to us. There are even state laws that protect you from 3rd party bill of ladings as to who ultimately becomes responsible. Those laws trump eBay. Again, an attorney will know this stuff. Remember, the freight courier is the professionals here, they know what they can and can not safely deliver. BTW, a good attorney will contact both eBay and the freight company for liability.
Second, for other using local pick up...never, never, never release the item to anyone other than the buyer. Make them show an ID. Heck, we don't ship to alternative addresses, we shouldn't hand over an item to a 3rd party anything
Third, with local pick up, sellers don't pack the item to be transported. If we did, we would charge for it. To ever think then a 3rd party carrier is going to show up and get a "ready-to-ship" load is ridiculous. Packing for freight can cost a bunch of money. Why eBay would expect us to do this is totally unreasonable...and they know that, too!
Finally, I hope this all works out for you...and you can get this taken care of in your favor....but unfortunately, you may just have to play the game of business and force it to happen.

Trust me that is not an option. You can't sue ebay and suing someone in different state is next to impossible. Trust me , i know what i am talking about

Shipping and releasing item to 3rd party carrier was a different animal till today. now looks like they are are treating one a same as another.

I know and in this case would cost almost as same as an item. Again, til today it was not an issue since sellers were protected from MBG

Hopefully eBay makes you whole, but from my 42 years in business sometimes companies need to be nudged.

Well, there is no such thing as consumer affairs attorney in California. it is a fiction. Arbitration with ebay is far more difficult and expansive than you think and will result in immediate termination of all of your accounts
I like ebay and have no problems with them, but all i want to understand the rules of the game. that is it
nothing special. are we playing tennis or pickleball or football or soccer. each one has a different rule set.
so what is called "rules of engagement" . if they say in rules that i am protected - i should be. if they say , i am not - no problem too, just need to know to adjust the selling process.

You would think that at the bare minimum the language re: possible discretionary exceptions to MBG & 3rd party voids of such would be included in the body of text.
I cannot imagine a seller on the face of the planet that would release a local pick-up item via 3rd party carrier if they knew there was even a 1% chance, they might have to not only accept the item back but pay the freight cost for the return trip.
Maybe it's me, but the messages from eBay re: this matter to the OP seem ambiguous and convoluted.
Perhaps even contradictory.
I am normally a huge eBay supporter.
However, barring some MAJOR omission of facts in the case by the OP this one seems unconscionable.
I truly hope this matter gets resolved for the OP properly & policy (as well as discretionary exceptions) is clearly articulated in a public & forthright manner.

Also, with regards to potential omissions of facts there is no offense intended. None at all.

I can't believe myself that ebay is changing the rules on the fly.
And I told them, all i want (like any other seller) is a clear rules of engagement
if they say that i am no longer protected from buyer SNAD claims , i will not release any items to buyers
from other regions unless they pay in hard money. It makes no sense at all. To my understanding of ebay rules and regulation i have to offer electronic payment as well, but i do NOT have to release items to 3rd party unless i required to. So they need to make clear - if they want me to release it to 3rd party or not and if so what are the protections from it.
So i will have to revert back to offering local pick up with CC payments to local guys , but will require to pay in hard cash anyone taking it out of the region or refusing to sell period.

I guess you misunderstood me. This pic is from the his TRUCK - his pick up. I want to demonstrate that he made no arrangement to secure the freight DESPITE my repeated advise to do so

No one did. We told him that he need to hire crating/packing company and he sent just pick up by freight carrier and managed to convince them to get it like this.

If so, shipping was not "local pickup", it was Freight........which I assumed you, as seller, arranged?
Could be wrong, but the policy reads "3rd party on behalf of the buyer", possibly meaning buyer arranged pickup....
Am just wondering if that's how they are parsing it...........

·1 year agoIf that's the item, you are probably right.
When seller offers shipping, seller is responsible. This is one of the many reasons we tell sellers to never agree to use a buyer-provided prepaid shipping label.
As far as I'm aware, the third party collection policy only applies when the listing advertises, and the buyer chooses, local pickup.
Edit: Although the OP does have a few sold items in that price range that did offer local pickup, so it would be great to hear from them which item is in question. For example, https://www.ebay.com/itm/177038085244

·1 year agoIf that’s true, then I’m selfishly covered because I never allow local pickups. Just one more reason for me to never budge on that choice to not “meet a buyerâ€.
I’ve gotten many requests/demands for local pickup, even ones that offer to come directly to me. I’ve never agreed mainly because I think it’s safer to have a paper trail.

Also Paypal didn't offer didn't offer buyer protection on pay on local Pickup . Nor did they offer their Buyer protection policy to buyers out side local pickup only . that want the items and would pay for the shipping .Even eBay did same thing .

Another thing is not a local buyer. in that case you can ask them to come down in person or refused the deal

·1 year agoI never had any local buyers that paid online payments for their items on local pickup . I stopped selling back on may 2021 when eBay removed the category's I was dealing in , because adyen refused to process the payments . also I didn't want to go back to the auto seller fee payments ,since I never trusted eBay's billing system . which there are issues still on going with billing errors based on threads on the selling boards .

When items are shipped, they are purchased (essentially) sight unseen so the buyer isn't able to verify the condition of the item, accuracy of the listing, etc.
But with local pickup, buyer is able to see, test and otherwise verify that the item is "as described." So there was no need for MBG.

so it is covered by MBG

I agree,l but it is not a point
My case is different as it is NOT a local pick up, but a buyer using 3rd party freight agent to ship it and it is specifically stated in MBG as a voided term

I don't know what's going on with these two cases - if some technical aspect of the process was not followed or what's going on, but the MBG is clear here.
If you have eBay messages with the buyer confirming they arranged a 3rd party trucking company to pickup the item, I suggest reaching out to one of eBay's social CS teams to plead your case. Point to the exact part of the MBG that's supposed to cover you as the seller. ebay on facebook, ebayforsellers on insta, askebay on X

Local pick up INDEED is subject to MBG coverage, but we are talking about not a local pick up, but about 3rd party pick up by shipping companies ARRANGED and PAID by the buyer
I have no problems with MBG for the local pick up, since it can be facilitated, but in very rare cases you may be able to easily facilitate pick up for 1000lbs items on 4 pallets like in my case from God knows there.
These cases can't be treated as a LOCAL pick up, because buyer is not local and arranged his own shipping by 3rd party company which is VERY clearly excluded from MBG coverage

·1 year agoAnother big concern I have here is, if ebay is in fact going against their policy on losing MBG coverage for 3rd party pick ups, would this also affect the hundreds of thousands of Freight Forwarder (aka 3rd party shipping) purchases that happen on ebay all the time?
Should we all be worrying now when buyers who use FF's file for not as described returns?

·1 year agoI think this has always been a 'thing'' but the seller is only required to send a label for the original shipping location, so the 'buyer' would have to ship from Norway back to Florida, for example, on their 'own' dime and then the FF would have to 'reship' using the label provided (just will not happen)

OP1 year agoUnfortunately not, i am on direct support team with them and spoke with high value claims, they basically told me that this policy is not going to be enforce and each time buyer claiming SNAD seller will be responsible for return. I am waiting for leadership team to call me, this is as bad as it gets , i never seen such blunt posted policy violation by ebay!
It is ridicules. Why can ebay post the policy correctly? I would never release he item to the buyer knowing that i will be exposed to such risk

·1 year agoThis is very interesting. Like the others, IDK why this happened to you. If there was some specific detail to your transaction that voided that clause in the MBG. I will try to do some research and see if I can get any additional information one way or the other.

OP1 year agoThank you, please do. There is nothing specific about this exact transaction . ebay told me that ANYTIME buyer open SNAD, you done . Even if it is been picked up by 3rd party. I was amazed by that.
I asked them repeatedly - how so and why it is NOT posted in any published policy and exactly in opposite to what is posted. How can i be responsible for 3rd party pick up? buyer can claim anything they want to knowing that they can basically keep both item and a money . It wasn't same just a few months ago
I did lot of research myself and do not see anything which would put me such position according to the PUBLISHED policy

Interesting thing that case is officially still CLOSED in my favor as it is posted on ebay, but ebay CS told me different story and sent me message that i have to "facilitate :" the return
All i am trying to do is to understand the RULES OF THE ENGAGEMENT. If ebay have new policy in place and buyer can use 3rd party carriers and transport my items god knows there and i will have to arrange pick up[ from Alaska or Hawaii for 1000lbs item, that will be end on myside of releasing such items to 3rd party carriers. I will force buyer to come or cancel. There is no way i will let items worth in some cases tens of thousands dollars to be transported and be liable for it
ebay should really think if they want to discourage sellers to sale such items. few years back you had such policies and most sellers switched to local pick up and were not even releasing it to anyone other than locals. Than ebay enacted current MBG policy and we are started to let buyers use 3rd party companies to pick up. Now if it is not a case, we will stop doing so and ebay will lose millions per month. I pay like 350K or so in ebay fees per year and do not believe y guys want to reduce it

·1 year agoI am confused. First you said it was closed in your favor but the buyer appealed and eBay decided in the buyer's favor.
Now you are saying it is closed in your favor.
So ... did eBay give the buyer a courtesy refund with no impact to you?
Was the buyer refunded? Did the messages from eBay telling you to facilitate the return come after the return was closed in your favor and before the buyer's appeal? What was the timing?
We are missing pieces of the puzzle here.

OP1 year agothis is how buyer picked it up - actual pic from his 3rd party carrier truck and the buyer acknowledged all of this
how can i be responsible for anything in the such case - it is LOOSE freight, not secured or even care about.

So a local pick-up item can be tampered with or damaged in transit from the 3rd party to the buyer, and the seller is liable for the return, including shipping.
That's great to know and should affect all of our future listing decisions.

·1 year agoAs far as I know, buyers do have a MBG if the buyer claims it is "not as described" regardless if picked up or shipped.

·1 year agoBut the MBG is pretty clear (link) the buyer loses coverage when the buyer arranges a third party to pick up the item, as in the OP's example.

OP1 year agocorrect, but ebay told me that i is not anymore and if buyer claiming SNAD, you will still have to "facilitate" the return. Item in question was 4 pallets and would cost tons of money for me to pick up.

I was told many years ago that returns on local pick up items were decided on a case to cases basis. Sounds like that was true.

OP1 year agoif you check MBG policy posted on the ebay web site and scroll down to the middle of it, you will see exception from MBG coverage - item picked up by 3rd parties or item picked up by buyer using freight company/parcel forwarders
