·3 years agoNo offense, but don't read the OP's post as those it's in all CAPS, lol. It's comical that one would read that as though the person is yelling. Then, on top of it, take it to heart. I could care less if its written all upper case or lower case, bold, multi-color text. It makes not one bit of difference to me.
Now on to the topic: I despise price controls; it violates the basic tenet of free market economy. But, I'm 100% for tariffs and protecting regional markets...that's another story.
I would like to see one of these supposed emails.

I do recall a couple of years ago a situation where when one did a "SEARCH" query, quite a few listings showed WITHOUT a PRICE. There was some notation (that I don't remember exactly) for the "hidden price" issue that required the buyer to click through to actually see how much the seller was asking.
When pointing out the issue more than once and sharing screen shots of the phenomenon, we were told that the authorized sellers were basically NOT allowed to sell below MSRP. eBay's answer (as to not lose the money) came up with this idea of "masking" the price.
I don't particularly search for new products, so I don't know if the behavior still exists. I would be very interested, if you are not an authorized seller of the product, to know how this entity got your eBay email address in the first place.
There has for years been a debate over such issues as the "First Sale Doctrine" vs a "Rights Holder's Ability to File a Takedown Notice" sort of thing. Some brand names simply do not want their products sold on eBay at all. They join VERO and (often falsely) proclaim each item is counterfeit even if it is not, as a case in point the D.Donut coffee debacle, which was for a product readily available in grocery stores across the nation.
I guess the MRSP police are up to the same thing or the message you got was bogus in the first place if no action has been taken by eBay.

·3 years agoA manufacturer can't dictate pricing unless you sign a contract with the company in which you agree to their rules.
Expectable isn't a word, so probably not from the company or a native English-speaker.
sumsum70
·3 years agoExactly. Many years ago, a business I co-owned got certified mail from an attorney representing Audio-Technica. They were threatening us with legal action for selling microphones below MAP. We had never signed anything agreeing to MAP terms and had purchased a lot of it from a distributor closeout.
In a multi-paragraph, Saul Goodman sort of way, we sent certified mail right back to them that basically stated: If you don't want us to sell your stuff below a certain price, it is your duty to make sure we can't freely purchase it for resale without agreeing to those terms. Since you failed to do this, your only option is to FOAD or sue us and get countersued and lose. Never heard from them again.

·3 years agoThis is nothing new at least in the realms of "authorized" reseller. Back in the day when we'd buy video games or PC titles liquidated or delisted we were told pricing ranges. Anything outside them we risk loosing authorization and that includes even where items might be shipped to domestic or international. We bought liquidation level publisher direct, distributorship direct, surplus direct, even from places such as Fry's, Media Play, Comp USA, Best Buy, Circuit City be it on the shelf or from warehousing. We'd be told price range, in fact, we'd often call the publisher to ask or risk loosing authorization. That simple.
As to issues of eCars sure you can pay for electric or not. I've two friends who have eCars and they charge themselves off solar and sell excess back unto the grid who must purchase it by law. Granted they don't use the eCars for anything but regional area driving and yes, there are environmental and economic issues surrounding all Lithium Batteries . Australia is the largest miner of Lithium with over 50% of global production and the largest known resources of Lithium are in the Lithium triangle (Chile, Bolivia and Argentina).
Largest Pan-Asian trade agreement ever struck happened during the last administration and due to our former leaders ways and mouth the USA didn't even get invited to the table. Also happens be one of the big reasons that the current administration is trying to not alienate South America where the largest known Lithium Deposits exist and why China be all to happy step into South America using our playbook, money , stuff and protection.
Lithium is quite toxic disposing of it and in as far as comparison to oil, well... We're seeing the results, forty years ago the environmental alarms went off. That due in large respect about permafrost melting and potential biological viruses and bacterium released. Oldest Permafrost about 650,000 years, another layer about 200,000 years and the last laid down estimated 130,000 years. When Nasa discovered that bacteria and viruses happily live in the harshest environment known to man, that being space all sorts of flares went off. Those microbial life forms trapped in permafrost having not seen the light of day upon release could devastate the planet be that water, food chain or even us. That's why Pandemic became the #1 threat to the globe over giant rocks from space, global war et el. That's why for near 40 years a protocol was developed to try mitigate/minimize pandemic yet the prior administration not only threw it away not following a single protocol but then turned around blaming scientists who actually helped develop said protocol, the result as of today, 7 million dead, 1.1 million of them Americans. One third of those with deficits due to primary infection are expected to have long term health impacts for the rest of their lives. The rest as with other viruses are also anticipated to have long term impacts as they age.
Problem with Fossil Fuels and Global Warming is not that of Ice melt which certainly is a problem for anyone sea level or several feet above. It's four fold, the introduction of so much fresh water into the Ocean salt water. Its said the collapse of a chain of land that existed between the Great Lakes and Saint Lawrence Seaway gave way, The Great Lakes were once one lake. The introduction of so much fresh water into the Global Conveyor's such as The Gulf Stream Current stopped it plunging to globe into an ice age. Secondly is general weather, changing salinity of Oceans, adding volume of water changes solar and Earth generated heating dynamics of said Oceans. Third, is weight... Ice caps are extremely heavy, the globe isn't round, its more like a smooshed ball. The caps and glacial melt result in geologic rebound just as if you take your hand weight off of say a beach ball. Geologically this changes pressures on the planet such as potential magma flows, geological faults, plate tectonics and more, this is what my niece does for a living. There is also effect on Earths rotational speed and axis as a result of said melt. The Earth "Wobbles" because of its ice cap, remove that wobble and add more water we end up science theorizes back millions of years ago... Essentially when in America everything between the Appalachian and Rocky mountain chains were an inland sea covered in water and swamp.
Does it take hundreds of thousands of years? Well that's a big question. It was once thought indeed that would be the case but not so much any longer. The last Ice Age came on quite quickly and weather before hand seemed be extraordinarily devastating... Fictional movies were very loosely based on that science but the math sorta works yet said math is incredibly complex. Trying explain that to the layman pretty impossible, I'm a software having dealt in pretty high level math and my niece in the geology of global warming, polar caps and glaciers, known magma flows, plate tectonics makes me look like a first grader in math. She's literally drawn me pictures like one might a child to show me the incredibly complex and just ENORMOUS forces at play.
Lastly, Pandemic which the entire world considers the #1 immediate threat to the entire planet due to global warming and permafrost releasing microbial life that 98% of things alive on the planet now have zero defenses over. Covid showed what an existing mutated virus can do, Corona Virus is the same as the common cold. It was thought to jump from Bovines to Human's in the 1800's nor are we past Covid. There is no past Covid, humanity has only "cured" two human impacting viruses in over 100 years, Polio and Small Pox the latter of which is re-emerging. The Flu Virus which is completely different from Corona has killed people, made many many many more suffer as they age into complex health disorders since The Spanish Flu struck. For example the movie "Awakenings" talked of people who both immediately and many in their golden years experienced Encephalitis that rendered them "Zombies" unable to reach out from inside themselves, trapped, like a Tiger in a cage. Many many could take in surroundings but had zero ability to interact or communicate with them.
In the Permafrost lay not one, not two, not a hundred but instead literal millions of lifeforms ready to spring back to life and as said, 98% of them are unknown to life be it human, animal, plant or other microbial life now existing. Thats the #1 reason global warming is construed such a threat and WHY Pandemic Protocols were established. Covid gave us a glimpse and I DO MEAN GLIMPSE of what can happen. Spanish Flu killed 21 million people in basically no time flat and left at least three to five times that amount with long term health problems. It's estimated the actual numbers killed by H1N1 (Flu) well in excess of 100 million.
Few years back in India a virus spread by Mosquitos and Ticks resulted in their Cattle industry being literally devastated, don't hear on the news here do we?
Point all being, sure... Changing one technology to another in which both can and would/will have environmental impacts becomes a measure of WHICH is likely more dangerous to humanity and the planet. Hands down burning Fossil fuels at least currently wins that debate. The measure can be seen in everything from Tree growths, weather change, sea levels rising, glaciers going away, chunks of polar cap breaking off. It's not about the pocket book, it's about having a planet and also why there is tremendous pressure to get humanity unto Mars so as perhaps humanity can continue should Mother Nature decide it's time to exterminate us as she has done to ever so many species.

It is getting ridiculous. Can you believe this - "they" are also telling you that smoking is bad for your lungs, and that antibiotics can cure infections. When will it stop?
stainlessenginecovers
·3 years agoNot uncommon if you sell here.
When you sell NEW items, you are a reseller and NOT an end user.
Therefore, some manufacturers DO have guidelines to what something can sell for (Bose Speakers for example).
pjcdn2005
·3 years agoThey may have guidelines but unless the seller signed some a sort of product sales agreement with the manufacturer or wholesaler, they can not specify what the seller charges for their product.
stainlessenginecovers
·3 years agowhich they are required to do if they want to get the items 'from the manufacture' at 'wholesale' prices.
pjcdn2005
·3 years agoPerhaps some manufacturers require that. I haven't purchased direct from a manufacturer in years but when I had my own brick and mortar store, I wasn't required to sign anything regarding pricing.
Even if that was true, many people on ebay do not acquire their items direct from the manufacturer so they would definitely not have signed an agreement with the manufacturer.

·3 years agoSorry to hear this has happen to you. But unfortunately, this type of practice has been going on for years in many industries. You shouldn't be affected like this but it probably not the factory who is making the fuss. Alot of manufactures give retail accounts exclusive rights to be the only retailer that sells their product within a certain area. Thus they can set a higher profit margin. They will sell the product at what is called manufactures suggested retail. To get this type of deal the retailer has to commit to buying large quantities of the product.
Its then called a exclusive. The internet has made this practice harder on retailers because of competition online. Where a snag develops is when a retailer who owns the product goes out of business and blows out their inventory at greatly reduced prices, it then puts it out there to be sold for less by who ever buought it at the reduction. The days of these type retail agreements will be coming to a end as more and more brick and mortar stores leave.
I was in the furniture industry for many years and this was quite a common practice of getting popular designs at exclusive deals. It basically shut out competition on the product and allowed a higher margin. This all really started to unravel in the 80's as other companies would turn to China to have knock offs made. They avoided copyrights on the product by just making slightly changes in the design and much lower quality. Spin forward to today and basically all furniture is now produced overseas. Thus why alot of the product out there won't last as long as it did years ago.
Your issue was probably started by a retailor who saw you selling it for less than them and they contacted the factory to let them know you were selling for less. The factory in turn doesn't want to sell it to the retailer for less than they are selling it for currently so they can compete with you. These type retail practices aren't as common as they once were. The factory basically sets it up where you have to be a authorized dealer to be able to sell its products. Thats how they keep control. Since you didn't buy it factory direct, I assume, they can and will shut you down. Hope this helps you understand what may have happen. Blame another retailer as Ebay is just a middleman and wants to stay out of any type legal issues that could arise. They are covering there you know what. Can't blame them as any of us would do the same.

It's difficult to read a wall of text when the beginning of every word is capitalized.

·3 years agoIs there a reason for every word to be capitalized? Like all caps it’s hard to read.
Sounds like spam emails to me.
I’m a seller I don’t receive eMails from so called manufacturers.
itsjustasprain
·3 years agoI had an old cellphone where that was one of the capitalization options you could choose from in addition to all lower case or ALL CAPS. I have no idea why that was even an option. It makes for some weird-looking text.
I would ignore unsolicited junk emails like that.
If the manufacturer has a problem with your listing then they can file a VeRO complaint with Ebay and have it removed. Outside of doing that they can just pound sand. I would definitely not reply to that junk email.
