Item removed
This got removed for counterfeit/ ip after a user report. It was a listing for a 3DS Xl, four pokemon games, and 3 more pokemon games downloaded from the Nintendo eshop. Is there something inam missing here on with why it was taken down?

·4 months agoThe problem with you saying it has downloaded game is your game account. That is not transferable and be considered selling your account.
Considered digital games a lost cause. Same situation as if you buy from Steam, those games are tied to account and not transferable.

·4 months agoYou made a mistake by mentioning downloaded games. That's against policy. Now if you were to relist without that mentioned you would be at risk for the listing to get removed again.

·4 months agoNintendo is so notoriously aggressive about their property that I'm shocked that a.) only Nintendo of America is a VeRO member and not the entire entity, and b.) that people are allowed to sell used copies of physical Nintendo games at all.
The physical games might be allowed, but take this seriously; I once had Pokemon stickers I drew myself taken down on a different site.

·4 months agoNintendo knows what they are doing with the physical games thing. If they started locking out the sale of used ones then the backlash would be far larger than the amount of revenue they would generate.
I have sold consoles that had accounts on them with games before. But I never list the games out and always check the accounts to make sure they are abandoned ones (no activity for years). Like generally if you find a PS3 or Xbox 360 at a garage sale the account will be long abandoned. If the account has any activity within the last 3 years then I wipe the console first. I just don't like doing the factory resets if I don't have to because I have had consoles brick doing them.

That's a different issue ... copyright violation.

·4 months ago...Is selling downloads of a game you didn't make not copyright violation?

·4 months agoYou can resell the physical copy of the game (i.e. the disc itself and its accompanying paperwork, etc.). That's no different than selling a used book. But you cannot resell downloaded software, as that is infinitely reproducible; you're basically setting yourself up as a publisher when reselling copies of downloaded digital media, similar to if you started printing your own copies of someone else's book without permission to do so.
Well, that's the publishing-without-permission thing again. You don't own the copyright to the Pokémon images so you're not allowed to sell your own drawings of them.

·4 months agoI brought that up to say that Nintendo in particular is especially aggressive about their intellectual property. There are many companies who have far less astringent grips on their copyrighted material not because they want people infringing, but because it's frankly impossible for most of them to go after every single shuckster. Nintendo has global reach and the assets to go after even small-timers, and they do.
It was an interesting lesson for teenage me, though: I was very lucky it was just a takedown and not a Cease and Desist.
As you can imagine, I'm no longer a Nintendo fan XD

·4 months agoThey actually seem to be way more aggressive about their characters than they are their actual software. They do nothing about the flood of products loaded with bootleg Nintendo software. You can buy probably 200 DIFFERENT bootleg game systems and arcade boxes loaded with their games on Amazon and you have been able to for a REALLY LONG TIME.

·4 months agoDown loaded games cannot be sold a second time, They are limited to one download, Any attempt at downloading them a second time is basically useless, Nintendo or any other gaming company would not allow it, They would lose considerable amounts of money & they are not about to do that, Physical games can be sold again but not downloads.

·4 months agoYou can not legally or officially sell downloaded games from Nintendo. Go back and read the T & A from Nintendo

·4 months agoDid the message from eBay actually say "counterfeit" or was it worded differently?
The only thing I can say right now is that if the listing was removed, don't try to relist it. eBay has you "flagged" and if you try to relist, you can get in trouble for that.
klhmdg
·4 months agoIm sure it was not a "user report" - unless the user was Nintendo.
eBay has no one looking at these "user reports" and will not remove listings because Joe said it was counterfeit.
This was most likely flagged by Nintendo OR as pointed out by @dhbookds it is because of the downloaded games from eshop.
Downloaded games from anywhere are not usually allowed to be sold 2nd hand per the manufacturer.
If eBay was alerted by the manufacturer that this is counterfeit, they have no choice but to pull the listing.
Best not to relist here.

OP4 months agoThis is what it said in the email. First time ive had an item removed so unless thats just thrown in there thats why i said it was user reported.

·4 months agoAccording to the terms and services of Nintendo I don't believe you can sell downloaded games.

can you resell those?
fff094
OP4 months agoIs the "can you resell those?" a snarky way to say I cant then? Functionally there is no difference between those and the physical games sonce they were all legally and offically purchased.
lonebuck-books
·4 months agoNo, it wasn't a snarky reply at all. It was a legitimate comment. Most downloaded games have as part of the TOS that you cannot resell them. That is most likely what eBay took it down.
kibble-net
·4 months agoThis is the correct answer.
You can be mad about it all you like, OP, but it is the answer.
You are not allowed to advertise the sale of digital goods.
fff094
OP4 months agoSome of you are weird. I'm not mad, but that objectively wasn't an answer. He said, "can you resell those?" Clearly, I thought I could sell those, so that's why I asked if it was a snarky way to say I can't.
