Is there a way to win fraudulent return case without having to accept the return?
I sold an N64 on ebay recently. The seller got it today, and is claiming I sent a cracked unit with a jumper pak instead of an expansion pak. For those who don't know, the N64 has two memory expansions, the jumper paks are cheap and always black, and the expansion paks are usually red. Mine included the expansion pak, which is visible in the pictures. I do not even own a jumper pak, so it was not possible for me to send it, which is how I know for a fact this is a scam and that it didn't get damaged in shipping (which I also packed really well).
I have already reported the buyer with a detailed explanation, and included the original listing where I bought the N64, which shows that it did not come with a jumper pak at all (it also didn't come with an expansion pak, which I bought later). There is also a serial number on the bottom of the console, which is in my listing photos. I tried asking the buyer for the video that shows the crack and the serial number, but they made the excuse that ebay doesn't allow it.
Of course they have opened a return request which I can't deny. I do not want to accept their return, because I know they are just going to ship me a broken console. Even if I film myself opening the box and showing the undoubtedly wrong serial number and then send it to ebay, that's probably minimum of two weeks before I get the money if at all. If I call them will they resolve it faster? Is there a way to end the scam here without dealing with the full process? They also have 1 feedback, my account is 7 years old and I have 0 negative feedback as buyer or seller.

·8 months agoHow does ebay know if what you sent was the same thing as in the pictures?
They don't.
Anyways, the answer to your questions is NO.
You can't "win" a fraudulent return case without a return.
Do you expect ebay to just believe you over the buyer?
It's not going to happen.
Sorry.

Gamers gonna game.
They don't even see it as cheating or as criminal.

·8 months ago@reallynicestamps I literally almost put it that way. Like they see scamming as "leveling up" on "the system" or something. 😆
And you know, if it involves Walmart or Amazon or whatever that's one thing, but scamming a regular person makes me sick.

·8 months agoUnfortunately electronics are the most commonly scammed category on eBay, and video games are among the worst OF electronics. These losers share their scamming tips with each other on Discord, Reddit, etc. The 1 feedback is because this guy just creates a new account whenver the last one lost its Money Back Guarantee privileges or got closed by eBay due to excessive reports of abusive buyer behavior.
So sorry this is happening to you. If you have similar items you might want to consider selling them locally for cash instead. That's probably what this guy will do with your item. It may be his full time "job."

·8 months agoProtections for Top Rated Sellers
Top Rated Sellers seller are eligible for these protections when all the following criteria are met:
What to do if an item is returned used or damaged
Once you receive the item back, you need to refund the buyer. However, if the item has been used, altered or damaged, it may be appropriate to deduct an amount from the buyer's refund to cover the loss in the item's value.
If the return is eligible, you'll see the option to deduct a specific amount or a percentage when you refund the buyer through the return request. Once you've sent the refund, we'll keep the return open for up to 10 days so that we can help the buyer if they ask us to step in, but because you're protected there's nothing more for you to do.
See our seller protections for full details of eligibility and how we protect you in these situations. Keep in mind that you're not eligible for fee credits when you deduct from the buyer's refund for a return that was used, altered or damaged, and you’ll no longer see this option if eBay steps in to help with the return.
How to deduct from the buyer's refund when the item is returned in a different condition
If you qualify to deduct an amount from the buyer's refund:

·8 months ago@caldreamer @dojasoulja The ability withhold up to 50% of the refund isn't just for Top Rated Sellers. If the seller is at least Above Standard and had 30 days free returns on the listing, they can do the withholding.

·8 months agoYou can refund without demanding a return.
Sellers do that when the damaged item is of lower value than the return shipping.
For example, a china seller might accept a photo of the smashed package or its contents instead of paying to get a box of shards.
But you will be refunding.
Refunds are a business expense and tax deductible. EBay will send you a 1099K for your income tax if you sell enough (probably $600 gross).
From that gross amount you take your costs (including fees, postage, packaging materials, etc) and report the net to the IRS.
