I was robbed by a buyer!
I sold a pair of men's Christian Louboutin high tops. They approved the return and the buyer sent me a pair of beat up Nikes. I've submitted an appeal, I've also tried calling the seller number but it's useless. So is the automated chat! It just tells me the case was closed. I just got the returned shoes today. They're disgusting. I submitted an appeal with pictures of everything including the return instructions and shipping label. How do I fix this?

·8 months agoWhy do you keep ignoring the question why you listed these as NEW, but photos show dirty USED shoes?

First off, I don't know whether the sneakers are fake or not but that's beside the point of this discussion for the following reasons:
I have several comments. Some comments tell you what WOULD HAVE HAPPENED if your shoes were part of the AG program.
The first 4 items tell what would have happened if the shoes were indeed authenticated.
1. If your shoes were part of the AG (authenticity guaranteed) program, the listing would have had a banner and when they sold, you would have shipped them to the authenticator, NOT directly to the buyer. Your listing doesn't have that banner.
2. If your shoes were part of the AG program, you would have received notification from the authenticator letting you know whether they passed or failed authenticity AND condition. You didn't receive any notification, meaning they weren't authenticated.
3. If they failed to pass authenticity, they would NOT have gone to the buyer from the authenticator. The listing would have been removed as ebay does with counterfeit items and you would have a policy ding on your account for fakes.
4. If they passed authenticity but failed for condition, ebay varies in their handling. Sometimes they give the buyer the option of accepting the shoes if they're okay with the condition and sometimes they return the shoes to the seller as failing for condition.
None of the above happened because the shoes weren't authenticated by ebay and weren't part of the authenticity guaranteed program.
The next items tell what actually happened in this case.
1. Seller improperly listed well-used shoes as new.
2. Buyer purchased and paid for the shoes and opened a return claim for NAD (not as described)
3. Buyer claims counterfeit (a NAD reason) but also appropriate would have been that @bonhub-13 sold used shoes as new.
My opinion is that the seller needs to accept the return, issue a full refund upon receipt of the return and before relisting the sneakers, invest in a professional authentication by a company known for accuracy in the brand and item.
Personally, I question authenticity but again, I'm not a CL expert.

OP8 months agoThank you for the helpful information. Had the sneakers been returned, I wouldn't be upset. However, I was robbed by a buyer, have the original receipt from the purchase of the shoes, and this transaction took place across state lines so I intend to file a police report against the purchaser which is felony theft.

·8 months agoYou might want to look up the clean hands doctrine first. If you went into this with this intention of passing off used shoes as new, this could end up blowing up in YOUR face.

·8 months agoLike most dispute-related topics, before even clicking I already knew many sellers would pile on the seller involved and instinctively side with the buyer and eBay’s decision.
To be clear, the seller here was definitely at fault for listing the item as new. That said, his photos do appear to accurately show the item as it actually was. More importantly, that mistake does not excuse the buyer’s behavior of returning a completely different item (assuming the seller’s account is true). Two things can be wrong at the same time, and mislabeling an item does not justify fraud or abuse in a return.

·8 months agoI'm curious why a seller would list a "new" pair of Louboutin sneakers for $225.00. Those sneakers probably sold new (at a store) for at least $1,000.00 if not more. Even in the dirty condition they are actually in, I would think they should be worth more than $225.00.

·8 months agoIf you going to try and sell used shoes as new, at least TRY and clean up a little bit. Geeeeez!
momtoabeautifuldaughter
·8 months agoExactly....be nice if they would come back and say why they listed dirty used shoes as new.

·8 months agoSorry, there is no way to "fix this".
Selling online has it's risks. This is one of them.
Pictures or not, ebay has no way of knowing for sure what was sent back to you.
They will almost always side with the buyer.
This is something you need to consider moving forward.
Good luck.

·8 months agoCan you explain why you listed them as new but they were not new? Your photos show dirty used shoes.

·8 months agoDo $225 shoes need to be authenticated?
I thought the threshold for authentication was much higher.

From what I'm reading in the AG policy, eligible sneakers are authenticated at $100.
CL is an eligible brand, unless customized (which these do not appear to be).
But this listing didn't show the AG checkmark.
So that's why I was asking.

·8 months agoSold as new with box but even your pics show that shoes were dirty and used.
Maybe your buyer felt robbed as you advertised new shoes and they got these dirty used ones?

I wonder why your Christian Louboutin sneakers were not authenticated?
That would have forced a return to be authenticated on the way back.

OP8 months agoThe buyer showed some tag from eBay that was supposedly in the box stating that eBay stated the shoes were not authentic but that's impossible because I boxed and shipped them myself. He's pulling a scam. I'm filing a police report tomorrow. The value makes this a felony.
momtoabeautifuldaughter
·8 months agoLet us know how that goes. You listed the Christian Louboutin shoes as new but your pictures prove they were dirty and used.

·8 months agoI'm going to say it's because they didn't match her description. She listed them as new and her pics in listing show dirty used shoes.

·8 months ago'they approved the return'...who is they?
You have 'no returns' but of course there can be returns.
'shipping label'...did you give an automatic shipping label for the return or did eBay do it?
If eBay did it and it got escalated then buyer can actually keep them and get a refund...'case is closed'.

Maybe they were not authenticated as not matching your description as new. As others have stated, they were used and very dirty.
