I got scammed and I'm freaking out.
I need some help or guidance. I purchased what was supposed to be a Samsung galaxy fold 7 from a seller. After I got home and I opened the box there was nothing but a bag of potatoes! I started a return request and contacted ebay customer service and thay said they can step in after 3 days. The seller has messaged me and complained about the return request and is putting the blame on me saying that's not the box they sent the phone was shipped in, the phone has been activated, and overall trying to call me the scammer. At this point I am freaking out cause this has never happened to me. I need help.

Hope the seller fails to respond and you get some free potatoes for you trouble. Most scammers just send trash..

This is a typical his is He said/she said.
If I was the seller, I would get in touch with the USPS. As the package goes through the scanners in the main hubs it also gets weights. Because the USPS would not let a package go through with incorrect postage. a "bag of potatoes" would trigger the alarms unless the seller paid postage for a bag of potatoes.. If you don't belief me try it. a couple of times I had incorrect weights and USPS charged me the difference through ebay. So I would contact USPS to get info of any discrepancy of postage.

I agree. Send 1 potato, not a bag, to make the package weight and size of a phone.
Maybe the switch happened along the way to the buyer.

He received an item that's very obviously not as described.
He opened an NAD case. If there is no response to the case, he returns and asks eBay to step in.
Pardon me, but your suggestion makes the situation more complicated than it needs to be.

·1 year agoWhat is the weight the shipping label is showing for the potatoes? Keep a copy of the shipping label the potatoes come in. Take pictures of the package with the label just encase there is a problem.

·1 year agoI'm skeptical about the weight variance between a bag of potatoes and a phone. A phone will ship for under a pound while a bag of potatoes is considerable more. If the package had small dimensions and was under a pound and it may be hard to prove a bag of potatoes was in the box.

Immediately, the image is a 5 lb bag, but it need not be.

·1 year agoAfter you get your refund, reflect on whether you should be buying a Samsung Galaxy Fold 7 online from anyone other than Samsung or an authorized Samsung dealer who is included on Samsung's list of authorized dealers.
You will be getting your refund.

·1 year agoYou click return this item. Select does not match description. The seller can either refund in full or issue a paid return label. In that case you return that package and what ever was in it to them.
If they request you close the case DO NOT it can't ever be reopened.
Got to watch out when buying items like that. Current hot sellers attract scammers out of the wood work.

File an "Item Not As Described" dispute with eBay and follow the instructions carefully.

Is the shipping label from that seller? (check tracking number, track the number on the label)
If so, ask the seller if they shipping somebody a bag of potatoes. (might have mixed up some labels)
If not, did somebody in your family order some potatoes recently?
If it is from that seller, just return item, not as described.
Freind of mine ordered a $500 ice machine last Wed.
They sent him the tracking number on Friday.
He tracking it and it showed the "shipment" was shipped out on Monday (two days earlier) and was Delivered Thursday in Florida (we nowhere near Florida).
He flipped out, trying to cancel his PayPal payment. Not sure how that went.
But his ice machine showed up Saturday.
They accidentally sent him somebody else's tracking number

OP1 year agoThe tracking number is exactly the same from FedEx that the seller sent that was supposed to be the phone. The potatoes came in a big box and wrapping paper. There are no signs of the labels being removed or tampered with. The seller was saying that's not the shipping box he sent the phone in. At this point I'm just lost and just want my money back and never deal with this seller ever again.

·1 year agoUnfortunately, in some areas of the country, it is not unbelievable that the seller is telling the truth, when we consider the contract employees who handle delivering FEDEX Ground packages. However, it is also possible that this problem was a scamming warehouse employee who works for the seller.
Human greed can be a very creative motivator.

Wait the required 3 days.
On day #4, return to the case and ask eBay to step in.
Some responders are making this harder than it should be.
And, when the smoke clears from this, read the MBG.

·1 year agoThis sounds like someone at fedex stole the original package. Fedex is rife with internal theft, they know, and they don't care.
That aside, you will get your refund (as you should) but unfortunately the seller will get screwed.

·1 year agoYou opened the correct case. The scammer almost certainly won't pay for a return label to get their potatoes back. Ebay will automatically refund you. You're all good!

Ebay should find in your (the buyers) favor.
You may have to send back that bag of potatoes.
Once the tracking shows the seller received it, you will get your refund.

OP1 year agoYes I opened a not as described case with ebay and even called customer service letting them know the seller is trying to say I'm the one scamming him. Customer service did let me know I have to wait 3 days before they can step in. It's just a scary situation.

·1 year agoI know, it will be ok, my experience was the button to ask Ebay to step in did not appear until after the third day, so just keep an eye on that, you will be refunded, if the seller doesnt provide a label to return the potatoes, which he probably wont.

OP1 year agoThe seller noted he doesn't accept returns but according to the guy I spoke to in customer service he's required even if he doesn't. So I'm really hoping for the best.

·1 year agoFor items not as described cases, a seller has to take the return. There can be abuses/scams on both ends. I have had scams done on me from both sides, as a buyer, and from buyers. Its never great being in the position of being scammed no matter what side you're on. Ebay will definitely help you once the time limit is met.

·1 year agoSorry -- the seller does not "have to take the return". He does, however, have to refund. He can decide that it's not worth it to him to accept the return, especially if the item is broken etc.
Hard to picture someone who wants their potatoes back, but, then again, hard to picture someone who would have sent those in place of that Samsung galaxy in the first place.

·1 year agoHave you ever tried to fit potatoes into a Samsung Galaxy box? I've owned several Galaxy models over the years and never got more than two carrots. My current model, a Z Flip3, came with a few string beans included, which I thought was pretty chintzy considering how much I paid.
That aside, it doesn't matter what you received that wasn't a phone. You file the Not As Described claim, and if a return label arrives, you ship it back; if no label arrives, you ask eBay to step in after four days.
It occurs to me that the scam seller may also have either a fictional return address or a randomly-selected address for someone who knows absolutely nothing about it, but once tracking shows either Delivered or Delivery Attempted, eBay should enforce a refund.

·1 year agoNot sure why it's a scary situation. eBay offers you very good help when this happens. You open the case, wait 3 days, on day #4, if you've not received a prepaid return label, go back to the case and ask eBay to step in. You will be refunded and told to keep the item.
The Money Back Guarantee is very good. It's been activated probably thousands of times by buyers and worked well.

·1 year agoStranger things have happened, A similar thing happened to me a few years ago, but I was on the receiving end, I received a pair of sport shorts when i ordered a set of hot wheels, So go figure.
