Fraudulent buyer using myus.com / 4299 express lane florida
Summary: The discussion centered on issues related to a fraudulent buyer possibly using a specific mail forwarding service in Florida. Participants shared their experiences and concerns about potential scams and fraudulent activity associated with this service. The conversation seemed to focus on identifying and addressing possible risks when dealing with certain buyers.
Recently sold an iPhone. Shipped in perfect condition, After it was delivered I received a message from customer saying phone is damaged and i sent a broken phone. Customers english skills were very rough so I traced the address to 4299 express lane sarasota fl. I quickly found complaints and a case against this company from the US government.
I contacted myus.com and requested their customers actual location, they simply replied stating the customer is new and has not requested any packages shipped and all packaged they received are still at their facility. Customer requested a refund, ebay placed funds on hold. I have the proof the picture sent is fraudulent and not the phone i sent. Because according to his shipping company and his account number, the package is sitting in florida.
how should i proceed from here? I also specifically said US only.

·3 years agoCell phones are a favorite target for scammers although it's been awhile since I have seen one of these posted. How did the buyer "request a refund" if there is an official case opened with eBay or you need to respond provide the shipping information showing delivery to the freight forwarder. Mention in the reply that the buyer utilized a freight forwarder but the item has not in fact been delivered to the individual whatever country they are in. Provide the information from the freight forwarder if you are able to do so in your response to the claim.
Filing a police report will do little good. As others mentioned the FF has done nothing wrong. You can try filing a report with the buyers police department but that will probably do little good since they are international. You can report the buyer to eBay providing the same information you use to respond to the refund request.
One side note is while you may prevail on the eBay issue refund/request or claim if the buyer opens a chargeback with their CC company all bets are off. The CC company cares nothing about eBay's policy and will only look at the financial aspects of the claim. EBay may cover you if the chargeback with the CC company is the same type as the one filed with eBay and eBay may refund out of their own pockets. Difficult to say.

There are much better forums to sell cell phones on than eBay but if you continue to do so you may want to retain the IMEI numbers for the phones you sell. In the case of a successful scam by a buyer you can report the IMEI number to the blacklist which basically renders the phone useless to the buyer.

·3 years agoI am confused. Isn't the the problem is with your buyer, not with the freight forwarder? The freight forwarder did not open an INAD case. The freight forwarder did not send you photos you say are bogus.
Are you claiming that the freight forwarder broke the phone? What evidence do you have that it was not USPS or UPS or whoever the carrier was that you used to get the package to the freight forwarder who damaged it?
Several of my good customers in Europe used the company you are maligning, which has been around since 1997.
Asa for the "case against the company,," that is really old news. It began in 2013, draggeed through the courts for years, and was settled in 2019 after which the owner was no longer associated with the company, which was acquired by Aramex:

@maxine*j
The address is a freight forwarder. My understanding according to the OP is the phone is still at the freight forwarder facility in Florida, yet the buyer is claiming damaged, and he/she does not even have it yet.

Use one of the links to contact eBay through their social media portals. Regular customer service is not likely to help you. There are indeed some extra seller protections available when a buyer uses a freight forwarder. Unfortunately, the seller must contact eBay and inform them that the item is to be reshipped to another country using said freight forwarder in FL. They may dispense with the claim right away.

You can see the country of registration for you buyer on their feedback page. If they have ZERO, you may have to tweak a url. For example, here is yours:
https://feedback.ebay.com/fdbk/feedback_profile/erhu_3906?&ssPageName=STRK:ME:UFS
If you remove YOUR name between the forward slash and question mark and replace it with the buyer's, it will lead you to the correct page.
Keep in mind you have a timeline to consider when responding to the case. Even if you end up having to accept the return for some reason, you issue a label to the F.Forwarder address. There is a good chance they won't use it at all, will change it to another address in your Zipcode, or simply purchase a cheap trinket on the net and have it sent to your local library, pharmacy, etc. to satisfy the bot driven return requirement.

·3 years agoExactly. Yet OP is trying to make the freight forwarder the bad guy. The freight forwarder told OP that the buyer has not even requested anything to be forwarded. Yet buyer has opened an INAD and provided what OP says are not even pictures of the item sold. It's not the freight forwarder who's the bad guy here.

OP3 years agoIm obviously new to selling so I had no idea they could circumvent the US only rule with a “freight forward†company. But myus.com (the freight forward service they used) was great, they gave me 100% confirmation the package i sent, verified with my tracking number is indeed sitting there un opened in Florida.
Considering everything is time stamped, my actions of quickly figuring out what that address was related to and contacting them will probably be what saves me a thousand bucks.
If this post is some what demonizing to mass freight forwarding companies I apologize. But the plain straight forward fact is they are providing anonymity and a service that circumvents certain protections a business has to cover itself and I should be free to deny the use of these services in future sales. I know this person’s real name and it is NOT what was on the shipping address. So obviously no ID verification that is standard in your typical mailbox service was done. And a package with a fake name was signed for…..
Regardless, this can help somebody in my situation in the future increase their odds of not getting ripped off and I feel that is more important.
This person made it very clear they had received the package, opened it and sent me a photo of a broken phone that look like it was ran over by a truck. Considering they never had the package, that is obviously a lie and the start of what is indicative of mail fraud. Also if this person purchased a broken phone and has the company send it to me from the Florida address, I'm sure myus.com will be happy to inform me if that was indeed my package sent to my address. This is by far enough evidence for a police report. Lets see how it plays out.
I appreciate the replies and help. And I hope this saves some poor person some serious stress and loss in the future.
Thank you.

I looked at a couple of your Sold listings.
I see your shipping and handling details state "Ships to: United States."
eBay provided you with the buyer's mailing address in Sarasota, Florida.
The state of Florida is still one of the current 50 United States of America.
Therefore -- you did mail that sold item to an address within the United States.

OP3 years agoI’ve sold several so far, shipped fast. Have the invoice from my original purchase. Funds are in my business account already. We do have more items to sell for tax reasons from our business. The person did pay for the phone. My concern is owing ebay on a negative balance and this guy getting away with his shenanigans. Should i file the police report in florida or my state, should i wait to see if he actually ships me this smash phone so i can have it checked and then i have an actual stolen item and fraudulent return, or do i have enough evidence?

·3 years agoFile the police report if you wish, but the forwarder has done nothing wrong.
These businesses accept purchases made in the USA by overseas customers, broker them through the buyer's customs offices, and reship en masse first to the country then to the customer.
They have thousands of customers, and inevitably a few are crooks.
Tell the customer to open the Claim.
They will go away.
If they don't, send the Return ShippingLabel to the forwarding address.
The customer then has to get the phone to the forwarder on his own dime, and the forwarder has to find the Label and reship to you. With a deadline.
When that doesn't happen, your cost for the label is refunded, and the Claim dies.
You might want to get your problem on record with eBay, on general principles.
The phone reps have a terrible reputation for getting you off the phone as soon as possible even if that means giving you the advice you want to hear instead of the advice you need to have.

The social media Chat accounts are covered by trained eBay employees with some authority.
And you get a transcript so you can compare what you heard with what you were told.
BTW- Google the address on google maps. They have a picture of their plant. Not some flybynight outfit from the looks of it.

You may want to make a report yourself with the police. FYI I'd be careful selling all those Iphones as a new seller. New sellers are under eBays radar and selling expensive items, especially in multiples will set off red flags. eBay could very well hold your funds and ask for receipts as to where you purchased all these phones. Just giving you a heads up, as we see it here on this forum all day long. Please be careful. Again, file a police report and see what they can do for you.
Happy Selling

·3 years agoBecause the seller's responsiblity for delivery ends when the forwarder accepts the shipment, forwarders are the second most secure addresses you can ship to.
Much better than somebody's front porch, and second only to USPS PO boxes where the owner has a key.

·3 years agoThat's a freight forwarder.
The buyer is overseas.
Because he used a forwarder most of the Money Back Guarantee does not apply to him.
https://www.ebay.com/help/policies/ebay-money-back-guarantee-policy/ebay-money-back-guarantee-policy?id=4210#specialcoverage-inr
Tell him to file a Claim.
You will be told to send return shipping.
The Return Shipping Label goes to the address you mailed to in Florida, not to the customer overseas
When the phone is not returned, the Claim ends.
The unused Label cost is refunded.
A seller is only required to provide return shipping from the buyer's input address at time of checkout - that goes for any return where a seller provides shipping ('free' returns, etc).
