Ebay has illegally withheld funds owed to me for over a month. Efforts to have my monies release to me has be in vain.

·2 years agoWe would need more information to really help in this situation. But I see many have commented about selling police gear which is a huge no no on Ebay to prevent police impersonations. I would try to contact them and plead your case but if its been on hold this long it may lead to a suspension of your account sadly even if you did not have ill intentions. Plead your case sincerely and honestly that you weren't aware of the issue but you may have to wait for the outcome sadly.
But more information would be needed to actually understand your issue

·2 years agoEbay placed my money into a Bank account which wasn’t mine, as I hadn’t added my correct Bank account. It has been sitting there for two years and I have been fighting to get the money released to my bank account. Umpteen phone calls, all to different people. Emails sent etc. But no luck. Help!!

Best course of action would be to contact a lawyer.

·2 years agoIts pretty common for sellers on internet marketplaces to complain about illegality when funds are held.
Its almost always legal because you have entered into a contract with the marketplace which allow them to withhold your funds when you violate any terms of the contract or the policies which are incorporated in the contract.

While that is true one of the elements of a contract is legality. As long as there are no legal precedents to invalidate the contract terms those terms will stand. The contract becomes null and void when the terms and conditions of the contract are challenged in court. If the court rules a policy, clause or condition of the contract to be in violation of law then one or more parties have to adjust the terms of the contract.
Despite the terminology this is why it is a misstatement to "put a contract out on somebody." The contract is null and void because the terms of the contract are in violation of the law.

·1 year agoNever signed any contract. Ebay holds money for ONE reason. To make the interest of your money. That's it.
You sure did sign a contract when you signed up for an account you signed eBay's User Agreement.

·2 years agoYes, there is more to the story that OP isn't sharing. He probably got flagged for the law enforcement related items. (3 or 4 that he sold from first glance). EBay no longer cares/can tell what is vintage vs. actively used for law enforcement so it's no longer safe to sell that kind of stuff here.
If he's going to post here he should actually share more details but I'm sure he won't.

Agree there is more to this. It appears the OP's account may also be suspended or they have pulled all of their listings. No idea how much eBay is holding or the exact reason. Best advice I can offer given the limited information available is for the OP to contact a lawyer.

"Made of solid copper, best detailed and three-dimensionality. This badge can only be purchased and used as a memento, or in a collection, for decorative purposes, for a dramatic presentation or for any recreational purpose."
Uh, huh. Right. And people wonder why eBay bans the sale of even replicas.

I saw the posts regarding the law enforcement items and could understand why they might suspend the account but can't understand the extended hold on the funds if they have either temp or perm suspended them.
While I fully understand the eBay policy regarding holding funds it is what it is and will probably stand until somebody challenges it in a court of law.

·2 years agoI'm not sure how holds work, because I never had one so I've never looked into them in detail -- but the items all sold on Aug. 6, so maybe the hold is calculated from that date -- in which case, the 30 days are not up. Also, he has fewer than 10 seller feedback (no details, since feedback is private), so he may have a new seller hold.

To help prevent impersonation, we don't allow certain police or emergency service-related items to be listed for sale.
The following items can't be listed for sale on eBay:

They can hold your funds for 30 days and there's nothing illegal about it.

There are a multitude of reasons you are having your funds held...'illegal' is not on the list
There are compliance holds, dispute holds, transaction holds, all for one reason or another.
Have they indicated why there is an issue? Have you replied 'in kind' to any requests, seeing as you are being classified as a 'New" or "Infrequent" Seller since you just recently returned to selling....

·2 years agoDoes selling two prohibited item have anything to do with it? You're not allowed to sell police jackets and badges.
Maybe they're preparing to restrict you from selling and turn the money over to your state, or maybe they are holding payments because you are a new or infrequent seller.
