eBay never protect their own sellers, who paid the most
There were couple times, some buyers as fault to return orders with missing items. I sent message with picture proof, report buyers, called customer service, and boom..... they closed the case which I cannot dispute.
Ebay said they do not have any physical contact with the item so they are not in the position to determine who caused the problem.
If this is a case, all eBay sellers will be treat at fault.
Could anyone can give us (sellers) at least a minor protection as sellers, or should we talk about the class action ?

·1 year agoIf you offered 30 day free returns, you could deduct up to 50% of the refund.
That's about the best you'll get.

·1 year agoEbay allows buyers to claim item not as described and you end up either settling or refunding entire purchase. Buyers are crooks and eBay believes the lying buyer not honest seller. I will not list anything worth over $50 on ebay now.

·1 year agoIt is a pretty straightforward decision. eBay protects the buyer’s interests first and foremost. Knowing this upfront, sellers must adjust their expectations —and decide whether or not to use the platform and accept the inherent risk of selling online here. Do the benefits outweigh the risks? It will be different for each if us.

No one except eBay can do that.

That was litigated in Campbell vs. eBay in 2012, and the case was dismissed. You will have trouble finding a law firm to spend money on a longshot.

·1 year agoTrue, but sometimes even when eBay or their representatives are in the position to determine who caused the problem because eBay did have physical contact with the item but they will still find the seller at fault.
Check out this post where after eBay authenticated a item and sent it to buyer there was a problem that buyer did not receive item. eBay forced a refund from the seller anyway, even though it was eBay who shipped the item to the buyer.

·1 year agoWhen the eBay claim is done...there is the original photo of item purchased which eBay shows on the claim.
And thus, the buyer has to download a photo of what they received on the same claim.
Funny thing, buyer can remove something from original photo saying it's not there.

OP1 year agoI had pictures of the listing and compare with pictures of the returned package, it showed missing item

·1 year agobut that's not "proof"............you could have removed the missing item before taking the picture..... which some seller might do, if ebay paid off on these kinds of claims........

We take the 'good', the 'bad' and the 'ugly' sort of speaking
We win...we sort of win...and we downright lose.
I remember (I'm retail in wine shop.)...a buyer returning a bottle as corked and had liquid in it with the same cork reinserted...we have to refund on the spot...it was a bottle of Caymus Cabernet Sauvignon for $200.+
After customer left we felt noisy and opened it and it was 'coffee' inside and no wine...LOL

·1 year agoDayum! I would feel noisy if that were pulled on me, too - I would probably get noisy, too.
Jonathan Swift once said (paraphrase) that one obnoxious person takes up the energy of five normal ones. I think that's about right.

You are not protected in a INAD (item not as described) case.
Ebay will always side with the buyer.
You are protected in a INR (item not received) case.
As long as you respond/upload a tracking number that shows the item has been delivered, you're covered.
