eBay does not take counterfiet items seriously.
Summary: quadcitypickers raised concerns about eBay not taking counterfeit items seriously, particularly regarding SKIL batteries. jdbelt1960 mentioned instances of misuse of the brand name in product listings, with some sellers not indicating products as 'replacement' or 'for' SKIL, but rather using the brand directly. luckythewinner observed that most listings correctly stated 'replacement for' or 'for Skil', though a few listings misused the brand name, which they identified as keyword spamming and search manipulation, rather than counterfeiting, but still a violation of eBay's policies.
I was looking for a new power tool battery and saw a seller selling fake Skil batteries.
They did not have the Skil logo on them or look similar at all. Pictured is a real battery, then the fake one.
We looked into your report and didn’t find the listing to be in violation of our policy. This determination was made by a customer service agent.
I swear they hire blind people!
eBay...if you want to constantly display your intolerance for fake goods being sold on your site to the media, then you need to take action!
I used to report this stuff twice a week and have now stopped. Every SINGLE REPORT comes back as "we didn't find this listing to be in violation".
eBay, why are you allowing this?

·4 months agoEBAY bots are notorious for making bad decisions.
When you reported this listing, did you use reason search manipulation? It is against EBAY rules to show brand name when they are selling knockoffs.
What is the policy?

·4 months agoNothing wrong with aftermarket parts, not everything has to be OEM. For all we know its the same manufacture just not labeling for Skil. However, I will say stating "SKIL" in title is wrong and INAD. The seller could say in the description, compatible with name brand items of list SKIL and others...I think it is dangerous to list aftermarket parts and state specifically for one brand/item, but if seller is clear these are after market, it is ok

·4 months agoThe title needs to say "for Skil" or "fits Skil" and in the item specifics the brand or unbranded needs to be listed.

OP4 months agoUsing a brand name in such a way that may cause a buyer to believe it is a genuine product is.
For example "brake pads for Toyota" is fine. Or "aftermarket brake pads for Toyota" is fine.
But "Toyota brake pads" is not. That wording would allude to them being made by Ford.
Same with "HP compatible laser printer toner cartridge" vs "HP Laser Printer Toner Cartridge"
I can also tell you from someone I know who got "dupped" a few times, they will often photoshop the logo out on the eBay listing but the actual product WILL have the brand name on it. I see this a LOT with auto parts. Usually the OEM brand is photo shopped off the box and part, (just grey boxes) but the actual received item will have those logos.
Unfortunately eBay is so lax in enforcement they know fully well how to "play the game" to continue selling these items.

·4 months agoI have a solution for you..go to authorized dealer and buy it..costs more? Price of authenticity…eBay can’t, physically, verify every single item …if you think/ know item is counterfeit, move on and buy elsewhere..stop trying to save the world…

·4 months agoNot a violation nor a counterfeit since it doesn't claim to BE a Skil branded item. It's only a "knock-off".

·4 months agoIf they are not selling it as a SKIL battery but rather something that fits on their tools it would not be a violation.

OP4 months agoThe title literally begins with
Skil 12V Battery 6.0Ah BY5020A-00
Not "replacement" or "for" or anything,

·4 months agoWhen I search that exact phrase, I got 17 listings, and 15 of them said "replacement for" or "for Skil" in the title.
