EBAY CUSTOMER SERVICE WORKERS ARE ASSISTING IN THEFT.
TL DR. ITEM WAS RECEIVED BY BUYER. I DONT KNOW WHY THE HECK EBAY IGNORED EVERYTHING AND REFUNDED THE CUSTOMER AND ASSISTED THEM IN STEALING MY ITEM . THIS IS THE 3RD TIME THIS HAS HAPPENED THIS MONTH.

·4 months agoYou sold an item.
You did not use tracked shipping.
The customer opened a Not Received (INR) Claim within 30 days of the estimated last day for delivery.
You did not respond promptly.
The Response could be the tracking number showing delivery OR a refund.
Now - if you did not use Tracked Shipping, which is expensive compared to untracked, you are gambling that the item will be delivered in time (a good bet) and that the customer will not open a Claim (usually a good bet, but it depends on the category*.)
Is the cost of tracking 100 packages where 95 go right, high enough that it is worth losing the 5 Claims, whether the Claim was valid or a scam?
If you did not respond promptly to the Claim, you got a Defect, which is much harder on your selling account than making a refund.

·4 months agoCustomer service workers cannot do anything other than chit-chat.
'send a request for a manual refund'...they can't do stuff like this...they can give advice and suggestions which might be wrong or right.
'confirmed the delivery with feedback'...feedbacks are meaningless in something like this I am afraid to say.
A seller is responsible for the buyer getting the item.
Unfortunately, not all buyers are honest. I wish they were.

·4 months agoNo that is not correct. There are U.S. consumer protection laws supercede (gulp) even eBay.
Under U.S. law, sellers are responsible for ensuring goods are delivered to the buyer.
The Uniform Commercial Code § 2-509 has been in effect since the 1950's.

·4 months agoDoes that include USA sellers that are shipping items outside of the USA? ie: If a buyer in Spain complains about not getting something from a US seller, will US law protect the buyer?

Then it seems like eBay's MBG would protect that buyer. That buyer could/should open an item not received case.

·4 months agoYes, in my scenario, assume the item was shipped from a US seller. eBay's MBG would probably protect the buyer .. I was wondering if the US consumer protection law would provide any kind of protection for a non-US buyer. It's probably designed to protect American buyers only.

·4 months agoNo. The law is for domestic U.S. consumer protections. It does not apply to international shipments.

·4 months agoIf this was a shipment for a sticker have you considered using ESE, there is tracking on these types of postage? Not th e best tracking but better than no tracking at all with First Class. I do not ship using ESE since most of my items are more than a few ounces.

EBAY STANDARD DELIVERY LABELS ARE FIRST CLASS ENVELOPES.
EBAY SLAPPING THEIR DOOFY NAME IN THIS MEANS EBAY IS THE ONE HANDLING THE TRANSIT.
IF USPS DOESN'T TRACK FIRST CLASS ENVELOPES ✉️. EBAY NEEDS TO FIGURE OUT HOW TO TRACK THEIR LABELS.
ITS NOT THE DUTY OF THE SELLER TO TRANSPORT THE ITEM TO THE BUYER. ONCE SHIPPED EBAY IS THE ONE WHO SHOULD BE TRACKING
THEIR LABEL.
THIS IS OUTWRIGHT THEFT. AND SHOULD BE TREATED AS SUCH.

It does not, eBay does not "handle" any shipping, they provide a way to print labels but it is USPS who actually provides the label and the delivery service.

·4 months agoYou clearly do not understand Consumer Protection Laws or your agreement with Ebay.
You the seller are responsible for the safe and timely delivery of every order you accept and are paid for.
It does not matter who you pay to deliver. YOU are the one who is responsible.
There are limits to the liability which is accepted by the carriers of your shipments, and there are procedures to be followed. Whether you are reimbursed, in part, in full, or not at all, has no effect on what you must pay the buyer.
You cannot argue your way out of your responsibility, no matter how just you think your position is. It is a matter of LAW, Consumer Protection Law to protect the buyer, and contract law which governs your relationship with Ebay.

Almost all of us are fellow buyers and sellers here. We are not responsible for any of the things you mentioned.

·4 months agoCalling ebay thieves because the did not rule in your favor on a dispute is ridiculous.
If you truly believe ebay is involved in theft, I suggest you contact law enforcement immediately.

OP4 months agoFirst off and most importantly. The customer confirmed they received the item. They forgot to take the case down for item not received. eBay has the ability to check message (they do not care to). Also the freaking email sided with me. The case was closed by a bozo and sided incorrectly that’s the main problem here. There’s nothing the seller can do for this. If this happened to me. Imagine the millions of other sellers. That’s where the theft by eBay comes into play.
This would be considered petty theft.
I would need to tally up to 1000$ for grand larceny. and then I’ll have the ability to report it to any local law enforcement.
I’m not there yet. (Thank god).
Mercari and whatnot has a built in system to confirm shipment.
eBay does not.
whatnot , you immediately have to take a picture of the item in packed , they log it. You see where the person is standing.
Mercari has some way to track them. I don’t know how but they are very good at it. And since they provide the labels. They actually refund the sellers if the item is truly lost in transit.
(ESUS) labels are not tracked by the post office. They are limitedly tracked. As in the post office worker has to do their job correctly (in which they are lazy pieces of potato’s) and sometimes they just skip the logging information. The ✉️ envelope need to pass a barcode scanner in the hub facility of the city/state. If workers are skip this. It’s not logged. DOESNT MEAN ITS LOST. ITS JUST NOT LOGGED.
EBAY STANDARD DELIVERY MEANS EBAY IS ONE HANDLING THE TRANSIT. IT LITERALLY SAYS EBAY STANDARD DELIVERY.

You are apparently talking here about using Ebay Standard Envelope but your listing promises USPS Ground Advantage. ESE mailings have routing codes but they do not have actual tracking barcodes. Ground Advantage DOES use tracking barcodes.
Routing codes on ESE mailings are read by automatic sorting machines along the way but that is all the reporting you will see. If the buyer files an Item Not Received claim then you will have to refund in full and then get restitution from Ebay which is available up to $20. No routing updates will occur if the package is too thick to go through the sorting machines.
If you had shipped using Ground Advantage as shown in your listing then you would have had actual tracking and an actual Delivered scan which is what you have to provide in an INR claim in order to win and not have to refund.

USPS is the one that handles the transit.
Quit using the cheap service and ship Ground Advantage like your listing stated.

·4 months ago@pokepeelery : If you used eBay Standard Envelope to ship the sale then you can be reimbursed for up to $20 by eBay if you have to refund a buyer who has filed an Item Not Received claim.
INR claims are defended by tracking that shows a Delivered status to the City and ZIP of the address provided with the payment. Because eSE envelopes do not have tracking (they have only routing codes read by sorting machines), you will not have any tracking to upload and will need to refund the buyer. What you do next is file with eBay for restitution so that they will basically cover your refund that way.

P.S. As was already pointed out, your problem listing showed that you would be using USPS Ground Advantage, not eBay Standard Envelope. You should go with whichever service was listed by you and paid for by the buyer.
