    DAY 8 OF EBAY NOT SHUTTING DOWN A CHINESE SELLER WHO HAS COPIED MY ENTIRE ACCOUNT

    Well here I am again after calling every day for 8 days and getting nowhere.  A Chinese seller has pretended to be me copying my entire account except my Screen name.  They have taken all my over 5000 items including photos even though they include my company watermarked ones. They have taken my entire description with my business name even includes a link that links right by to my account. Anyone with one eye and a quarter of a brain would see this is clearly stolen valor. I have been a seller on ebay for 25 years and have sold over 300,000 items on all my accounts and this is a new low. Why is nothing being done? They are clearly pretending to be me selling items they do not have.  Now customers who have purchased items will not get them and it will look like im the one scamming them. This cant be real?

    @burningrubbertoycompany your items listed are illegally showing a picture (that is NOT a watermark- you need to learn what that is) and even MORE important- you are NOT making those items, you are simply a 'reseller' so you have NO copyright back up to report anything.

    While it used to be a policy violation to copy another seller's photos and text, eBay has decided that such plagiarism is now allowed.  Once you post an item for sale on eBay, your photos and text can be copied by anyone else without penalty on this site.  They don't even have to be in the eBay "catalog" anymore which is why watermarks were disallowed since they could not really be included in the "catalog" without looking suspect from the start when someone else used them. 

    Though the policy still states that text in photos and watermarks are not allowed, it is not enforced.  eBay would have to get rid of 90% of their esteemed sellers from China if that were the case.  

    If you do have your own website, and someone snags your photos and text from the WEBSITE (not eBay) then you have recourse.  Otherwise, no.  Anybody is allowed to use your work product. 

    If it is any consolation, all buyers are not as stupid as one may think.  A right click on a picture or two on google chrome will often produce information regarding such plagiarism and the 'thief' will be avoided.  As a buyer myself, I use it all the time.  That "beautiful vintage rhinestone necklace" for sale on eBay for $39 can be purchased on AliExpress for $5 for a lot of ten.

    eBay prohibits waternarks of any kind.  Because they allow others to use your pictures and texts then maybe you shouldn't be watermarking your pictures.

    @burningrubbertoycompany There is an obvious solution here, just not the one you likely want. Currently you are confusing copyright infringement with eBay policy. One carries the full weight and import of the US Govt. The other does not. If you object to the unauthorized use of your intellectual property, then go get legal counsel and sue the user.

     

    But eBay is not going to step in and stop the practice, because copying another seller’s listing is not a pressing violation of eBay’s standards or rules. In fact, the opposite is true. eBay encourages its members to use the text and images found in its source catalogue. Now it’s true, a few years back, this behavior was anathema but things change and this was one.

    When another seller is selling your stuff, I think that means you made the big time! 

    I hope you have All your own line of products. Then you got it made. 

    Because in order for them to sell your stuff that is only available from you. 

    They would have to buy it from you anyway!

    The way I see it is, you got yourself a free salesman and since you're not paying him. 

    You don't get to fire him no matter how bad a salesman he is. 

    Just be happy he's trying.

    Oh what was that? You don't have your own product line.....too bad then you're just doing the same thing they are then reselling someone else's stuff.

    I could just imagine Dewalt company calling Home depot "Hay Guess what I saw what you did, you have a whole isle of my stuff the same exact tools that I sell and you used my images and color for the ads I can still see where it says Dewalt, I don't like your sales prices are you low you will sell more than I do I demand you use a different name and color! egg yolk is my color!

    That is an odd take away from my one sentence post.  I never came anywhere near addressing ANYTHING you responded with.  Seems you ASSUME a lot and took creative turns in your response to what I said.  Which was, for the record, simply this:  "Odd why someone would want to copy a seller with such a bad record."

Ill ship some crayons and coloring books.  Never been a push over you can apologize to the ones who don't read or look past picture 1.     They're learning to hit the back button and flee from you.

     

    Holy Moly! I would NEVER buy from a seller that replied like that to FB.

    Clearly you don't know what stolen valor means.

    Stolen Valor refers to the act of falsely claiming military service, achievements, or decorations that one has not earned.
