Competitive sellers offering 2024 preorders, breaking policy outside of 40 day delivery | Selling

I recently posted a discontinued item released in 2016 for $400, that has been selling around $415. I didn't have any bites, and when researching my competitors, found that there are preorders for this same item stating 2024 in the item title, for around $350. The difference is I have this item in stock and ready to ship. More research shows the manufacturer opened preorders for a reissue of this item, but won't ship until at least March of 2024. After researching these sellers, a bulk of their listings are for preorders well beyond 40 day delivery. I've gone and reported all of their listings that break policy. So far, no action has been taken by eBay. I can easily produce the manufacturer's preorder ship dates to prove they are outside of the policy window. All is fair with competition, and anyone can be as aggressive as they like with pricing IF they have the item on hand to ship. However, given the policy restriction of 40 day delivery, these competitor's listings should be removed with extreme prejudice.
