Buyer leaves false claim in feedback
The buyer purchased a presale item (not in hand as of yet). I’m always 100% transparent in all of my titles and descriptions so that there’s no misunderstanding of any kind. Having said that, I was unable to secure the presale item, so I immediately reached out to the buyer to let them know and then I refunded them immediately (it is also stated in my description that if for any reason I am unable to secure the item I will refund immediately). The buyer left a feedback saying that I sold the item to someone else for more money which is false. Not once did I relist and resell the item. eBay states that the buyer didn’t break any policies (what about the false claim?!?!) which I disagree with because the buyer used the feedback system to retaliate against me despite my being 100% transparent with them. Is there anything more I can do? Escalate this to higher authority?

·2 years agoThe buyer did leave a false statement, yes. Ebay should always remove those, they aren't mere opinion or feelings.
You also may have done something wrong. Listing and selling an item you don't physically have in inventory is a violation of ebay policy, unless you have some special supplier relationship you made ebay aware of and they are ok with it. There are only a few conditions ebay is ok with sellers not having physical possession of inventory on hand.

·2 years agoIf it was an item for a few dollars I can understand it...but it was a high end sale. It's like taking money from someone for a loan and then paying them back when you get paid. Item should have been in your hands before selling something for so much.

OP2 years agoNot exactly the same. My description says it’s refunded immediately if securing the presale is unsuccessful; so in full 100% transparency, the buyer is aware prior to purchasing. Some folks don’t have the time to go for a limited item, so they go on eBay and purchase a presale for the item. I, personally, don’t hold onto any funds unless securing the item is successful (and I do have a decent rate for securing limited items, this was just a rare occurrence); otherwise, I refund right away.

Speaking as a buyer, I wouldn't accuse you of selling it to someone else, but I sure as hell wouldn't be happy about the fact that I'd paid for something you couldn't deliver.

·2 years agoI'm a bit on the fence about this one. I can see your point of view and that of your buyer.
However, I'm with you on the false statement in the FB by the buyer.
Sometimes it can take multiple attempts contacting Ebay to get a FB removed. I would say continue to try and stick to your story of the false statement in the FB which Ebay can tell is false from your Selling and listing history.
I would suggest that you contact Ebay for Business on Facebook, Instagram or Twitter for the better trained CSRs.

Sometimes you have the Chat option available and other times it won't me. If it is important to you to use one of those options, just try back later.
If you use a cell phone or other mobile device, you may need to turn off your Spam filter so that Ebay can call you.
If you are a seller outside of the US or Canada, you will need to use the Chat Option.

·2 years agoSelling ANY item that you don't have in your hands is very risky.
I would never do it.
That being said, I think you may be able to get that feedback removed.
It may take several attempts and the right CS agent, but I think it could happen.
My reasoning is, the buyer has no way of knowing that you re-sold the item to someone else.
That is pure speculation, thus making his statement untrue.

·2 years agoI still remember the one I got where the buyer left a neg because a "metal coin" was "heavy like lead". It's metal, what did you expect? The metal was mentioned in the title (to not confuse with silver versions of this coin). Anyway after a few attempts they did remove it.
Another poster got one because the pendant wasn't as shiny as it appeared in the listing, that one got taken down pretty quickly with the online removal tool.
I think AI is partly responsible for these removal decisions.

·2 years agoWhen the bot reviews the FB, if there is a crystal clear reason to remove the FB, the bot will do it rapidly. But when the reason to request it to be removed is a bit more foggy, the bot will deny the removal.
It however doesn't hurt trying the automated way first. If the outcome had of been different, you would still be able to contact Ebay and request a human review the FB and then give your reasons for wanting it removed.
