Buyer is claiming INAD on a factory sealed item
This buyer purchased a factory sealed new item from my store last week or 2 and is now claiming that the content is a wrong one and doesn't match the item. I call bull sh**. Straight up. I know if he files an INAD claim - I will most likely lose.. How can I fight this? I even discounted him $10 for this item just for him to pull some crap like this.
I am straight up accusing this buyer as a theif. the photos that he sent me does not make sense as it is half the size of the actual item and it would obviously have rattled inside when shaking the content. It did not.
I messaged the buyer to file a claim through ebay but what are my next course of action here?

Nothing more, nothing less in a message. Puts the ball back in their court.
If they open a return, make sure a return label is available.
Get the item back and refund accordingly to eBay policy.
You can't fight it.

·5 months agoYour next course of action is to accept the return and refund the buyer once you receive it.
If you aren't willing to do that, then stop selling here. This is part of running a business. Ebay is not Craigslist and it is not a garage sale.

Once in a while I will get a INAD.
It happens.
I treat it just like any other INAD.
Accept the return and refund the customer when I get the item back (even if it's opened).

·5 months agoJust wait and see if they do file a case. If they do, you just issue a paid return label and refund when you get it back. There is still a chance. Many buyers never get around to sending items back. You might get lucky.

·5 months agoYour 'next course of action' is do NOTHING; until buyer opens an official 'Return' (probably reason of 'not as described').
Doesn't matter if buyer ships you back a rock, you must refund (and provide return label prior to).
Just the way it works here. There is nothing you can 'prove' of what you originally sent the buyer.

·5 months agoEBAY has Seller Protection if you Top Rated Seller and offer 30-day returns, you can deduct percentage if item is "returned damaged".
If you are NOT top rated, you must offer FREE RETURN to get any EBAY Seller Protection.

·5 months agoUnfortunately Ebay will just tell you to refund the buyer upon receiving the item back. Buyers have a right to file an "item not described" case against the seller and ask for a refund. Don't fight it. Just know whenever you list something especially sealed on Ebay you run the risk of stuff like this happening. Majority of the time things go fine but you run into buyers like this one.

OP5 months ago** To add, the buyer came off right off the bat fishing for a refund. Asking for a refund immediately after providing bogus photos on a factory sealed item.

·5 months agoIf they run it thru the eBay procedures you will have to refund. Send them a return label thru eBay. If eBay makes the decision on your behalf you are more than most likely not going to like the outcome.

·5 months agoI also had this happen to me. buyer wanted a refund right away and then sent back an entirely different item. One that I never sent him. He got a full refund, + shipping, kept the item I sent him, and now I'm out the sale money plus the item that I don't have any longer. Total out $115.00. E-Bay really needs to level the playing field here with "buyers" and "sellers". At least have a way for sellers to warn other sellers of certain buyers. I couldn't even leave this thief a neg. feedback. You can "report" a buyer (which I did) but then E-Bay will never let you know what they did. Anyway I guess it's just a chance we take using E-Bay as a selling platform.

·5 months agoSellers haven't been able to leave negs/neutrals for buyers in a couple of decades now, this isn't anything new.
