OP9 months agoLook all I DO KNOW SO FAR is that some Prolific Copyright Infringer reported me thru the VERO. His Ebay store is evidence of 100's of cases of Copyright Infringement. This is all i have gathered so far. I Do not know if Taking a dump in his bed is warranted just yet.
I also am starting to believe he's more Insane than Tony Robbins

·9 months agoSorry to hear you are up against a big time money maker for eBay, if that is what is happening. The best solution to maintain your eBay status is to stop selling whatever is bugging eBay, VeRO or whatever.
Not sure how many warnings or takedowns you get before eBay puts the hammer down.
Good luck.
ETA: The bed thing has nothing to do with your nemesis, unless of course, he's Johnny, in which case, get him to sign a few of his things and you'll recover any losses by selling them here.

OP9 months agoThis Guy is making some Serious Enemies online. I keep finding stuff almost everywhere I look. Omg

OP9 months agoThe more I Dig the worse it gets. His Google reviews are nothing like his stellar 100% Ebay Feedback.
Seems Sparky is a Bad Foulmouthed Vero Pirate

OP9 months agoTake a look at my store. There is literally no Infringement anywhere yet I get reported for Copyright Infringement.
Take a look at my Accusers store by typing in "Ready Kilowatt Sign" and find the Guy standing by the white house with blue windows. He has 12 pages of Copyright Infringement Items he is selling. He is your Vero Hero ?
grann-4629
·9 months agoWhy do you think he's a VeRO hero?
He is selling the same illegal stuff you are, but more of it? Try reporting him and you'll see the difference between a report made by a VeRO member to protect his product, and a report made by an unhappy member. I would like to hear the results, only because of the gazillion similar complaints made by others of which we never hear back from.
Good luck ... the message on the stickers is still good 🤓
nh_sales_lv
OP9 months agoThe Guy who reported me is making Unlicensed Copyrighted Signs and he's reporting others.
He's making Disneyland signs and Mercedes Benz signs. Do you really think he got Licensing ?
He's a Vero member & the Biggest Copyright Infringer Ebay has.
luckythewinner
·9 months agoHe's a Vero member & the Biggest Copyright Infringer Ebay has.
So let's recap:
nh_sales_lv
OP9 months agoNo, Vero is a Anti-Trade Tool that is False Reporting made by a Few and seeks to eliminate free market-based exchange.
Vero is the most Misused System Ebay has Implemented to date in it's recorded history.
Vero belongs in the Waste Bin Annals of History.
grann-4629
·9 months agoSorry pal, your argument just jumped the shark. Try looking up the origin of, and the reasons why the VeRO program exists. If you don't violate (ie: steal) their ideas, you need not worry.
nh_sales_lv
OP9 months agoWho are They ? Xcel Energy, Timothy Colvert, Sparky, Electolite, Jonathanbrightlight ?
Why do you think he's a VeRO hero? I don't - I have no Idea who he is but apparently he's **bleep** off a lot of Sellers on Ebay.
He is selling the same illegal stuff you are - No, my Stickers were on Ebay for all of 10 minutes.

OP9 months agoI remember getting a message in my inbox from Beijing China from a Kuang saying he had Vero Intellectual Property Rights 😂

·9 months agoThere doesn't need to be.
If you didn't create the artwork, you don't have automatic permission to use it. Simple as that.
You cannot simply assume everything is public domain unless there is a trademark symbol shown, that's not at all how it works.
I am not a lawyer, but this is pretty basic stuff. Feel free to google it and learn more. Or just keep arguing with people on the forum and insisting you're right.....
nh_sales_lv
OP9 months agoPeople are blurring the lines of Vero.
Milwaukee Tools owns the Copy Rights to Milwaukee Tools
Zoro does not own the Copy Rights to Milwaukee Tools
Moen owns the Copy Rights to Moen Faucets
Build does not own the Copy Rights to Moen Faucets
stainlessenginecovers
·9 months agoThe only blurring going on is by you.
What does Milwaukee or Moen have to do with anything? Zoro is NOT using the Milwaukee Name and logo to make bumper stickers, t shirts etc.
Apples and Knitted Socks..... as these are not even in the same genre
nh_sales_lv
OP9 months agoYou don't get it do you
Build sells Moen Faucets on Ebay. Build is using the Vero system to report sellers anytime a Moen product comes up for sale. Build sells more Moen faucets than everyone else.
This is the most common way Vero is being used.
The actual Big Copyright Owner may sometimes use it to protect Distributors or if there's a New Release product and 70k of their old models litter Ebay.
Either way it's a Malicious Tool.
nh_sales_lv
OP9 months agoSome people here are late in the game, My sticker images have nothing to do with the Sign Maker who is Obsessed with Ready Kilowatt so much so he joined the Vero program and Trademarked his own sellers name and claims to have 28 Trademarks of Ready Kilowatt. He's just an Successful Ebay Artwork Seller plucking off any and all Competition.
Maybe he trademarked his own Art, IDK but he's Definitely not the CR Owner.
albertabrightalberta
·9 months ago@nh_sales_lv
Are you sure the person who reported the infringement isn't the owner of the original image?
Just because YOU ALTERED the original image doesn't make it yours to use.
BELOW: Your altered image is on the left. The original image is on the right:
My suggestion would be to take YOUR OWN picture(s) of the sticker you have in your possession.
stainlessenginecovers
·9 months agoI don't understand this story:
If this 'guy' is NOT the CR owner, then he cannot join VERO to do a take down in the first place.
He can 'report' all he wants' but ONLY a VERO takedown by a VERO member can tell ebay to do a takedown.
nh_sales_lv
OP9 months agoExactly, He is not the Rights Owner. Ebay should Eliminate him. How did he join VERO !!!
luckythewinner
·9 months agoFirst:
You have no idea who Excel Energy has licensed the Reddy Kilowatt character to. They could have licensed it to thousands of people for all you know.
Second:
You have no idea who Excel Energy (or any of its licensees) has asked - or hired - to police eBay on their behalf. For instance, I am a VERO member, and I police the intellectual property rights of four different music artists on eBay. But there is no way you would ever know that they had asked me to do so.
Third:
If Excel Energy's intellectual property rights are being violated, then it is Excel Energy's business to decide what to do about it. eBay is not going to investigate this alleged problem just because you claim they should. If you want to be a Good Samaritan, you should notify Excel Energy - because they are the only ones who can do anything about it.

·9 months agoWell if it is about the kids then luckily those stickers are available in 3 packs for $1.63 shipped on Amazon for parents to purchase. And in giant rolls directly from China and on literally every other wide marketplace on the internet except for ebay.
Someone is obviously actively keeping these off ebay. You could not be the first person to ever think of selling these stickers on ebay. One of the current Amazon listings for them has reviews going back to 2022, so they have been available at least that long.
It also doesn't even appear that you have ever sold any of these. Looks like you bought the 10 piece listing from Amazon, why not just return them, get your $6 back and move on with your life?
nh_sales_lv
OP9 months agoI was selling 10 for 10 bucks but it's not important, I will hand them out to Tesla Trainees.
nh_sales_lv
OP9 months agoI'm not pursuing this as Sparky could have mental problems. He's definitely not Xcel Energy. Just an Artist with an Affliction. I get it + I sell Auto Parts and this isn't my Territory but it sure was Creepy.
luckythewinner
·9 months agoI just want kids to live a long and prosperous life
LOL we're not fools. You want to sell things on eBay.
Who am i Infringing on
Probably Xcel Energy, who appears to own the copyright to Reddy Kilowatt. But the VERO takedown notice will tell you exactly who and how to contact them.
nh_sales_lv
OP9 months agoI already told you it wasn't Xcel Energy. I told you who the Perp is. The Perp is the Infringer with 28 Trademarked Images of his own Infringements of Ready Kilowatt.

·9 months agoHow do you know that this 'guy' doesn't have a CR agreement with the CR owner?
I can have a GM agreement and then sell my items with various emblems (Impala, Camaro, Corvette etc.) for a cost of $3500 a year and a percentage of each item.
grann-4629
·9 months agoRight. Just try buying anything with the NHL logo on it. Bought the grandson a jersey this year ... $329.00!

OP9 months ago.............
nh_sales_lv
OP9 months agoSo this Guy that reported my listing sells signs of Reddy Kilowatt for BIG MONEY. He's an Ebay Seller
onefootflipper
·9 months agoLook at it this way. You are breaking the rules, does it matter why or how you got caught? Do you think this is something you can win or be right about in some way?
You are risking your real actual account that sells real stuff over a bootleg novelty sticker (or patch or whatever it is). It doesn't matter if others are getting away with it.
Here is what happens with that stuff. The little guys get their accounts ruined and get lifetime bans.
The big really criminal bootleg organizations hide behind a maze of LLCs if they are even based in America in the first place. They will have multiple accounts under different LLCs, likely even shipping from different places and when one goes down it just all transfers to another. Now sometimes the people at the top of these organizations do end up going to prison in the end. It is still crime after all.
You have a no win situation with this. There is no way the real rights holder to that character gave you the right to sell that image, more likely the person who created the image with the character they didn't own was the one who said you could sell it, which is not the same thing.
nh_sales_lv
OP9 months agoI'm not planning to Relist my Item but I it is Interesting that it's another Seller who is the Actual Infringer making the Complaints. The Trademark Owner is Xcel Energy Inc. which this Sign maker has nothing to do with.
The VERO List needs to be Examined by EBAY . If I were a betting man I would bet that most of the Vero Complaintants are just other Ebay Sellers trying to knock out any and all Competition.
onefootflipper
·9 months agoHow do you know who is making the complaints?
If I had a huge account selling similar items someone like you who literally only had one item competing against me would not be on my radar in the slightest.
nh_sales_lv
OP9 months agonh_sales_lv
OP9 months agoTo Top it off he has a Trademark in his business name and read his fine print. He believes he makes authorized signs and that he's the only Seller. He's a Ready Loon

·9 months agoThey do have their stooges out looking don't they.
nh_sales_lv
OP9 months agoWhat if the Trademark Owner has Authorized me to sell these like he has. Where do I submit my complaint
eoma689485
·9 months agoI doubt that the owner of Reddy Kilowatt would appreciate a depiction of their trademark holding a knife to a young child - so I kind of doubt that the owner will give you permission.
But, hey feel free to try, contact the Vero member who canceled your listing, the information should be in the email you received from eBay
nh_sales_lv
OP9 months agoSo it turns out the guy who reported me is not the Current Trademark Owner. He has an Ebay Store and Infringes on Trademarks all the Time it seems.
stainlessenginecovers
·9 months agoThen that owner needs to discuss this with the people he hired to take down (his VERO reps) those that are using his copyright.
albertabrightalberta
·9 months agoIf the trademark owner gave you permission to use his picture, I wonder why he'd report your listing.
However since you claim to have permission, you need to contact the rights owner at the email address listed on the takedown email. Send them whatever documentation you have that states that you have permission to use their images.
broto_64
·9 months agoYou need to contact the VERO rights owner, I doubt they will authorize the sale but even if they do that doesn't really protect you from another automated takedown (because even if the VERO rights owner and Ebay tell you that it's ok - the takedown is done by bots and they won't care who said what).
That said, yes VERO absolutely gets abused and even in cases where the rights owner is correct it still feels like the BIG BAD CORPORATION is slapping you for reselling your very own product that you purchased from them (which is a violation of your rights as a consumer after purchase). You are not wrong, however it is your selling account that is at risk here so what can you do?
I personally suggest adjusting your selling tactics so as to avoid triggering the Verobot.
Fighting a corporation (and in this case it's ebay AND the rights owner) rarely turns out well. You'll just expend all sorts of effort and time and maybe you win (but probably not but even if you do win the end result is not likely to be as intended)...
nh_sales_lv
OP9 months agoBUT IS THAT REALLY READY KILOWATT AND NOT HIS TWIN BROTHER GRADY KILOWATT FROM SANFORD AND SON . DO YOU SEE WHERE I'M GOING
jonathanbrightlight
·9 months ago@nh_sales_lv
If you didn’t create an image, and you aren’t 100% sure that it’s in the public domain, you shouldn’t reproduce it on products.
When you say “Another VeRO Takedownâ€, how often is this happening? I seriously doubt you can afford to accumulate a bunch of takedowns. eBay may just decide you’re a risk.
nh_sales_lv
OP9 months agoHad no Idea Ready Kilowatt is on his 11th Different Trademark Owner
nh_sales_lv
OP9 months agoeoma689485
·9 months agoReally? you must be a lot younger than me, that's Reddy Kilowatt - and more than likely it is copyrighted and trademarked - Electric Companies have been using him for years, since 1926
nh_sales_lv
OP9 months agoA Reddy Kilowatt lamp was discovered in an abandoned storage locker in 2012 by Barry Weiss. Can you believe that lol
grann-4629
·9 months agoIt was originally intended to promote electrical safety, and electrical safety is still a problem today, even more so with the advent of Lithium batteries.
Copyright or not, the message is the same ... the owners of the copyright should be pleased that it is still getting out.
jonathanbrightlight
·9 months agoWhether you or anyone else thinks they should be happy about it, the fact of the matter is that they hold the copyright, and they or whoever they authorize to help them enforce that have the right to demand that no one else sell unauthorized copies. That is how copyright works.
grann-4629
·9 months agoYep ... no argument there about copyrights. I've been around the block a few times over this issue.
Nobody owns the copyright on any safety message, and using a well-known character to promote it shouldn't (I know it is!) be a violation either. Without Smokey's constant nagging we would probably have more forest fires ... I hope they don't remove the Bear's message due to a copyright.
And let's not forget "I've fallen and I can't get up". We're not even allowed to say that anymore. (oh oh, here come the lawyers)
Only saying the safety message is good, and no matter how it gets out there, it is something that people need to be consistently reminded of. it's a concept and not something you can put in a box or hold in your hand.
After spending more than 40 years in the life safety field, anything that anyone does to promote it is my friend.
