Account Erroneously Restricted Due to eBay Misclassification of a Medical Device - No Recourse
Summary: The discussion centers on positivevibration575 facing issues with their eBay account being mistakenly restricted due to the misclassification of a medical device. positivevibration575 expresses frustration over not having any recourse to resolve the situation. Various participants, including luckythewinner, meme6253, and soh.maryl, engage in the thread, although their specific contributions are not detailed. Others, such as tobaccocardyahoo and jonathanbrightlight, also engage with positivevibration575, possibly offering support or suggestions. The conversation shows the challenges individuals face when dealing with platform misclassifications and lack of support.
Account restrictions (10 days) for erroneously flagged medical device listings are now commonplace. The random nature of these violations most often leads to completing the 10 day restriction only to be immediately erroneously violated within hours of reinstatement. This cannot possibly continue if eBay expects to do business with medical device sellers.
Zero legitimate recourse available, as appeals system is seemingly automated with egregious flaws.
Unfortunately, after 9 years selling with eBay, we are losing all confidence in customer service and base level seller protections.
Considering the prevalence of identical seller input, why is eBay not working to rectify these issues?

That is NOT typical, if you removed everything that they didn't even remove that would ALSO violate.
You cannot sell many 'medical devices' without being pre-approved. Some 'other' items cannot be sold at all since it requires a prescription.

OP4 months agoThank you for your opinion. This is painfully “typical”, and the reason for our request for insight.

·4 months agoEbay doesn't want you selling this item yet you are still trying to. If after 9 years you think that's a smart decision, perhaps ebay is not the problem here. Maybe try selling your medical devices on FBM or CL.

·4 months agoDo you wonder if that's because the OP realized that maybe the error wasn't due to eBay or to AI?

OP4 months agoSympathy? Ignorance? We were hoping to gain insight from sellers with a base level of human intelligence regarding a general topic.

·4 months agoThe sellers who wanted to provide insight asked several times what the specific items were, and you have made four consecutive posts afterward and refused to divulge that information.
I'm not sure why you are so reluctant to do so.

OP4 months agoThere are many listings. We were hoping to discuss the general issue here and gain insight of worth. Thoughts and commentary that are effective and worthy of time and consideration.
We will now happily fade away.

·4 months agoOften, seller behavior after the initial finding of this violation impacts future actions when the violation is repeated.
This may not be an issue for sellers who react to the first violation notice by ceasing to attempt to list items which are found to be in violation.
Sellers who attempt to change the wording of the listing to avoid the apparent violation are labeled as serial offenders and the findings of violation are more frequent, and the penalties, include restriction, are more punishing.
This could be far more serious for you than for some of your competitors.

OP4 months agoAfter first violation, we paid for outside legal consultant to cross reference all pertinent sources and immediately removed each listing associated with even the potential of violation. We paid this consultant $3,500.
We are confident in our ability to understand the policies. Do you have any recommendations of worth?

·4 months agoNot sure eBay identifies this as an issue and that's why they aren't working to rectify it.
If you'd like to share with us what the device was, we might comment further.

·4 months agoI assume you came here just to vent your frustration, There is really nothing any one here can do for you with this situation, If we knew what type of medical device & what classification you gave & what Ebay classifies it as someone might be able to figure something out for you, But no one can change any restriction., Good Luck to you.
