Whos used the legal affidavit for fraudulent returns
Had an item returned that was not the same one, in fact in the return photos the buyer sent via ebay its not the same thing. When I asked them about it they never responded. Item in question was almost $2000
One time years ago I used the legal affidavit to not have to pay a return. I called yesterday and the non helpful foreign call center people told me I can only use it once in my lifetime as a courtesy. I haven't been able to find that in the TOS.
The reps told me to refund half or open a case and it will default to the buyer. Anybody with a better understanding of the affidavit or how i can talk to a north American representative

OP5 months agoBack when you could talk to california based reps one helped me with the affidavit. Saved me 1500. Yes I can refund half but I know how thats going to play out, a credit card dispute.
I've been selling since 2003 and watched the steady decline of the platform in regards to seller protections and customer service. Its disheartening to say the least.

Trust me, I get that. But on the flip side what we see here in the same space is an increase in Seller fraud and yes, for high priced items, not just run of the mill items. It can be via the False tracking number scam and other scams criminal sellers have gotten very good at.
The irony of both situations (Seller & Buyer fraud) is that third parties not involved with the physical transaction wind up enforcing policies and making decisions on fraudulent transactions. We've had a few of those over the years on our accounts, it is part of doing business and is not limited to eBay.

For myself I never heard of the affidavit for avoiding payment on a return. However, I do know that one important thing Sellers need to do is use the Report Buyer link on the sold item before they issue a refund.
Next of course is taking advantage of your Seller protections and the phone rep had part of that answer correct. You can withhold the original shipping the Buyer paid (unless you had the listing set for Free Shipping) and up to 50% of the item price if the item's condition changed of they shipped you something other than what you sold them, etc: Seller protections | eBay
That helps cut your loss and the remaining refunded amount will be a tax deduction at the end of the year.
As to speaking to a north American rep, good luck but here is what we have share with other members:
