Who should win this case? Buyer or seller?
My sister ordered a high value item, not sure about the exact price, but around $1000.
She had returned the item via her own shipping method via the post office.
Now the seller who she returned the item to says he received a box with a rock inside instead of the order item which was a phone.
He even sent pictures.
My sister swears she sent the phone back, but since she used her own shipping service and label, is it her fault the box came with a rock inside?

OP3 years agoShe did get ebay involved, will let u guys know how it goes.
The thing is that the seller requested she send the package on her own terms and that she pays for it.

·3 years agoIt does for buyer remorse if the seller isn't fulfilling their return policy.
Say their listing says 30 days buyer pays return shipping. If the seller doesn't accept the return then it's false advertisement, and gets handled like an INAD.

What seems critical here is whether your sister stepped outside of the buyer protection scheme.
If that is the case then there's probably little to be done.
That said...
Did your sister open a return on ebay?
If so, she should be able to input the tracking number into the case, once that is done if the seller refuses to cooperate AND the tracking shows delivery she can escalate the case and ebay will rule in her favor.
Unfortunately if she did not open a return at all then she basically refused receipt by shipping it back, but if there's a return case open then there is some hope she may be able to salvage the situation in her favor.
It all boils down to how exactly things transpired.

·3 years agoYou know what you sent back @mark-2041205 so karma will back you up. And if the box was rifled, such a seller would have claimed that. Now completely stop talking to the seller. Completely.
Instead, file a CREDIT NOT PROCESSED chargeback with your card issuer and provide your already-returned tracking number to get your full refund.
Why Would a Customer File a Chargeback With Reason Code “Credit Not Processed?â€
“Credit Not Processed†chargebacks are filed by customers who have returned their purchase but did not receive a refund from the merchant.
Or before doing that, if you paid with PayPal and the return was because it was defective or not as described, start another return request here, upload photos and cite the reason. When told to pay for return shipping yourself, upload the already-returned tracking number to get your refund.

·3 years agoWhy not? The seller could be lying and said she received a rock because they don't want to refund. It doesn't matter if the seller received a rock back or an empty package, if the refund was handled through eBay the seller would be forced to refund the buyer.

If the buyer did it by the numbers it was an easy refund...but they didn't.
They opted themselves out of the MBG. No refund is required unless the buyer can prove the seller got the item back in the same condition and they CANNOT.
Unless this seller tips their hand no one can prove they are lying...just like when a buyer lies. You want MBG protection...use it.
Buyers don't get to just get to make up their own rules and do whatever they feel like and get all their money back.

It's a changed mind remorse return.
Despite reshipped via a freight forwarder
- the buyer can start a remorse return request
- but the option to ask eBay to step in will never appear.
Seller agreed to the return and
- "Her and the seller agreed that she should send the item back on her own cost"
- because it's a remorse return.
So everything according to the rules. Responders don't get to just get to make up their own rules.

When the buyer opted themselves out of the MBG it all ended there.
You don't get to make up your own MBG in here.
Buyer shipped it back on their own. They are the one responsible, period.
Ebay will probably step in and refund them anyway as a courtesy.
You need to go brush up on the MBG before it bites you like it did this buyer.

·3 years agoThis is your second posting today. Although it is different it is the same subject matter. What if I return something am I covered? From freight forwarding shipping. You show a somewhat new account here from Croatia which is the same account on the other posting just inquiring "what if".
Don't they have phones in Croatia that are available for $1000.?

·3 years agoWhatever a sell phone costs in the USA, it's at least 3 to 5 times MORE in foreign countries. We have family in Spain and in Argentina and whenever they want something, we buy it for them. The savings is alot.. Americans really have no clue how blessed they are to live in the USA.

·3 years agoIt's not about who SHOULD win this case but more about following the correct procedures for any returns. This platform offers a money back guarantee so had your sister followed the correct procedures by opening a return case and receiving a return label which would be tracked by the system on here, she would auto win most likely. From what you've written it sounds like she did not open a case but shipped on her own, leaving the seller the opportunity to make their claims. Had she used the eBay supplied return label, once the tracking showed it was delivered back to the seller the case would close in her favor. Seller could claim a rock all they want; the system would close it based on the tracking of the eBay supplied label. The return system is all automated so always best to follow the procedures to ensure the policy will apply. Best of luck to your sister....

Dirty trick, this seller obviously didn't encourage your sister to open a return, did he?
No return, no refund, pretty much.
Still pretty dirty the seller would just up and keep a thousand dollar return.
The seller has to know what they did here, the seller can play dumb and maybe the seller is just as naive as the buyer but even then the seller has to know that keeping the thousand and the item too isn't right.
