If you are referring to that "sideloaded No Fee Android box Movies,TV shows,both new & old,also live sports&TV" which you had previously sold, you will have a difficult time finding an attorney to recover an item worth only $45.00.
Your attorney fees alone will probably be over 3 times that amount.
Never send a refund on a return until you receive your item back.

·6 months agoHow the ebay return process works:
1. Buyer opens a return request
2. Seller accepts the return or ebay automatically accepts the return
3. Buyer sends the item back (the seller may have to provide a return shipping label)
4. Once the Seller has received the item back, they issue the refund.
Somewhere along the way you didn't follow these steps. Either the buyer opened a return and you didn't respond, so ebay automatically refunded them. Or you sent a refund before the buyer shipped the item back to you.
Instead of calling an attorney, take a little time to read through the ebay policies, and if you encounter another situation that you are unfamiliar with, come to these message boards to ask questions and get some help.

·6 months agoI'm not really sure what you are talking about but it sounds like you sold an item and the buyer wanted to return it for a refund. If this is what happened, and you gave him a refund before he returned the item, you are out both the item and the money. If you give a refund before the item is back in your hands, there is no incentive for the buyer to return the item so you are out both the item and the money.
Contacting an attorney will do you no good; it's a waste of time as the buyer did nothing wrong and eBay did nothing wrong.
The procedure for returns is that the buyer files a "not as described" claim and you furnish him with a return label to return the item to you. When you receive the item back, you issue a refund to the buyer. If it happens that the item isn't worth the postage to have the item returned to you, you can just issue a refund and let the buyer keep the item.
BTW, I see you are selling a headlight cleaning service with Ground Advantag shipping at $10.21. How can you ship a cleaning service? Would someone pay $75.00 to have this done when a bottle of headlight cleaner is sold at many stores for less than $10.00? I guess people some would.

·6 months agoI've said this before, but you can never lose both the item and the money. You can only lose one or the other, as you were never entitled to both in a transaction.

·6 months agoSo, a long time ago, when I was new in the game ( I no longer sell), when I stupidly ignored an NAD case and let it expire (truthfully, a precipitous time in my life), that buyer was refunded by eBay and that buyer kept the item, you're saying that didn't happen?

·6 months agoI think that @tools* was being semantic, though I'm not saying that in a negative way.
You were entitled to either receive the proceeds from that sale, or receive the item back, and so while you ended up with neither, you were technically only entitled to one of those. If you had received either back, you would have been made whole (or as close as possible given the situation).
It's a distinction that mostly only has relevance to the fact that if a seller receives back an item, they should not feel entitled to keep the money and the item, and the same applies in reverse in situations like you described. The details about what actually happens depends on the actions of the buyer and seller, primarily, as you so wonderfully explain to many posters here. 😊
