Seller sold me fraudulent item and I didnt realize until 34 day mark
Hi everyone,
A seller sold me what I have come to learn is a clearly fake version of what the seller had listed. It is a very good knock off, but it is clearly a counterfeit fake. I just requested the return, but I am at the 34 day mark because I did not have a chance to check the item until now due to family travel. Will ebay help me out given I have not heard back from the seller?

·1 year agoIf you paid by credit card, contact your card company. eBay sticks to the 30 days from delivery policy.

·1 year agoHi @krisdoer-99
Thirty days is the customary time period that local stores and online selling venues give buyers to return items.
After that, we need to go through our payment source for a refund. I recommend you contact the Fraud Department of your credit card company. You should have no trouble getting refunded.

·1 year ago'take it up with my bank'...you made a purchase.
Was it a price too good to be true?
What was it?
Maybe because it was counterfeit it was very cheap.
'family travel'...so didn't do the 30 day return...
We have excuses for everything in life these days.

OP1 year agoThanks for the not helpful reply. Yes, it was a family tragedy that I needed to handle. Im sorry you can't understand that some things require more time than a few weeks. Price was not too good to be true and it was sold as a legitimate product. Again, you are defending a crime here.
Best of luck to you in the future and I hope you are never scammed.

·1 year agoYou really have no idea just how much eBay actually favors BUYERS. Do you realize that you could buy a genuine item and get a return (within 30 days) just by claiming it's fake? -That's literally all a buyer has to do, CLAIM an item is "not as described" and eBay AUTOMATICALLY approves the return..
So picture this. You're a seller and list a genuine sold 18-karat gold ring on eBay, when gold is at a high spot price. Then 29 days later your buyer could claim it's fake, return it and get a full refund ... even if the spot price of gold had plummeted during that time. So just imagine how much of a drop it could take in 60 or 90 days.

·1 year agoAs already stated, eBay is no longer an option for you 30 days have past right or wrong
It is your responsibility to take action prior to eBay's 30-day deadline
you still have other options
The best to you whatever you decide

You might also report the seller to eBay for selling counterfeits.

·1 year agoYou had 30 days from receipt to verify authenticity of the item. You're too late to file a claim through ebay's money back guarantee.
Ebay won't help you.

OP1 year agoYes, but this person disguised this product very well. I can still take it up with my bank of course, but ebay won't step in to help out for what is a completely fraudulent product that took some time to realize that? Multiple people looked at it first who were inexperienced so clearly the seller was trying to fool people. Ebay has no recourse for that? Sounds like a terrible policy.

Again, you had 30 days from receipt of the item to check it out for authenticity.
If you didn't do your own due diligence in that time, ebay cannot help you.

·1 year agoHow many days would you consider "not terrible"? Whatever the number, there would be people who waited that long to verify their items and complaining that it wasn't enough time.

OP1 year agoFor something that is completely fraudulent and was meant to deceive? At least 60 days, but would be as much as 90. I get the idea that people need to check the products, but things happen in life and the notion that 30 days is enough time for all things is just not true. The fact that ebay is rife with fraudulent products also makes this an issue. The fact that my credit card company gives a longer window than ebay shows ebay program is inadequate. It is clear the community here is more on the side of sellers though, which is not a surprise, and is highly defensive of straight up criminal activity.

·1 year agoNone of that is true. If you found out in 95 days and there was a 90 day policy, you would just say 'it should be 6 months' or 'it should be unlimited'. You would NEVER be satisfied. Even Walmart has a window (91 days and too bad/so sad no matter WHAT the issue is).
Another reason there is a 'too long' (30 days) timeline is because YOU could've purchased a 'fake' at another website, or the swap meet; and then do a 'return' and send the seller back the 'fake' while keeping the 'real' one. Happens ALL the time.
So, the 'criminal activity' goes both ways.
30 days is 20 days too long. You should get 10 days to 'check out' something that
a.) costs enough to go through this
b.) can be faked and is typically HEAVILY faked on 100's of websites from 1000's of sellers.
If life is 'too busy' to spend the time to 'check it out' then simply don't buy it.

·1 year ago“Clearly on the side of sellersâ€? Actually, some of the responders here are buyers only. Why would they side with sellers? They wouldn’t, and don’t . . . We all simply know eBay policy. Plus many of us who sell have sold on multiple other sites, too. We know what standard practice is on various matters. This is nothing more than knowing how things work, both with these matters here and similar issues on other sites.
