Seller sold Camera as "mint" but was faulty. Will not except return.
I bought a GFX 100S II in mint condition and it arrived on 5/13. it was in excellent condition, It worked great, and fell in love with the camera. HOWEVER, a week into testing and using the camera, the 2nd LCD monitor suddenly stopped working. it’s supposed to be on all the time but it’s not showing any information. I tried troubleshooting it but with no success. The light works when I press the button so that’s not the issue. I even contacted fujifilm for help and they said it could be a faulty wire on the top plate and will need to be serviced.
I reached out to the seller to inform them that I was having issues with the camera. They said they tested it and it worked fine when it was shipped. Whatever happened since I've had it is no longer their problem. I asked the seller if they could provide the receipt since most fujifilm is under warranty but will need proof of purchase. They said they bought it from their friend and would ask for it. It's been a week now and they are saying they don't need to provide the receipt nor will they accept the return since it happened since I've had it. They stopped replying to my messages.
I was planning to use it for a trip but couldn't because it was faulty and did not want to use it since I intend to return to the seller. While I was on my trip I removed the battery and left it in my camera bag. I tried testing it out again when I returned and placed the battery back in and now it's flashing off and on a few times but remained off. I truly believe this seller sold a faulty camera in the guise of it being in mint condition. I’ve already started the ball rolling with eBay and the seller is accusing me of damaging it myself. All i asked the seller for was the receipt so i could possibly use the warranty to get it repaired. They said they bought it from their friend and is waiting for them to reply but is no longer responding. Posted about the issue on an GFX Facebook page and someone mentioned It could be a stolen camera sold on eBay. Really worried eBay will side with the seller, and i'm stuck with a faulty camera but will need costly repairs and could be potentially stolen.
Will eBay help me with this matter or side with the seller?

If you will go back and read what I said, I said I do not know how eBay will handle this so I do not know that eBay will not charge him back. I have only heard of this so I'm not 100% sure that it is even true. You have your mind set that you do not think you will get your money back but if you returned the camera and tracking shows the seller got it back, you should get your refund. That's what eBay's Money Back Guarantee is for.

OP1 year agoApologies, I read it wrong and just frustrated with this situation. I appreciate the clarification. I am just preparing myself for the worse case scenario. I do hope the refund is in full and I can be done with this drama. Moving forward, only buying from sellers with more selling history and probably not buying another camera from eBay again. I went into a deep dive regarding this topic and there has been a lot of horror stories like mine.

I agree with @mtgraves7984. eBay has no way of knowing who is telling the truth. As we said, photos are meaningless because photos can be doctored. You should get your refund because of eBay's Money Back Guarantee. But because this has ended up being a he said-she said thing, they may not charge it back to the seller, giving him a one-time free pass. I don't know this will happen this way but I know eBay sometimes does this.

OP1 year agoSo the seller will get their money back and get to keep the camera while I am shafted with no money or camera? Really hope that’s not the case. Moving forward, taking Fujifilm’s advice and not buying anything from eBay any more. Apparently this is an on going issue for them where sellers off load their faulty camera not to get it repaired. Causing the buyer to pay for the repairs. Luckily I was able to return it but may lose my money? Ugh. The seller offered a partial refund but not enough to cover the repairs so I opted for a return.

You are covered under eBay's Money Back Guarantee. It Does Not matter whether the seller thinks that your reasoning is valid or not. He still has to issue a full refund. And if he has only sold two items, as mentioned in an above thread, he probably is not in a position to try to withhold part of the refund. BTW, eBay does not accept photos as evidence in any claim so all those photos would be meaningless to eBay.

OP1 year agoI just got an email that the seller opened a case against me. Saying that I returned the item broken. Luckily I took photos prior to shipping cuz I had a gut feeling this would happen. Gotta wait for eBay to decide the fate of the situation. I have never returned anything to eBay and this is my first situation where the camera arrived ok but failed within days. Not sure how it’ll go. This is basically turning me against eBay and may stop buying from the site. I truly believe the seller either didn’t packaged the item correctly (camera was well packaged but moved around during shipment) or seller bought the camera from eBay and was having issues and sold it off as mint so they didn’t have to pay for the repairs. I don’t know how it’ll end up but if it goes against me. I may ask PayPal to step in for a charge back.

OP1 year agoGood news! The seller has decided to take the return without eBay stepping in. The seller has provided the return label via FEDEX. I took photos of the camera as proof of its current condition and the serial number. I sent all the photos i took to the seller as well. I sent a pic of their serial number from the listing and a photo of the serial number I’m sending, they match. Also sent pictures of my packaging.




















I will be shipping it out today.

OP1 year agoI filed an INAD with eBay (on Sunday) and tomorrow (Friday) is the day I can have eBay step in. I'm worried the seller will claim some other thing saying im at fault and eBay will Side with them. I truly was trying to work with the seller to get it fixed but refuses to help and accuse me of breaking the camera. Ive purchased cameras from eBay before and never had an issue. This may be my last time purchasing a camera or any camera gear from eBay. I don't want to deal with the hassle and drama ever again.

·1 year agoIt's nice that you tried to work with the seller but clearly, the seller wasn't willing to work with you. (And having left feedback for the seller doesn't reduce or eliminate your option to file a claim.)
Ebay won't side with the seller in a NAD case. The best the seller can hope for in an appeal would be a courtesy credit after you get your refund. But for a $4K item, I doubt ebay will eat that!

But fortunately, you did buy it on May 8 so your receipt of it is within 30 days.
Make sure there's signature confirmation on the return shipment since the price is $750+.
BTW, the seller's no return policy doesn't fly with a NAD item.

·1 year agoIf you're within 30 days of the delivery date, you can go to the order and click to "return this item," choosing that it's defective or on of the appropriate "not as described" reasons.
The seller will have to either pay for and supply the return shipping label if they want it back or issue a refund if they want to let you keep it.

OP1 year agothe seller doesn't want to accept the return because they're saying I broke it. if it was truly in mint condition, I would not be having these issues. Waiting to get eBay involved so I can return and get a refund, hopefully.

The MBG says you get the item in the condition as stated in the description, which you did.
When buying used items on Ebay, there's no guarantee how long they'll work.

OP1 year agoso you're telling me that I have no case in the matter? it worked for a week and then it stopped working? so my fault? It worked as expected but then suddenly the LCD screen stopped working. if it truly was in mint condition (it wasn't, a few nicks all over but overlooked it cuz it "worked" then 2nd lcd screen failed and stopped working) this shouldn't have happened. I have videos of the LCD flickering off and on. Seller could have posted pics of the camera when it flickered back on and sold it off as mint. I was more than happy to resolve it by getting the receipt to get the warranty and use to repair the camera but wouldn't provide that. at this point, returning is the only option but not sure how it'll turn out with Ebay making the choice.

·1 year agoI was just saying, buying used items, especially expensive ones is a little risky, because you never know how long the item is going to last.
As long as you filed an INAD, you shouldn't have any problems, unless the seller tries to fight it or claim you damaged it.
Come back and let us know how it goes.
Most of the time, it goes pretty smooth.

If the item is not as described you can stop trying to work things out with the Seller. You go to the item in your Purchase history and file a return using the reason "does not match pictures or description".
eBay will issue you a return shipping label, send it back and once the Seller has it they have 2 days to refund you. Failing that you go back to the claim and ask eBay to step in and force the refund.
Do that within 30 days of receipt: eBay Money Back Guarantee policy

There isn't a chance in the world of your losing the claim with eBay. Really. The Money Back Guarantee is that clear-cut. 😊
But YOU can screw it up by whatever you do if you get the receipt you keep asking the seller for. Manufacturers will not honor any warranty for an item purchased on eBay. Even if the seller were a licensed dealer for the camera... you would have to go through the seller to make use of the warranty. The manufacturer will not deal with you directly ... with or without proof of sale. They only will deal with the original buyer.

I could have just bought new if that was going to be the case. I really just want to return it and be over this drama. Seller refuses to accept the return and if Ebay sides with them then im stuck and lose even more money.

Just wanted to add that I think I located the listing for the camera you purchased. I don't know if you noticed, but the seller appears to have sold ONLY TWO items on eBay ... even though they've made about 2000 purchases. Their lack of selling experience on eBay is surely one of the reasons you're having so much trouble dealing with them.

OP1 year agoI sent the seller one last message today. the seller will most likely not reply. I truly just wanted the receipt to get it repaired but returning it may be my only option.

·1 year agoIf the seller does not issue a return label and tries to fight the case, most likely you will not be required to return it at all, and will simply receive a full refund and get to keep the camera. While I wouldn't suggest you should try to keep both, the fact that this seller is not making things right will cause that to be the result.

OP1 year agoI would be more than happy to return it and just get my money back. If I get my money back I would be more than happy to return the camera on the sellers dime. I am not spending any more money on this seller.

·1 year agoALL eBay buyers, as well as ALL eBay sellers, owe it to themselves to get acquainted with eBay's Money Back Guarantee for buyers if/when a transaction goes wrong.
There is no requirement that you engage in a dialogue with the seller. All you need to do is open an ITEM NOT AS DESCRIBED CASE. Your seller will have 3 days to respond. If that doesn't happen, you need to return to your case and ask eBay to step in. They will refund you from the seller's funds and tell you to keep the camera.
Now, when that's all over with, please go to the MBG and read it. Hope that you'll never have the occasion to use it again, but if you should, you need to be equipped with the knowledge to handle the situation appropriately. BTW, eBay gives you 30 days after receipt of the defective item to open a case.
