Seller didn't ship everything shown in listing. Trying to refuse return.
I bought a pallet fork attachment for my tractor and only received the fork bars and not the entire unit. The pictures and listing showed the entire unit, but the seller only shipped the bars and is claiming the listing was only for the bars. I submitted a return request, and the seller is insisting that I change the reason from "missing items" to "do not want" which would require me to pay to ship this 72 lb item back. I suspect they'll claim they are damaged and refuse the refund anyway. Should I just wait the 3 business days and see if eBay automatically forces the refund?

·8 months agoThat was a totally messed up listing, and all around confusing. Even the title was contradictory to what I know...I'm reading the title as an attachment and forks. Later in the description they said "dimensions: adjustable based on sliding fork slots" . If it was just the forks that would have fixed dimensions, to be adjustable it needs more parts, parts that included the fork slots.
Glad you got your money back. Sorry it was difficult to ship back, but one thing all buyers on line need to be able to do is make returns and that involves actually returning the item. So that is something you signed up for what you bought. Yet, still a pain.

OP8 months agoFollowing up. Seller did provide a return label and eBay refunded once tracking showed it was received. It was a pain to box back up, given the original box was destroyed. Plus having to make a trip into town to drop it off.

·8 months agoThe photos on the listing are difficult to justify in my mind. I agree that the text is vague. What is with all those totally unrelated pictures?

Absolutely!

·8 months ago'send 72 lb item back'....are you sure it's a 72 lb. item to return?
What you got back doesn't look like it weighs that much.
Something looks a little off here.

·8 months agoYou've never driven a Forklift, Huh?
Forks alone can weigh 30-40 pounds each easy. These are rated at 5000 lbs. 35 pounds each is nothing.
That whole unit Buyer THINKS they should have gotten. The frame/plate these Forks attach to, then the frame/plate attaches to the Forklift, complete unit, Frame/Plate and Forks, 400-500 Pounds minimum.
Nothing is off. Buyer got what the Seller was selling. The Forks. Pictures are misleading, but the Description Seller typed into the Listing clearly says what Seller is Selling.

Picture the OP put up, the Forks still in the Box, shows THE FORKS and THE HARDWARE attached to the Forks that are needed to be mounted on a "Multi Functional Plate". Nowhere does the Description say that the Plate, THE FRAME, is included with this sale. Picture of the Frame, the Plate in the listing itself, I am quite sure was added to show what these FORKS attached to.
Seller throwing all those Pictures up totally confused this Buyer. Buyer bought by pictures only. Buyer did not pay attention to what Seller "listed" in the Description. I'm still confused on HOW this Buyer thought they were BUYING that complete set up for $117. AND why nobody here is jumping on Buyer over that. I mean, same Members here trying to sooth over Buyer thinking Seller is 100% at fault, are the same Members who jumped all over the Guy who was here a few Months ago because he thought he was getting an $1800 Riding Mower for $299 from a Seller in China. Same applies here. Buyer thought they were getting a complete $2000, 500 pound Set Up (Plate/Frame, 2 sets of Forks, ALL mounting hardware) for $117, and only $72 to have it shipped to them. I'm so confused. I don't get it.

·8 months agoI see the guy's foot in the photo...do you?
And In the gym I go to...we have racks we put weights on...plus we have equipment where we use similar like items.
Those items in the photo are smaller than the foot...like those of a bed-frame(s) parts.
Doesn't matter what it is...it just doesn't look like 70 pounds.
I really didn't need a long drawn out story...

·8 months agoThem two pieces easily look like 72 pounds.

·8 months agoYeah, I see the Guys foot.
That attachment, that FORK, designed to lift 5000 Pounds. It's not a piece of painted aluminum.
You've never been around a Forklift a day in your life, have you? You've never struggled to move the Forks in and out on a Forklift that you have to adjust the Forks by hand to adjust them for different sizes of pallets, different widths of pallets, have you?
It's Obvious. Forks on Forklifts have some WEIGHT to them. You're thinking you could just squat down and carry BOTH of these Forks away easily. You possibly could do it, but it won't be easy. Guaranteed.

Buyer did not read Description in its entirety. Buyer bought from Pictures alone.
Rookie Mistake.
But, Seller is in the wrong also. That I agree with.

OP8 months agoAgreed. I have no intention of changing the reason and I politely told the seller again that it's either missing parts or that it's not as described in the listing. (No reason to get **bleep**y, assuming if eBay steps in they'll see those messages.) Their offer of a $30 partial on a useless $124 item is insulting.
I originally submitted this as not received, thinking the seller didn't ship a second package. That request was denied because the seller provided the tracking number for the bars. They're claiming eBay already sided with them on the "did not receive" claim, despite the return request still pending until Jan 22nd.
jonathanbrightlight
·8 months agoThe Item Not Received claim probably was closed in their favor. That's irrelevant, though, because it's separate from the return request. Just hold your ground, no need to talk to the seller anymore, and go back to the case as soon as the option to ask eBay to step in is available.

·8 months ago@lawson_chris,
Once you have started a return request, the reason cannot be changed. Don't close the return case or try to change it. Just wait about 4-5 days, and if the seller doesn't accept it, you will be able to "Ask eBay to step in and help" and they will make sure you get your refund. You may still have to return the item (at the seller's expense), or you may not.
The listing was deceptive, because the title said it was for the forks, but the pictures in both the picture gallery and the description showed a lot of more than just the forks.

Next time, take more care reading, and if there is anything ambiguous or not clear about the listing, find a better seller.
You can report the feedback the seller left for you, because it was a positive feedback with negative comments.
jonathanbrightlight
·8 months agoYou cannot and should not change the reason for the return. I did a little digging and I think I found the listing, and you're correct, it was misrepresented. If they do not provide a shipping label (at the seller's expense) within the timeframe in the return, ask eBay to step in.
Even if they do, they cannot just claim it was damaged and issue no refund. They might be able to withhold 50% of the refund, but if they do, just appeal that and eBay should issue the remaining refund.
lawson_chris
OP8 months agoYup, that's the listing. I can't see how a reasonable person would think that didn't include everything in the picture. The fork bars by themselves are useless, as I can't find anyone selling just the frame that these attach too. I hadn't noticed they left feedback yet (sellers can't leave negative feedback). I'll wait to respond to that.

·8 months agoAlso gotta play Devils Advocate here.
5000 pound Lift "Forks" only run $5-$6-$800 minimum at all the Industrial Suppliers out there. Grainger's minimum price for their cheap Chinese knock offs is $563.
What reasonable person that needs a set of these, has been shopping for a set of these, thinks they can get the full Attachment Set, Bracket, Cage, AND FORKS for only $117 plus shipping?? That's ridiculous.
Yes, Seller is totally in wrong here. Listing is very misleading. Seller has full inventory pictures in that listing, but it does clearly say WHAT you are getting for that $117.
Item Specifics
Package Includes
Buyer got what they paid for. Buyer got a $500 pair of Forks for $117.
Seller did sort of mislead Buyer with the way the Listing is set up, so YES, Seller is in the wrong. But Buyer here should have known better. Been smarter with this purchase by paying more attention to what the Listing actually covered. No Purchasing Manager, Shop Manager, Shop Foreman is going to be stupid enough to think they're going to get $2000 worth of Industrial Equipment (what the Seller shown in the listings, the complete set up) for only $117. Any EXPERIENCED person that has dealt with this type of Industrial Equipment would have looked twice, 3 times, 4 times, trying to figure out this Listing. That complete set up in the listing would made anyone with common sense look at that $117 price and go Hhmmmmm....What's up with this?
But, as Sellers, we've had issue with Buyers lacking common sense on ebay for years. Case in point here.
50/50 at fault. 50 on the Seller. 50 on the Buyer.
lawson_chris
OP8 months agoYou're way off base on the cost. Yes, the industrial setup is much more expensive, but you find these light duty fork quick-tach attachments intended for tractors on Amazon for $236-$299. I also had one seller using the same ad listing this at $169 confirm via message that it included the whole unit. So it wasn't unreasonable to assume the exact same listing, right down to the pictures, also included everything. (In hindsight this seller is listing under so many different names and changing their seller name frequently, so it might have even been the same seller).
My only mistake was assuming the listing was accurate. But yes, I should have messaged and double-checked.
hotwheelsbum
·8 months agoNo, your biggest mistake was assuming you were going to get a set of Forks, 2, AND that full frame, cage set up for only $117, and only $72 for shipping.
I mean, come on.
Enough said. I'll stop there before someone complains, whines again, saying I was rude, and getting another 7 day suspension over this idiocy.

·8 months agoDo NOT change the reason or cancel the return. I assume you filed an item not as described or missing parts case? Seller can try to refuse but almost always eBay sides with the buyer. Your seller is trying to avoid return costs. They may accept the return anyway. If they make eBay do it, they get dinged for poor customer service and have to pay the selling fees. Many sellers will try in hopes a buyer will back down. Don't.
