Seller committing FRAUD ?
Bought a new $41 phone case, it did not fit my phone. Seller said no returns in her ad. I contacted her and we agreed to a partial refund of $31 and I shipped item back to her. She acknowledged she got the case back and has it for sale on her site. She said she send refund over the weekend. She never did and Paypal and eBay have the full receipts and messages that she agreed to refund. Paypal denied and she never replied, never sent refund...what part of fraud does eBay and Paypal not get?...ridiculous!!!!

OP2 years agoQuick story. Seller stated no returns accepted in her listing. New phone case I ordered did not fit my model. My mistake for not reading properly but her ad was not clear but my mistake. I asked seller for a return, she said no. I replied i would be willing to ship back at my cost, and she would only need to refund me price of item. She agreed. I shipped back and tracking showed it was delivered. I messaged her, she said "okay I am going away for weekend, I will take care of it Sunday"...Sunday came and another Sunday and more. She has never replied or sent item back. Opened eBay case and PayPal. I left negative feedback. eBay denied my claim and removed my feedback. PayPal denied then they contacted me a few days ago said they would look back into it then the PayPal rep said the best way was to contact my credit card company.....so wrong all the way around...i have not contacted my credit card yet...so tired of it for a measly $31 total...i don't need the aggravation for $31. But item is still on her website, item #225924564945. I may contact credit card company but its just so wrong...you tell me if i am wrong!!...so now i am out just under $50 total...eBay sucks as i think they must no have real people looking at claims...how much more detailed do i need to be???

·2 years agoFirst off, TBH, I'm not sure why you say her listing wasn't clear. Pictures clearly show the box with "Samsung Galaxy S23 Ultra" and description states, "OtterBox - Defender Series Pro Hard Shell for Samsung Galaxy S23 Ultra."
IMO, that's pretty clear (in the seller's defense) but you do admit your error.
As for the return, had you opened a return request? You can still do that even if the item is appropriately described. In such a case, the seller does have the option of denying the return but you say she/he agreed to it.
So am I correct in assuming that you didn't open a request but did the transaction/return just through messages? That's the incorrect action.
Had you opened a remorse return request for "wrong size," the seller could have accepted and you would pay return shipping. Once tracking showed delivery, she could refund the $31 and if she failed to do so, you could ask ebay to step in.
I'm not sure how you'd fix that now.

·2 years agoFirst of all, it doesn't matter if the seller has a no returns policy. A Not As Described claim overrides this. Unfortunately that's where you went wrong. You should have opened a return instead of relying on the seller's promise to send you a refund. Now she has your money and she's reselling the case for an extra profit.
As for you doing a cc chargeback, that's your decision.

·2 years agoThe OP admitted that the return was a remorse return. Unlike the suggest you are making @css2001 , the OP was making an HONEST return request.
Suggesting to the OP to lie is wrong!

Yes, he did claim it was his mistake. But the point is that the OP shipped it back on his dime, the seller did agree to refund, but never did. The buyer trusted that the seller would keep their word. Sure, the seller doesn't have to refund, but then their word is meaningless.
And I did not suggest for the OP to lie. Nor do I think he is. I stated "As for you doing a chargeback, that's your DECISION." To clarify that I meant he has the option to either try to get his funds back, or just let it go. It's his money, and his right to do either one. Sounds like you believe that the buyer is lying.

·2 years agoMy point was (and what I said was) that the OP could have opened a return request for remorse too. Even if a seller has a no return policy, sellers have the option of accepting the return when buyers open a remorse (honest reason) request.
As I'd said in my post #4 , had the OP opened the request to return it through the order (rather than through messages), the seller wouldn't have been able to ignore the delivery of the returned item. Once the buyer's tracking showed delivery and if the seller didn't issue the refund, the buyer/OP could have requested that ebay step in and the refund would have been processed.

·2 years agoThe impression that I got from post 3 that they did open a return in ebay and Paypal. I'm assuming the case got denied on ebay because of the PP case. I don't know why the PP case was denied if they were able to show that the item was returned.
