Refund of the damaged item
I bought the item one month ago. It arrived damaged (with broken fingers). I paid a lot of money for it, plus transportation and customs fees. I informed the seller about it, who offered me another item free of charge. I refused because of high fees.
I asked to return my money. The seller insisted on returning the item, however I refused as it is connected with additional expenses and time. I asked the seller 50 % of the refund, wrote several messages but has been ignored!
I asked eBay to help me, but zero assistance!!!! I've bought 33 items on eBay and they didn't do anything to protect or help me! I am very disappointed. I got the damaged item and was unable to get my money back:(((((

While it may seem to be the ideal solution … buyers are NOT allowed to request partial refunds per current eBay policy.
It also violates eBay policy to request a refund while refusing to return the item.
I’m afraid you have only two options:
1. Keep the item.
2. Open an official ‘return request’ … preparing to return the item at the seller’s expense if asked to do so.

·10 months agoPer eBay's Money Back Guarantee, which ALL buyers as well as sellers need to read, you have 30 days after delivery to open an item not as described case with eBay. Please read the MBG to learn how this works.
The seller is not required to refund the buyer unless/until the buyer returns the item. These rules are pretty much set in stone. Sorry this happened to you, but, if you want a refund, you'll have to open the case. The seller sends you a prepaid return label, you return the item and are refunded. If the seller does not send you the label within 3 days, eBay will refund you and tell you to keep the item.
So: 1. Open the case as described, return the item and be refunded.
2. Hope it's still within 30 days,.
3. Rad the MBG. Hope this does not happen again, but learn how to handle it in case it does.

OP10 months agoThank you very much for your message. I want to clarify some details.
I explained the seller why I can't return the item. It costs me additional charges (a new box as it has been damaged while opening, transportation fees, etc).
I paid 220 $ for the item and asked the seller to refund 150$. She didn't reply.
Then I agreed on 100$ and sent her several messages, but I've been ignored!
I bought 33 items on eBay and there was one case like this: the doll arrived with both legs broken and I've been fully refunded and kept the doll (the same explanation regarding additional expenses).
Who can help me in this case??

·10 months agoHow damaged is the box? If you can, repack the item however the seller had sent it and include all the original packaging materials, then tape the damaged parts of the box back together. If it's totally thrashed, ask a neighbor or family member if they can save the box for you next time they get an online order delivered.
As for transportation fees, you can go on USPS website and schedule a pick-up free of charge. Your regular carrier will retrieve the box when he comes to deliver your mail.

So can you explain why you believe the item can be returned "free of charge", assuming you mean without the OP or the seller paying for return shipping?

·10 months agoFree of charge as regards the aforementioned "transportation fees" to return the item. In other words, the OP wouldn't have to set aside gas money nor bus fare to get the box to the post office. Even if it were to go by UPS or FedEx, they have drop off locations that would likely allow for the task to be completed while running the usual errands. Return shipping would be paid by the seller in this instance, assuming the correct procedure is followed by OP.

As I guess there is no chance to get even part of the refund without returning the item.
I thought eBay would arrange even some part of the refund.
As I've mentioned, once I got the refund without returning the item. I'm requiring just part of the amount.

·10 months agoThere's a saying you'll see going around here sometimes: If it's good enough to keep, it's good enough to pay for. Fair dealings are important to and for both parties in any transaction, no? eBay has their system set up to try to keep things fair, that's all. Don't take it personally. Do try to remember there's another human being at the other end of this though. eBay may be a huge faceless company but your seller is probably not. All this stuff goes best when buyer and seller are both wanting to do right by each other.

if you filed a Not As Described and the seller wanted it returned, then the seller sends you a shipping label to return it.

·10 months agoWow, you gave negative feedback to the other seller who fully refunded you and let you keep the doll for free that was damaged in the mail? And now you want another seller to fully refund you and let you keep the doll for free? Hhhmmmm. This second seller is probably not looking forward to getting negative feedback from you and is not planning to reward you with a free doll for the negative feedback you are going to give her. Just a guess here though.
