refund for an order that was cancelled by eBay due to a suspension

I've ordered an item for 400 US Dollars and after the payment was made and the money transferred from my bank account, my ebay account was suspended.

Since my account was suspended, the order was cancelled by ebay and the seller was instructed to not ship the item.

I never got a detailed response as to why my account was suspended, and I never got the item or my money back.
The purchases section in my suspended account shows the item that I ordered in an Awaiting shipment status, but the item never arrived at the listed date, which is Oct 24 - Sat, Oct 28.
It has been 2 months since this happened and every time I've tried contacting an ebay agent they responded that they can't help with that since my account is suspended and just logged me out of the chat session.

400 USD is a considerable amount of money for me and I am considering contacting a lawyer if this continues.

Not a registered user....kinda means not a registered user.

I would check with your bank or credit card or whatever you used.

Sounds more like bank or credit card issue and not eBay. eBay doesn't keep money...but a bank or credit card will.

You have no options on ebay after 30 days. You would just be throwing money on a fire.

Since your suspended account still shows that your item is awaiting shipment @facix_69 you could have started an Item Not Received refund request on Sun, Oct 29 the day after the latest estimated delivery date. Both suspended buyer and seller accounts are still allowed to pursue item claims.

Now file an item not received dispute here within 180 days of payment, if that's how you paid and you'll have your refund within 5 days. Otherwise file a chargeback with your card issuer, to get your refund.

On either no drama needed, nor any mention of the suspended account -- you just didn't receive your item 2 months ago, and now you'd like a refund.

However the seller might

have to pay the entire refund while eBay keeps the final value fees
be fined $20 if they challenge and lose the case
get a nasty defect on their record

and eBay could suspend your account ... er, nevermind on that last part.
