Need help - Closed return case for defective Apple Pencil, no resolution from support
I purchased a brand new Apple Pencil from an eBay seller.
It arrived later than expected, and unfortunately the item is completely non functional. It does not turn on or charge at all. I initially suspected it might be an accessory issue, so I tested it with a different compatible adapter, but the issue remains.
I contacted the seller requesting a return and full refund, as the item is defective. Instead, they offered a 50% partial refund, which I declined.
After this, the case was closed and I was informed the decision is final. I then attempted to contact eBay support regarding the Money Back Guarantee, but I have been unable to reach a live agent.
At this point, I am unable to use the product for work and need a resolution. I am requesting guidance on how to proceed with a defective item case when support access is not available.

If that fails, file with your payment source for a defective product.

-- is there a way for "the case was closed"
-- if you had never "actually open a case with eBay?"

·4 months agoOf course I would not expect to see that a case was closed if one had not opened a case.
However, as several people have mentioned, it didn't sound like you had actually opened a case because you just mentioned having contacted the seller, which is not the same as opening a case.
And, if you did open a case, did you or did you not return to the case in three days and ask eBay to step in?

·4 months agoIt sounds like you made a complaint communicative when it should have been made automative within the MBG time frame. Did you ever file an "item not as described" case for a full return?

OP4 months agoI did, was offered a partial refund and I declined as I asked for a Full Refund. Now I'm blocked for asking another return and eBay's Chatbot refuses to connect me with an agent

·4 months agoThe previous two commenters have said everything you need to know - there is a process for obtaining a refund - if you don't use it, you may not get one. Google is your friend here too.

·4 months agoPer eBay's Money Back Guarantee for buyers, you had 30 days to open an item not as described case with eBay. Have to ask: Did you actually open a case with eBay? If so, was it within 30 days of receiving the defective item?
Again, per the MBG, if/when you did open a case, you needed to wait 3 days for a response from the seller. No response? Then you needed to return to that case and request that eBay step in. You would've been refunded from the seller's account and told to keep the item.
Don't know exactly for sure what you've done or not done, but if the case is closed with eBay, perhaps you skipped a step.
Your only option now is to do a chargeback with your credit card.
Sorry this happened to you. Please read the MBG so you'll know what to do if/when a problem happens again.

1-No need to contact the seller except through the automated return process located in your purchase history to the right of the item under "More Actions"-->"Return Item"-->"Item Defective".
"After this, the case was closed and I was informed the decision is final."
2-How were you informed of this? If it was in a message from the seller see #1
"I then attempted to contact eBay support regarding the Money Back Guarantee, but I have been unable to reach a live agent."
3-An agent can't do anything you can't do yourself (see #1).
