This just happened to me. Im the buyer, never delivered. The seller looked shady from the beginning. But had many positive reviews.
I've read many discussions on how to proceed.
Many say file a return as item not as described.
My question is if you haven't recieved anything, how do I file that? It is asking for photos to complete that selection.

OP2 weeks agoUpdate. After receiving the Amazon return label, I was kind of stuck. I spoke to ebay on Instagram and they told me not to ship an empty box. They told me they couldn't do anything for 3 business days.
So after waiting I told them it was a fake tracking scam. I uploaded the print from USPS. And they fixed it for me. Refund is on the way.
Thanks to everybody that helped with this and hopefully this discussion will help the next guy

·2 weeks agoIf the item was never delivered, “item not as described” doesn’t really fit because you don’t have the item to describe. I’d contact the platform’s support team and explain that the order was never received. Keep screenshots of the tracking information, order details, and your messages with the seller as evidence. They should be able to tell you which claim or dispute opti

·3 weeks agoIf you value your time and sanity AND want the best odds of winning, file for an item not as described.
aitarules
OP3 weeks agoThanks, that is my plan. But it asks for photos. What photo should I send?
powell-collectibles
·3 weeks agoAnything. You can just add a photo/screenshot of the listing.

·3 weeks ago · EditedLooks like you were the victim of the fake tracking number scam. If that's the case do NOT file an ITEM NOT RECEIVED case. You would lose that one because the seller can show it was delivered to your zip code. (this in one type of scam that ebay really has dropped the ball on).
Your first step is to get some documentation from the carrier that the item was NOT delivered to your address. Once you have that documentation then you can file a NOT AS DESCRIBED case. If the seller does not respond within 3 days then you can have ebay step in to get your refund.
If that fails as a last resort you can go to your payment source and state you were the victim of a fake tracking number scam.

OP3 weeks agoThanks, that is what I think is going on.
I'm heading to the post office. Don't know how receptive they'll be about giving me documentation.
Question. When I click on return item not as described. It requires photos. What do I send if I don't have the item?
shire123
·3 weeks agoPhoto of the documentation that it was not delivered to your address.
Note that you will NOT get info as to the exact address it was delivered to. There are privacy issues with that info. All you need is that it was NOT delivered to your address.
aitarules
OP3 weeks agoOk. Thanks

OP3 weeks ago · EditedUpdate. Went to post office. They printed out a paper with my tracking number and the delivery address, which is completely different than mine.
So I'll file as item not as described.
But what if the ****** actually sends a return label? Do I send an empty box?
eburtonlab
·3 weeks agoIn the unlikely event that a false tracking scammer sends you a prepaid return label, put exactly what you received (nothing) into a box along with a copy of the tracking documentation you obtained from the postal service indicating that the item was not addressed to you, slap the return label on the box and return it, being sure you get an acceptance scan from the post office.
Most false tracking scammers are unlikely to pay out of pocket for return shipping of something that was never shipped in the first place, though.

OP2 weeks agoUpdate. The scammer has provided a return label. But it is an Amazon return services label. Is ebay going to be able to track this?
powell-collectibles
·2 weeks agoIf that label is through USPS, UPS, FedEx - yes, eBay can see the tracking.
eburtonlab
·2 weeks agoWas the label provided through eBay, or from the scammer directly? I don't think eBay will provide an Amazon return label. The difference is important.
If the label comes directly from the scammer through email, and the scammer purchased something from Amazon to fulfill an order (or to provide tracking), then using an Amazon return label might get the scammer a refund from Amazon, but will not necessarily get you, the eBay buyer, a refund from eBay unless eBay knows the tracking corresponds to the return of the item you purchased.
mam98031
·2 weeks agoThe seller likely knows how to handle this by uploading the tracking number to Ebay.
You are still making assumptions that you have no proof of this seller being a Scammer. There are many sellers on Ebay that PAY Amazon to store and ship their inventory. The seller owns their inventory but pays Amazon for fulfillment services. There are also other companies out there that offer these services that other sellers might use. It doesn't make them bad sellers at all. These services are not free and cost the sellers real money to use but they have deemed they save money by using another companies services for fulfillment.

OP3 weeks agoTracking shows delivered to my zip code. It started with DHL and delivered with USPS. It says left in front porch.
My wife was home and I checked all video cameras to the front of the house. Nobody showed up.

Did you contact the carrier?

OP3 weeks agoTracking shows delivered.
Heading to post office soon.
shire123
·3 weeks agoThe suggestions for filing a "not as described" case is for the fake tracking number scam where the order's tracking number states it has been delivered. Did that happen to you?
Otherwise follow the advice of thriftyfiftyfifty below
aitarules
OP3 weeks agoYes, I think this is what happened. Heading to post office soon to see if I can get some info
thriftyfiftyfifty
·3 weeks agoYou go to your Purchase History, find the respective Order, and file "I Didn't Receive It" if it is past the last Estimated Delivery Date. That gets the ball rollin'. Very different from a Return.
aitarules
OP3 weeks agoI've read that you always lose this way, because ebay bots see that it was delivered to your zip code. They don't actually see what the actual address was.
