Help on a "vacant" address and "returned to sender" item
I sold an item and shipped to the buyer. On the delivery day the package was marked as vacant and a few days later it was marked as returned to sender. The funds were released so I had assumed the item made it to its destination. However, about a week later when I received a message from the buyer and took a closer look only to find the above situation. I asked to buyer to check with his local post office to see if he could pick up the item in person but I guess he could not in time, as I ended up with the package delivered to my home. I don't mind giving a refund but I do not want to have to eat the charges for the buyers mistake. What is my next move? get ebay involved? just offer a full refund? I do have the item back, but as I said I would prefer to not be out of pocket. He did pay for shipping during the initial sell.

I said I wasn't going to respond again, but I have to go back on that for one important reason:
You haven't provided a source for these instructions you keep posting.
That text does not appear in the eBay Money Back Guarantee. https://www.ebay.com/help/policies/ebay-money-back-guarantee-policy/ebay-money-back-guarantee-policy
If you're going to make something up, at least try to be convincing.

·11 months agoTHIS is what you've been posting. YES.
Pay CLOSE attention to what it says on top.
EXCLUSIONS AND SPECIAL COVERAGE WHEN BUYER DOESN'T RECEIVE AN ITEM
Then you circle the incorrect address inclusion. That covers when the item disappears, vanishes, GETS DELIVERED TO that incorrect address and BUYER NEVER RECEIVES THEIR ITEM.
That item is gone. Person who it was delivered to at that INCORRECT ADDRESS keeps that Buyers item. That immoral person at that incorrect address now has item. Denies they got it. It was delivered to their address, they are keeping it. OR, it gets lost in the shuffle trying to get back to the Seller, and Seller NEVER RECEIVES IT BACK themselves. No, Seller should NOT be out anything. THAT IS WHEN the MBG is voided.
But. Like I've said a dozen times here, RETURN TO SENDER, and Sender, Seller, receives it back, it is now a RETURN. Get that through your head. Good Gawd. Do you REFUND on RETURNS?? Yes.
Do Not read what is NOT THERE:
If a package is returned to you because the buyer gave an incorrect address, you have a few options:
Seriously man, I've dealt with people who have low comprehensive skills. But this conversation is kind of getting ignorant. Hard to deal with the ignorant. Case in point here. Waste of my time.

·11 months agoBuyers are not covered by the Money Back Guarantee when they have provided an incorrect or invalid address at checkout. eBay policy doesn’t differentiate between undeliverable items that have been delivered back to the sellers and those that haven’t.

·11 months agoConsidering this has escalated to personal attacks over the information presented, I feel this is necessary to provide the OP with confidence in their approach:
@devon@ebay
@elizabeth@ebay
Can you confirm that eBay will not require the seller to refund the buyer if their package is sent back as undeliverable?
hotwheelsbum
·11 months agoSo you're going to have some little 2 year ebay Rep give his opinion about an ebay policy that's been in play, and that we've been discussing for over a decade now as to exactly what that policy says.
A little lesson here. Definition of UNDELIVERABLE:
"Undeliverable" means unable or impossible to be delivered, typically referring to a letter, package, or message that could not reach its intended recipient due to issues like an incorrect address or other technical problems. It also describes something that was not delivered and cannot be delivered.
Once that package is deemed UNDELIVERABLE, it is rerouted back to sender when it is marked RETURN TO SENDER. When it is then DELIVERED back to Sender, USPS, UPS, FedEx, whatever, Tracking will show that it was DELIVERED. It is no longer an UNDELIVERABLE Package. Why? Because it was DELIVERED back to Sender. It was RETURNED back to Seller. It is now a RETURN. Sellers REFUND Buyers money when that item is RETURNED. MBG is voided if neither party, Buyer or Seller, ends up with item back in their possession. Seller should not be out anything when Item disappears, go missing due Buyers mistake, such as an Insufficient Address that causes item to go missing, disappearing, so on. EBay, Sellers can not "penalize", if that's the correct word to use, Buyers on ebay for mistakenly not having a "Deliverable" updated address on their account. That's ECommerce 101 that the FTC will have a field day with ebay if a Buyer who lost $3000 on an item that was RETURNED back to the Seller and Seller tries to keep that $3000 item, AND that Buyers $3000. That's internet Fraud, Theft. Nowhere in the EBay TOS Buyers sign up for does it state "If you fail to keep delivery address updated on your ebay account and the item you bought from a Seller on ebay is returned back to that Seller you forfeit all rights, ownership of that item AND the money you spent on that item". It does not say that in any wording whatsoever. RETURNS are recovered under the TOS. And if an item is RETURNED back to Seller, it is a RETURN. Sellers REFUND on RETURNS. Good God. How hard is that too understand?
Again, I've said this 10 dozen times over the years. A group of Ebay Executives and Lawyers DID NOT sit in room creating these Policies and came up "If an item is returned back to Seller due to an Insufficient Address, we're going to allow our Sellers to defraud that Buyer by not only keeping their Money, but they can keep the Item they spent that Money on also". It didn't happen. THAT would bring in the FTC and its Investigators telling these same Executives and Lawyers to explain HOW they thought they could get away with that. These Executives and Lawyers weren't sitting in a Smokey Room smoking Cigars laughing and cutting up coming with Policies that go against FTC Regulations to get over on Buyers like this. It didn't happen. They did come up with Return Policies that covers when an item is RETURNED back to Seller, it is RETURN. Return Policies do not specifically state HOW and WHY that item is Returned. RETURN is a very broad Policy, and Policy covers you Refund on Returns.
Has it become personal with insults? Not really. It's getting a little more obtuse because of the blatant ignorance of what the Policy actually says. Ignorance some of us whose been on ebay for over 2 decades now have had to deal with for well over a decade. Case in point here.

·11 months agoI probably wouldn't feel good about being paid for something I got back.
If they still want it...
I'd probably cancel the order with the reason problem with address (If you have that option)
and redo it with the first shipping price added in
or
a separate listing for the shipping if they still want it
or
probably just ship it back and be done with it
(that would surely earn me bonus customer service points)

·11 months agoeBay does not require you to refund the buyer at all in this situation.
Most sellers will refund the cost of the item minus shipping and eBays fees.
sammbids
OP11 months agoI see. Thank you very much.
hotwheelsbum
·11 months agoWrong. Seller got item back. It was RETURNED to Sender. It is now a RETURN. Yes, you do REFUND for RETURNS. Minus any shipping costs associated with that RETURN.
Your advice here is one of the biggest misconceptions Sellers has had with this Policy for years. If item disappears, neither Buyer or Seller ends up with item in question due to an "insufficient address", then No, Seller does not have to refund anything. Mistake by Buyer should not cost Seller. But if it was RETURNED to Seller, it is a RETURN. You REFUND for RETURNS.
And to think that EBay Executives sat in a room full of High Dollar Attorneys when righting up these policies said "If item is RETURNED to Seller because a Buyer forgot to update their address, that they can now KEEP that Buyers Item AND their Money because the Buyer made a mistake", is just stupid, ignorant.
Take it as you will. Lot of ignorant Sellers are going to come here and try to say, "BUT AN EBAY REP SAID THAT'S WHAT THE POLICY SAYS", are just as ignorant as that ebay rep is. Try keeping my $1000 item AND MY MONEY when MY ITEM that I paid for is returned back to you. (Verified-Tracking-So on) We'll see how well that works out in the court system.
kensgiftshop
·11 months agoIf buyer provides a bad address and the policy says the MBG is voided, not much the courts would do.
Provide a good address and you wouldn't have to worry about it.
hotwheelsbum
·11 months agoWrong. Policy says if item is not DELIVERED TO Buyer due to an Insufficient Address, then MBG is voided. As in item disappears, actually delivered to Insufficient Address and recipient kept the item, denies receiving it, refuses to give it to Buyer, or it just overall disappears being shuffled in the postal system due to that Insufficient Address, then Yes, ebay is NOT going to penalize the Seller. MBG is Voided. No reason Seller should be out due to Buyers mistake.
BUT, if Tracking shows item WAS DELIVERED, as in it was DELIVERED back to Seller, it is now a RETURN. And Yes, you do REFUND for Returns. Minus any shipping costs Seller may be out. Sellers are NOT allowed to deny Buyers that item they paid their Money for due to a simple mistake by not updating their physical address on an online website. Sellers CANNOT keep BOTH that online consumers item AND money. That Fraud, Theft, covered under Federal Laws. Federal Laws an in using the Banking System for the monetary transaction, and using the Postal Service to transport item from Point A to Point B then back to Point A.
Do you really think any Judge in America is going to say, "What?? You forgot to update your address, so I'm going to allow that Online Seller to keep your $3000 Item when it was RETURNED to them. Plus, even though they received the Item back when it was RETURNED to them, I'm going to let that Seller keep your $3000 too?" ECommerce does not work like that. And that's NOT what that Policy says. It's been so misconstrued over the years it's pitiful. And very ignorant to think a Seller can keep BOTH a Buyers Money AND Item over a simple little account infraction.
Answer this.
Do you REFUND a Buyers Money when that item they bought is RETURNED to you? Return Policies DO NOT cover HOW that item is Returned to Seller. It Covers RETURNS. "Return To Sender" is a RETURN. Item in question has been RETURNED. Legal Commerce 101. EBay Return Policy 101. You Refund Buyers money when item is Returned. It's that simple. And to think any different makes one obtuse, ignorant.

You’re clearly very passionate about this. But you’re trying to apply your own definition to terms that are well defined legally and in the industry. If you are ever in that situation you are welcome to consult a lawyer, but until then I don’t see any reason we should change the advice provided on these boards based on eBay policy.
momtoabeautifuldaughter
·11 months agoAnd to not understand eBay policy that you agreed to when you signed up for eBay makes you the above it seems.
jonathanbrightlight
·11 months ago@hotwheelsbum
The statement by @klhmdg was that eBay will not force you to refund. That is 100% factually correct. Whether it is legal is not what was being stated.
hotwheelsbum
·11 months agoActually that's not 100% correct.
Buyer buys item. Buyer does not have updated address on account. Item is RETURNED TO SENDER. Buyer is still expecting item. Still waiting on item to arrive. Buyer finally looks at tracking and learns that the item he just spent $1000 on has been RETURNED TO SENDER. Tracking shows that item has been RETURNED to Seller. Seller is in possession of his $1000 item. That is a valid INR. Item has been DELIVERED. It hasn't disappeared like what the MBG covers under "insufficient address", that item is still in play because it was RETURNED to Seller. Do you really think Ebay is going to tell that Buyer tough shyyyt, you f'ed up with your address so we're letting that Seller KEEP your item AND your money? No they are not. Ebay can, will, and HAS made Sellers REFUND money to Buyers for items that has been RETURNED to them because it wasn't delivered to their Buyer due to an insufficient address, but was DELIVERED back to them, RETURNED to them. You REFUND RETURNS. It's ebay policy. Insufficient Address only covers if item disappears, vanishes.
And, there's no passion about it. It's what the Policy covers. We have discussed this a hundred times in those Cheesy EBay Sellers Groups all over Facebook for well over a decade now. At one time in the past, some uninformed aloof Seller misinterpreted that Policy, looked at it with ignorance, came up with this narrative, and like liberal cue cards, others kept repeating it as a talking point HOPING that if it's repeated enough times, that it may be reality after all. And now here we are in 2025 still dealing with this ignorance.
It's not that hard to understand.
jonathanbrightlight
·11 months ago@hotwheelsbum
I have never once seen a case where eBay made a seller refund for an undeliverable item, and their policy explicitly states that they will not. Your claim is simply incorrect.
hotwheelsbum
·11 months agoIt's been well discussed, and verified, in Facebook Groups for years where ebay has made a Seller refund the money to the Buyer when the item was returned back to Seller because it was not delivered to Buyer due to an Insufficient Address. Many times this has happened. My claim is correct, you're just misinformed, uneducated on how the policy works.
Again, TRY keeping an online Buyers $1000 item AND their $1000 when an item they bought is DELIVERED back to you, the Seller. You are in possession of that Buyers $1000 item. Your contract with ebay is to get that item to that Buyer, and if you cannot, will not, you REFUND that Buyers $1000. That's Ecommerce Law, regulated by the FTC.
The Federal Trade Commission (FTC) does regulate internet salesby enforcing federal consumer protection laws against fraud, deception, and unfair business practices in e-commerce.The FTC's authority covers various online activities, including advertising, commercial email, consumer privacy, and product delivery, and they also recently enacted the INFORM Consumers Act to increase transparency for high-volume third-party sellers on online marketplaces.
I would kind of suggest learning this before going any further with this nonsense you've been exposed to to believe.
jonathanbrightlight
·11 months ago@hotwheelsbum You’re free to believe what you wish, but I have been very specific that I am talking about eBay policy, not the law or the FTC. I won’t respond to you again, since you aren’t having the same conversation.

·11 months agoActually if the tracking shows it was returned due to an undeliverable/incomplete address eBay will close an INR in favor of the seller.

·11 months agoBut doesn't ebay automatically refund as soon as the tracking shows it was returned?
jonathanbrightlight
·11 months agoNo. eBay will not force you to refund an undeliverable package as stated. You’re thinking of when a formal return request has been filed and the item is returned to you with a return shipping label.
(Edited because I missed which thread this was.)

·11 months agoOk gotcha.

·11 months agoThis message in response to your question is incorrect.
"No. eBay will not force you to refund an undeliverable package as stated. You’re thinking of when a formal return request has been filed and the item is returned to you with a return shipping label."
What's right is No, ebay does not automatically refund when tracking shows it was returned. But, when Buyer either ONE, files an INR and ebay sees that tracking shows it was RETURNED TO SENDER, Yes, ebay will require Seller to REFUND Buyers money. Or TWO, if Buyer contacts ebay and shows that THEIR item has been RETURNED to Sender and Buyer has requested a refund, and Seller is refusing (because Seller listened to some ignorant fool on the internet who told him he didn't have to refund) then ebay CAN, WILL, and HAS forced Seller to REFUND the Buyers money for that RETURN.
Ebay will NOT force a Seller to refund an "undeliverable" package when that package goes missing, as in the examples I stated above. But if Tracking shows that package WAS DELIVERED back to the Seller, it has been DELIVERED (RETURNED) back to its origination. Go read what those Policies cover. The RETURNS policies, and what we're referring to here. NOWHERE under that "Insufficient Address" Policy does it state that a Seller can KEEP Buyers Item AND Money when an Item is RETURNED back to them. The MBG coverage is only voided when, AGAIN, that item goes missing. When it is RETURNED back to Seller, it is now a RETURN. And Yes, you do REFUND for RETURNS.
