Buyer wanted 3 guns from 7 gun lot (notice the extreme gaslighting on initial contact). I work with buyer for a FAIR agreement. Buyer states he buys and repairs broken guns and has done so 100 + times. My listing condition is parts- repair- nonworking.
Buyer ""cherry picks" 3 guns specifically by make- model number (422, 130. Marksman) BTW, All 7 guns are different with specific naming details- no duplicates.
We agree on a price of $300 which includes shipping, I also agree to wait on payment so buyer can take advantage of some offer for payment.
Buyers pays- I ship
Upon receipt buyer contacts me indicating he did not receive a gun he asked for, he claims he received the Marksman not the MKI he wanted. He never referenced the MKI in our negotiations.
I try to make it right by him, I make offers on the cost of the MKI going down to $30 just to be done with this lunatic, I cant give it away due to principal.
Ultimately he falsely open a return - item not as described. I report him the same day for abusing Ebay policy - false claim.
I call Ebay and speak to Dolly and ask her what response do I make to the return, she advised me to not respond and call Ebay back on the 11th at 9:00am and the case will be decided in my favor, Because the messages were very clear that the buyer was making a false claim.
at 2:00am on the 11th Ebay sided with the buyer due to no response to the return,
I called Ebay again and spoke to Marcicis who reviewed the message and OVERTURNED the ruling to my favor.
on August 16th the buyer filed an appeal and overturned my decision based on lack of response to a return.
I call Ebay AGAIN spoke with IRA who reads messages and agrees that I should be the one who is correct. she files a appeal and tells me to call back 72 hrs later.
I get emails from Ebay saying the buyer is awarded my items and my money.
I Call Ebay back again and Yashka agrees that I am right and Ebay made a mistake BUT THERE IS NOTHING THEY CAN DO ABOUT IT

I didn’t have a Marksman II listed. I had a Crosman MKI. I am the one who tried to work with you. I had 7 guns listed and you approached me to cherry pick from the lot. I listed the all as parts guns and had several pictures showing condition. Now you a person who apparently repairs guns has had these in your possession for a week and now wants to return them. I continued to try and work with you by offering the MKI for little more than shipping cost and now you want to return them. I don’t want them we had a deal for the initial 3. Then we had another deal for the MK I.

All of my listings are accurate depictions of the items, these guns were described as parts guns and had pictures to verify. I worked with you and gave you all of the things you asked for.

I will work with you, I was going off the last message where you stated Marksman in your request. I understand that you are a BB Gun guy who fixes them and all So I was convinced you knew what you were asking for. To be honest, that is why I made the deal because you were essentially cherry picking all of the best guns from my lot, so it made sense to me you got 2 good- rare ones, and one not so good - rare. I would not have sold the 422, 130, and MKI for $300 with shipping. the best I would have done on that deal would have been more like $400. Like you, I too do this to make money, and I want to be fair and I really want repeat customers. So here's what Ill do. I'll offer you the MKI and the 150 for $175 shipped.
I will also keep you in mind for these low profit deals in the future so we both can make money.

Spoke with Dolly – Escalations Wednesday Aug 9th.
She reviewed the Messages between me and Ames and acknowledged he requested three guns (422, 130, and Marksman).
She also reviewed the original listing which stated these were parts guns and saw o the messages where I informed the buyer the 422 was a parts gun and appeared complete.
The buyer approached me and cherry picked three guns from seven and requested additional time to pay all of which I agreed to.
He says in his messages AFTER he received the guns that he was talking about the MKI, never did he mention the MKI prior to receiving his items,
He sent me pictures of the guns with pieces removed- -altered, they were not that way WHEN I SHIPPED THEM.
He BUYS HUNDREDS of guns to fix and resell, now he wants to send me back my guns after he has had a chance to swap, take parts.
He also states that one gun has the frame cracked which was not the case when I SHIPPED THEM
