Counterfeit shoes, scam seller. Am I able to file a 2nd case?
I purchased shoes (NIKES) on December 14th from what I thought was a US seller and was told they would ship out within 3 days. 3 days rolls around and there's no movement and I'm told they should be shipped from the warehouse soon. Red flag #1, I thought the seller had these shoes and it wasn't coming from a warehouse. A couple more days goes by and still no tracking number so I reach out again and suddenly I receive a FedEx tracking number that was made out of Hong Kong....Red flag #2. It then sits for 3 weeks with no movement other than "label made" until I open an "item not received" case with eBay. Miracously, it then starts movement and I have it within 2 days. FedEx shows actually ship date was 1/5 instead of the 12/17 as it should have. I receive it within 2 days of movement and long and behold, they are counterfeit shoes. Took them to a Nike store and they confirmed our suspicions. The listing I had bought was removed due to a eBay violation but wasn't bc of me since I hadn't brought up the issue yet and the item not received case closed by eBay bc I now have my item. When I received shoes and told the seller my suspicions, it said the seller was now away and wouldn't be back until the 12th and all of his listings are no longer listed. The seller doesn't accept returns but I have the option of trying and uploading pix of the item which looks like the picture but is NOT real Nikes. What are my options? I don't see that I am able to open up a 2nd case with eBay for fake shoes.

·8 months agoWhen sellers are on time away from selling, they are still required to fulfill all returns and issues that may come up within ebay's allotted time frames. Time away does not allow a buyer to ignore responding to INR INAD , or refund request cases. So file your INAD case & no more communicating with the seller

Since these came from Hong Kong? if true...seller may not want a return and will give a refund as well.
Sit tight after opening the claim. Seller will try hard to work things out with you...don't respond.

·8 months agoIf it is within 30 days of receipt, you should be able to open an Item Not As Described request for a return.
You could instead open a dispute with your credit card issuer which has a longer time limit on that dispute you can explain you received a counterfeit product.

You should be able to open a "Not As Described" return if your previous case was an "Item Not Received" case -- as long as you did not win the INR case and already get a refund, of course.
The seller being away or not accepting returns for remorse reasons should not affect your ability to open a case and ask eBay to step in, if necessary.
